CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS

This CONTRACT TO SELL is made and executed in Angeles City, this 17th day of
January, 2022, in Angeles City, Pampanga, Philippines.

MELVIN QUIAMBAO PASION, single, of legal age, Filipino Citizen and a resident of
2130 Sta. Cruz St. Santa Teresita, Angeles City, Pampanga, hereinafter referred to as the
"SELLER";

-and-

SPS. RUDY G. TAN & SALVACION OYOS TAN, of legal age, Filipino Citizens and
residents of Dau Homesite, Mabalacat, Pampanga, hereinafter referred to as the “BUYER”;

WITNESSETH

WHEREAS, the SELLER is the true and registered owner of a parcel of land, covered
by Transfer Certificate of Title No. 042-202000732, more particularly described as
follows:

Portion of: Lot 19 (LRC) PCS-19869
Location: Barangay Manibaug Paralaya, Mun. of Porac
Area: Eighty (80) square meters

That the SELLER is willing to sell the above-described parcel of land to the BUYER
containing a total area of Eighty (80) square meters;

That the BUYER, is desirous, willing and capable in buying the above-described real
property;

NOW THEREFORE, for and in consideration of the above premises the herein
parties have agreed as they hereby agree subject to the following terms and conditions, to
wit:

1. That the total consideration of the above-described property together is in the


amount of THREE HUNDRED THOUSAND (P 300,000.00) Philippine Currency;

2. That upon signing of this document, the BUYER will pay SEVENTY THREE
THOUSAND PESOS (P73,000.00) to the SELLER, as initial payment for the
purchase of the above-described property and this serve as a receipt;

3. That an amount of FIFTY THOUSAND PESOS (P50,000.00) shall be paid on or


before April 18, 2022;

4. Failure to pay the amount of FIFTY THOUSAND PESOS (P50,000.00) on the 18th
day of April 2022, a penalty of Five Thousand Pesos (P5,000.00) will be imposed;
5. That the remaining balance of ONE HUNDRED SEVENTY-SEVEN THOUSAND
PESOS (P177,000.00) will be paid as monthly installment of EIGHT THOUSAND
PESOS (P8,000.00) every 18th day of the month starting May 2022;

6. Failure to pay the monthly installment on the exact date of monthly installment, a
Two Thousand Pesos (P2,000.00) penalty shall be imposed;

7. Failure to pay the monthly installment for Five (5) consecutive months, this contract
shall be considered null and void and all payments made are considered forfeited
and there non-refundable;

8. That the SELLER will surrender the Transfer Certificate of Title once the BUYER is
fully paid;

9. In case of death of any of the parties, their respective heirs will be substituted and
succeed their rights and obligation in connection with this contract;

10.That upon full payment of the whole obligation, the necessary Deed of Sale will be
executed in favor of SHELLY TAN KIM, and the SELLER commit and oblige himself
to vacate and surrender the property to the BUYER;

11. That both parties shall comply religiously and faithfully to the terms and conditions
set forth in this document.

IN WITNESS WHEREOF, the parties have hereunto affixed their signatures this 17 th
day of January 2022, in Angeles City, Pampanga, Philippines.

BEFORE ME, a Notary Public for Angeles City, this 17th day of January, 2022, in
