Compromise Agreement

COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This COMPROMISE AGREEMENT is executed and entered in

Zamboanga City, Philippines on _______ by and between:

VINCENT MERTALLA CATARATA of legal age, single, Filipino

Citizen, and a resident of Zamboanga City, herein referred as the FIRST
PARTY;

-and-

RODOLFO EBOL MOLINA of legal age, Filipino citizen, and a

resident of Kawit, Zamboanga City, Philippines, herein referred as the
SECOND PARTY.

W I T N E S S E T H:

Whereas the FIRST PARTY is the CREDITOR.

Whereas the SECOND PARTY is the DEBTOR.

Whereas both the FIRST PARTY and SECOND PARTY, in order to

buy peace and tranquility, have agreed to enter into this Compromise
Agreement subject to the terms and condition stated below.

NOW THEREFORE, the SECOND PARTY do hereby these presents

UNDERTAKES TO PAY the FIRST PARTY the settlement and, as a
consequence, the FIRST PARTY also expresses its willingness to DESIST
from filing the complaint under the following terms and conditions, to wit –

1. Upon the execution of this compromise agreement, the

SECOND PARTY shall pay the FIRST PARTY the amount of THREE
HUNDRED THIRTY THOUSAND (P 330,000.00) PESOS Philippine
currency payable until 31 December 2022;

2. Non-compliance of the SECOND PARTY of the terms and

conditions found in this Compromise Agreement would render the
FIRST PARTY to file a case before National Prosecution Service,
Office of the City Prosecutor, Hall of Justice, Sta. Barbara,
Zamboanga City against SECOND PARTY and in all or any available
jurisdiction, offices, courts or agency.
