Malabar County Lease Agreement
This Agreement for Leave and License made and entered into at Mumbai
BETWEEN
Indian Inhabitant of Mumbai, presently having address at Flat No. 402141, Juhu
meaning thereof is deemed to mean and include her heirs, executors, administrators

Monthly Compensation i.e. Rs. 5000014500/- shall be remain on the other Licensee.
4. The Licensees have deposited with the Licensor the sum of Rs.

the terms and conditions contained herein, receipt whereof the Licensor both hereby

admit and acknowledge. It is expressly agreed to and declared by the parties hereto
that if the Licensees commit defaults or breach of any of the terms and conditions

-herein, the Licensor shall be entitled to and at liberty to forfeit the said deposit
amount without prejudice to his other remedies at law and shall be entitled to and at
liberty to remove the Licensee(s), their members of family, staff, employees and
servants and their office equipment, furniture and other articles lying therein. It is
further agreed to and declared by the parties hereto that the deposit amount shall
remain with the Licensor and shall be refunded without interest to the Licensees on
included of the monthly compensation etc. of said licensed premises will be paid by
the Licensee/s and the Licensor will not be responsible for the same.
6. The Licensee can obtain their own Telephone connection in the Flat Premises
at their own cost and the Licensor shall not be liable for any expenses whatsoever for
the same.
7. The maintenance and society charges shall be paid by the Licensor Licensee to
the Soceity.
8. The Licensor shall not be liable for and/or in respect of any damage or
to any workman or other person in the employment of the Licensees and the
Licensees shall indemnify and keep indemnify the Licensor against all such damages
and compensation and against all claims, demands, proceeding, costs, charges and

10. The Licensees shall be deemed to be Licensees only by virtue of there presents
and shall not make or have any claim to tenancy, sub-tenancy, lease or any other
right, title or interest of whatsoever nature in the said premises or any portion thereof.
It is agreed between the parties hereto that the Licensees shall not grant agreed
between the parties hereto that the Licensees shall not grant any sub-License to any
other person and shall not keep any other person in place of the Licensees.
11. The Licensees shall not, under any circumstances, have any right to deal with,
assign or dispose of in any manner whatsoever all or any of the benefits under this

water or gas pipes or electric wire fuses or tubes or any other causes whatsoever.
15. The Licensees shall not change or alter whether temporary or of permanent
nature in the said premises or any portion thereof without written consent of the

16. It is hereby expressly agreed and declared that upon the Licensees complying
with the terms and conditions of this Agreements, they shall be entitled to use and
occupy the premises during the Period of this License or renewal thereof as the case
may be without any interruption from the Licensor or any other person or persons

equipment, furniture articles and things from the said Premises or any part thereof and
shall restore vacant and peaceful possession of the said Premises to the Licensor. In
the event of Licensees fails to handover vacant and peaceful possession of the Said
Premises in good and clean condition to the Licensor on expiry of this Agreement as
above, the Licensor shall be entitled to and at liberty to enter into the said premises
and retake possession thereof from the Licensees without recourse to a Court of Law
and without prejudice to the right of the Licensor to recover damages from the
licensees.
19. If the Licensees fails to handover vacant possession of the premises in good
and clean condition within the stipulated time as stated hereinabove or on expiry of
the Agreement, the Licensor shall be at liberty to recover the compensation and
arrears, if any, at an enhanced rate as may be deemed fit and proper by him till
recovery of the Premises from the Licensees and all other moneys payable by the
Licensees.

20. At the time of Licensee/s leaving the said premises the Licensee/s shall be
entitled to remove all items belonging to the Licensee/s brought into the said
Premises.
21. It is agreed that the provisions of Section 24 of the Maharashtra Rent Control
Act, 1999 as amendedIn the event of any breach of the terms and conditions of this
agreement by the Licensees and not remedied by the Licensees within one month
from the receipt of the written requisition from the Licensor(s), the Licensor(s) shall
be entitled to revoke and cancel the License here by granted after giving one month’s
notice in writing and thereupon the Licensees, their officers, and member of their
family shall remove themselves from the said Residential Accommodation with all
their goods and belongings. shall apply in the event of the failure of the LICENSEE to
vacate the said Premises on the expiry of the period of license as agreed upon and/or
on breach of any of the terms and conditions of this agreement.
22. The Licensee/s will vacate the Flat and hand over possession to Licensor
immediately on expiryof this Agreement. If not they have to pay Penalty of Rs.
5,000/- per day in addition to the normal rent payable till the date possession is
handed over.
23. If due to any reason whatsoever, if rent is not paid for a period of two months,
Licensor has a right to take over the possession of the Premises, irrespective of what
is mentioned in this Agreement.
24. Both the parties hereby confirm that Stamp Duty, Registration Charges, if any
will be paid by the Licensor and Licensee/s in equal proportion.
