A RESOLUTION IN THE MATTER OF RESPECTFULLY REQUESTING

THE HONORABLE GELACIO R. MANALANG, CITY MAYOR, TO ADVISE
THE OFFICES UNDER THE CHIEF EXECUTIVE WHO ARE TASKED TO
IMPLEMENT LOCAL ORDINANCES TO STRICTLY ENFORCE
PENALTIES FOR ANY VIOLATIONS THEREOF AND TO REFRAIN FROM
REFERRING TO THE OFFICES OF THE MEMBERS OF THE
SANGGUNIANG PANLUNGSOD, ANY APPEALS FOR
RECONSIDERATION FROM PERSONS OR ENTITIES WHO ARE FOUND
VIOLATING ANY LOCAL REGULATIONS EXCEPT AS OTHERWISE
AUTHORIZED OR STATED IN THE ORDINANCE

WHEREAS, Section 458, Paragraph (a) of the Local Government Code of

1991 provides that: “The Sangguniang Panlungsod, as the legislative body of the
City, shall enact ordinances, approve resolutions and appropriate funds for the general
welfare of the city and its inhabitants x x x.”

WHEREAS, Section 455, Paragraph (b.2) of the same Code empowers the
Local Chief Executive to: “Enforce all laws and ordinances relative to the
governance of the city and in the exercise of the appropriate corporate powers x x x,
implement all approved policies, programs, projects, services and activities of the
City”;

WHEREAS, every provision of an approved Ordinance, represents a collegial

legislative action of the Sangguniang Panlungsod, which, essentially, cannot be
attached or associated to a single legislator, inasmuch as it is a collective decision of
the Sangguniang Panlungsod as a homogeneous institution;

WHEREAS, there are several instances that certain Offices or employees under
the Local Chief Executive referred to my Office some persons or entities who are
seeking reconsideration for violations of local ordinances hoping to be relieved of the
penalties corresponding thereto;

WHEREAS, such practice needs be stopped as it will not only retards the
effective implementation of local ordinances, but also opens windows of graft and
corruption;

NOW THEREFORE, on motion of Councilor Glen Troy S. Caritativo, duly

seconded;

RESOLVED, that a request shall be respectfully made to the Honorable Gelacio

R. Manalang, City Mayor, to advise the Offices under the Chief Executive who are
tasked to implement Local Ordinances to strictly enforce penalties for any violations
thereof and to refrain from referring to the Offices of the Members of the
Sangguniang Panlungsod, any appeals for reconsideration from persons or entities
who are found violating any local regulations, except as otherwise, authorized or
stated in the Ordinance.
