AMENDMENT. - Sections 7, 11 and 21 (A) of Provincial Ordinance No. 254-2009, the Investment Incentive Code of the of Province of Agusan del Norte shall hereby be amended. Section 7 of Provincial Ordinance No. 254-2009, that reads: “Section 7. A. NON-FISCAL INCENTIVES. The PIIPMT shall facilitate investment incentive application processing and shall provide investors an_ investment processing guide for each identified investment priority areas. Is hereby amended to read as follows: “SECTION 21 (A). FISCAL INCENTIVES. The investors, whether local, private or foreign shall refer to the Local Investment Code of the concerned city or municipality. A. NON-FISCAL INCENTIVES. The PIIPMT thru the Local Economic Development Investment Promotion Office (LEDIPO) shall facilitate investment incentive application processing and shall provide investors an investment processing guide for each identified investment priority areas.” SECTION 2. REPEALING CLAUSE. - All ordinances, MAY ssa \ rules and regulations, and issuances, or parts thereof inconsistent with any or all of the provisions of this Ordinance are hereby amended, repealed, or modified accordingly. SECTION 3. SEPARABILITY CLAUSE. — If for any reason, part/s, or provisions hereof is/are declared unconstitutional, ultra vires, or inconsistent with law by a competent authority, part/s thereof not affected thereby shall remain valid and in full force and effect, otherwise repealed, modified, or amended accordingly. Bungabong, forwarding the draft of the 2019 Local Investments and Incentives Code (LIIC) of the Province of Agusan del Norte. ACTION TAKEN: The committee convened on May 13, 2022 to discuss the said measure. FINDINGS AND RECOMMENDATIONS: Under Committee Progress Report 02-2020 of the Committee on Economic Zone, Trade, Industry, and Tourism which was adopted by the Body on its 27th Regular Session, dated January 20, 2020, the Committee informed the Body that it needs a re-indorsement of the said proposal to resolve the issue whether the Sangguniang Panlalawigan can amend the existing Provincial Ordinance No. 254- 2009 without any consultation from the Agusan del Norte Investment and Promotion Board (ADNIPB). The Committee has also consulted with the Provincial Economic Enterprise and Development Officer'and the Provincial Assessor for further study and review regarding the said amendment of the 2009 Local Investment Incentive Code (LIIC). During the committee hearing, the Committee together with the above- mentioned offices has agreed for the amendment of the Investment Code particularly the sections comprising the Agusan del Norte Investment and Promotion Board (ADNIPB) and the Provincial investment Incentive Promotion and Management Team (PIIPMT). It has also agreed for the amendment of the Fiscal and Non-Fiscal Incentives to be granted for the local/ Private Filipino/ Foreign Investors Under the proposed amendatory ordinance, there would be a deletion for the “Co-Chalrperson: Business Sector (to be appointed by the Provincial Governor)” for the composition of the Agusan del Norte Investment and Promotion Board. Also, the Provincial Assessor is added for the composition of the Provincial Investment Incentive Management Promotion Team. Fiscal incentives is also amended that the investors, whether local, private or foreign shall refer to the Local Investment Code of the concerned city or municipality provided, that the respective city and municipalities also have its own Local Investment and Incentive Code. On the other hand, on the granting of non-fiscal incentives shall also be amended that the PIIPMT thru the Local Economic Development Investment Promotion Office (LEDIPO) shall facilitate investment incentive application processing and shall provide investors an investment processing guide for each identified investment priority areas. Norte Investment Promotion Board (AdNIPB) as created pursuant to this code, b) Bona fide Resident - refers to a person with at least six (6) months residency or a registered voter of the province of Agusan del Norte. ©) Capitalization — refers to the total project cost. d) Existing enterprise — refers to an enterprise already operating in the Province of Agusan del Norte and plans to diversify/expand to other business ventures falling within the IPA as defined by the Board. e) Expansion — shall include modernization/rehabilitation/increase of existing volume or value of production and/or upgrading of the quality of the registered product or utilization of inefficient or idle equipment under such guidelines as the Board may adopt. ) Foreign Investment — shall mean equity investment owned by a non- Philippine national made in the form of foreign exchange or other assets actually transferred to the Philippines and registered with the Central bank of the Philippines and the Board of Investment which shall assess and appraise the value of such assets other than foreign exchange. 9) Government - refers to the Local Government Unit of the Province of Agusan del Norte and its Municipalities/City. h) Investment Code — refers to the Agusan del Norte Investment Incentive Code of 2009. B: Local Investment Priority Areas or LIPA‘S © LIPAs should be identified in the LIIC through the Board; and * The Board shall undertake periodic review of the LIPA list, in consideration of the Socioeconomic Development Plan and Public Investment Plans of the LGU and Preferred Areas of Investments; 13 ~ w Note: The criteria adopted for IPA selection shall likewise govern each and every subsequent amendment of the LIPA List. Removal of a sector or area from LIPAs can be recommended by the Board in the following instances: (a) as soon as the sufficient investments in the area has been attained; and (b) continued extension of incentives is no longer to the interest and benefit of the locality. VII. The Province of Agusan Del Norte’s Registration Procedures and Registration Requirements VIL. A: Registration ‘© Registration is a requisite for the availment of incentives. Investors must apply for incentives. + Those entitled to local incentives under Incentives Law shall apply by completing their registration with the LIB at the soonest possible time after they have secured their Certificate of Registration from BOI under the applicable incentives law. ‘* Registration is different from securing a business permit, and independently administered. Investors can apply for business permit ahead of registration for incentives. VII. B: Registration Eligibility for Inward Bound Investments « "Wew Projects” refer to the projects or activities in the IPA List that have not started commercial operation, undertaken by (1) a newly organized/formed enterprise; or 2) an existing business that proposes to engage in an entirely distinct activity from its current business would qualify as a Diversification. 4 * “Expansion” shall mean installation of additional facilities/equipment that will result increase in the production capacity of an Existing Business. It may include modernization and rehabilitation. No expansion for additional capacity shall be allowed unless applicant has attained, in general, 85% utilization of its existing capacity. + "Modernization or Rehabilitation Project” refer to projects of Existing Businesses or Registered Enterprises that are qualified to be registered and eligible to incentives, if any of following conditions are met, viz: - at least twenty percent (20%) reduction cost, which if sold in the Philippines should result in the reduction of the selling price of the product; or = significant increase in productive efficiency including de-bottlenecking; or - meaningful upgrading or product quality; or = upgrade in the technology used in production to bring it at par with the technology used by leading manufacturers of the product manufactured by the Registered Enterprise. * “Diversification” refers to the introduction and production of a distinct line of products or services by an Existing Business, whether or not Registered Enterprise; Provided that, to be considered distinct, it should require new investment in terms of machinery or equipment or would involve the use of new set of skills not currently used in the existing product or services, Provided further, that a new service or product may constitute a diversification even if such service or product is already within the scope of its original or existing business purposes. VIL. C: Registration Eligibilit isting Ir 15 ~ w~ + Existing investment qualified as IPA and a business of “good standing” may also seek registration and apply for the incentives being provided by the LGU. Note: Business of good standing means those business religiously paying taxes and other fees, has no existing tax delinquency, no incidence of under- declaration of gross receipt for business taxes and has not been involved in any cases in business operations (e.g. labor, bribery or corrupt practices) for the past five (5) years. VIL. D: Documentation Requirements 1. Duly accomplished and notarized Application Form Certified true copy of the primary registration of the applicant to do business in the Philippines as issued by the DTI, SEC, or the CDA, as applicable; The latest available comparative audited financial statements acknowledged/received by the BIR and the SEC ( in case of corporation), if the applicable has already started operation; and Proof of proposed place of business which shall show that the main operating facility, whether a services/manufacturing/production facility or plantation, and not just the warehouse or the administrative office of the applicant is located within the territorial jurisdiction of the [Province/City/Municipality]. Additional requirements for those registered under an incentive law * Certified true copy of its Certificate of Registration with the appropriate registering agency pursuant to the applicable incentive law granting applicant's business, investment incentives, including the terms and conditions of the same; 16 * Proof of commencement of commercial operation, if commercial operation has commenced; and * Copy of the Feasibility Study/Project Study submitted to the Registering Agency. Additional requirements for local registrants * Project Study (Exempting micro business is encouraged) * Proof that the applicant meets the criteria pursuant to which it is aiming eligibility to avail of incentives; and * Other specific permits applicable to the business of the applicant by virtue of its location or the nature of its activity, e.g.., Environmental Clearance Certificate (ECC). VIL. E: Registration Procedures 1. Filling of Application Form — Filling of application Form, form verification of documentary requirements, acceptance, and stamping date of “official acceptance”; 2. Assessment — Payment of reasonable fees. Micro economic enterprise are exempt from payment; 3. Evaluation and Approval ~ to be conducted by LEIPC and LIIB for a maximum period of sixty (60) working or calendar days and thirty (30) working or calendar days for enterprises with certificates of registration under an incentive law; inaction by the Board within the maximum period means approval of application. 4. Issuance of Registration Certificate — within a period of five (5) days working days. Note : Validity of the Registration shall be from the date of approval until the 7 termination of any incentives granted to registered investment, unless sooner revoked by the Board. VIL. F: Grounds for Cancellation of Registration Violation of the provision of the Code and violation of other relevant laws, rules and regulations or ordinances issued pursuant to or in relation to the Code; Violation of the terms and condition specified in the Certificate of Registration issued under the Code; or Fraudulent misrepresentation by an enterprise in relation to its application for the grant of incentives under the Code or in any other document required to be submitted pursuant to the Code. VIII. The Province of Agusan del Norte’s Fiscal and Non — Fiscal Incentives to Investments: Incentives Privileges granted to investments to attract or retain them. Granted by the national government through the promulgation of Incentives Laws and the local government unit through the power vested to them by the Local Government Code. Fiscal incentives i.e. tax holidays; and, non fiscal incentives General Policies on Incentives It shall be based on categorical/clear criteria, time-bound, and consistent with the existing laws. The incentives shall be fairly administered to ensure a level playing field for investors in the locality. 18 «The incentives shall be extended only to investment activities enumerated in the MIPA list and LIPA list. Conditions for Continuing Incentives * Efficient use of natural resources to conserve and protect those indigenous to the [Province/City/Municipality]; Minimize the adverse impact or enhance the positive effect of their operation on the environment by undertaking business practices that adhere to the country’s environmental laws, such as efficient solid waste pollution management, adopting technologies that reduce greenhouse gas emissions, and implementing climate change adaption measures and disaster risk reduction and management, among others; * Compliance with all applicable labor law and standards, including those relating to occupational health and safety; and + (Registered enterprises enjoying fiscal incentives beyond three (3) years! PROVINCIAL ORDINANCE NO.254-2009 INVESTMENT INCENTIVE CODE OF THE PROVINCE OF AGUSAN DEL NORTE BE IT ORDAINED, by the Sangguniang Panlalawigan of Agusan del Norte, in session assembled, that: i CHAPTER I GENERAL PROVISIONS Pest SECTION 1. TITLE - This Ordinance shall be known as “The Investment Incentive Code of Agusan del Norte”. SECTION 2. DECLARATION OF POLICY ~To accelerate the sound economic development of the Province., it is hereby declared to be the policy of the Province of Agusan del Norte to pursue an environmentally, sustain, sustainable and equitable growth’ by encouraging local, private Filipino and foreign investment in the province which will responsibly utilize its natural resources, provide employment opportunities and equitably distribute wealth to its people. In line with this, through the Agusan del Norte Investment incentive Code, the Province will formulate and implement policies necessary to provide clear-cut and comprehensive action plans and investment guidelines that will establish @ solid foundation for its sustainable socio economic growth. SECTION 2. OBIECTIVES — This Ordinance is enacted to attaln the follawing objectives: | 1.
