POLICE HEAD QUARTERS, JAI SINGH ROAD, NEW DELHI, SUBJECT: COMPLAINT OF BLACKMAIL, CHEATING AND THREATENING TO FACE DIRE CONSEQUENCES UPTO THE EXTENT OF IMPLICATION IN FALSE AND FABRICATED CRIMINAL CASES FROM THE HANDS OF MY PREVIOUS TENANTS NAMELY SMT. PRIYANKA GUPTA AND HER HUSBAND NAMELY SH. SHIV KUMAR. Sir, I Naresh Kumar Sharma, S/O Late sh. Chandgi Ram, R/o SR-42, Delhi Gurgaon Road, Mata Chowk, NH-8, Rangpuri, New Delhi, aged about 63 years, would like to plea upon your kind and valuable consideration towards my complaint of blackmail, cheating and threatening to face dire consequences upto the extent of implication in false and fabricated criminal cases from the hands of my previous tenants namely Smt. Priyanka Gupta and her husband namely Sh. Shiv Kumar, both R/o K-360,Khasra No. 764, Gali No. 6B, Mahipalpur Ext., Mahipalpur, New Delhi-110037. Sir, I am peace loving and law abiding citizen, never given any chance of any complaint to anyone throughout my life, senior citizen is an owner of “Hotel Paradise International” situated at, property bearing No. 272, Revenue Area of village Mahipalpur, Mahipalpur, New Delhi-110037. In the month of February 2018, the aforesaid accused persons namely Smt. Priyanka Gupta and her husband namely Sh. Shiv Kumar approached me for taking the Ground floor and First Floor of my hotel Paradise International on lease, therefore after several meetings and negotiations, I decided to give entire Ground Floor and First Floor, having an area of 2000 Sq. ft. of my aforesaid hotel Paradise international on lease for the period of five years W.E.F. 23.03.2018 to 28.02.2023, at the rent of sum of Rs. 70,000/- per month, plus service tax as applicable from time to time commencing from 23.03.2018. The rent was exclusive of charges for consumption of electricity and water payments. Subsequently one registered lease deed bearing E-Stamp Certificate No. IN-DL04173290213189Q, dated 23.03.2018 was registered in the office of Sub Registrar VIIA, Sarojini Nagar, on dated 26.03.2018 at 12:18:34 PM between me and Smt. Priyanka Gupta, after paying the appropriate stamp duty. Copy of the Lease Deed is ANNEXED herewith this complaint. Sir, as per the lease deed, the lessee i.e. Smt. Priyanka Gupta had to use the aforesaid premises for commercial use only, i.e. for running of a restaurant in the name and style of “Blue eye Cafe” i.e. ( Bar and Restaurant includes connected activities). It is mentioned in clause 2(1) of the agreement that the lessee i.e. Priyanka Gupta i.e. the lessee has given 12 Post Dated Cheques to me in respect of rent payable to lessor i.e. me. It is further mentioned in the paid the sum of Rs. 5,00,000/- by way of cheque bearing no. 066555 dated 26.04.2018 drawn on Central Bank of India, which was never encashed by me. Everything was going well till October 2018 and I was receiving my rent of Rs. 70,000/- per month regularly, but on dated 10.10.2018 I came to know that one FIR bearing No. 530/2018, U/s 323/341/506/34 IPC, Police Station Vasant Kunj has been registered against the husband of Smt. Priyanka Gupta, i.e Sh. Shiv Kumar and two more persons namely Sh. Vikky and Vipin, who were also the partners of aforesaid accused persons for running the Restaurant, had beaten some person named Anoop Kumar, S/o Sh. Rajender Singh on dated 9.03.2018 at about 1:30 AM with iron rods, and then Anoop was admitted to the hospital with grievous injuries. Sir, when I confronted Shiv Kumar about the aforesaid incident, and tried to make him understand that this kind of fights brings bad name to the hotel and restaurant, he told me that Anoop was the one who started the tussle, and assured me that this kind of act would not be repeated in future, and there was no problem till the month of January 2019, when suddenly the aforesaid premises was emptied by the aforesaid accused persons on the pretext that they are having financial issues and therefore not in position to run the restaurant bar, and would like to cancel the lease deed, and requested me with folded hands that I should not press the compliance of aforesaid Lease Deed dated 23.03.2018, registered on dated 26.03.2018 for five years, as their partners have fought among themselves and Priyanka gupta and Shiv Kumar are not in position to run the Restaurant Bar themselves alone without the help of their partners. Therefore considering the poor financial condition and request of the aforesaid accused persons, without taking the rent of January 2019, allowed them to vacate the aforesaid premises without forcing upon the registered agreement dated 23.03.2018, and also returned 12 post dated cheques and even the security cheque amounting sum of Rs. 5,00,000/- bearing no. 066555 dated 26.04.2018 drawn on Central Bank of India was returned to them after their continuous requests and persuasions, and also considering the loss in their business. It is also important to mention here that after the aforesaid accused persons left my premises I received summons dated 23.02.2019 from the Municipal Corporation of Delhi, which required my presence in their office on dated 28.03.2019 and when I reached there, I was shocked to know that the necessary documentation, license, approvals and permissions etc. regarding the running of restaurant bar had not been taken by the aforesaid accused persons, although it was clearly mentioned in clause 2(iii) of the registered lease dated 23.03.2018, therefore even in the MCD office, I had given the statement that there is no bar and restaurant working anymore and the same has been shut in January 2019. Sir, I have not received even a single penny in the name of rent from the aforesaid accused persons since 11.12.2018, and as per clause 4(vi) the conditions are given for termination of the lease deed, and as per clause 4(vi) (a), the lease shall be liable to be terminated forthwith by the lessor if the rental payment are in arrears for more than 2 consecutive months, therefore I had not done any paperwork regarding the termination of lease dated 23.03.2018, but despite the termination of lease deed as per the terms and conditions of the aforesaid accused persons, and even after returning the post dated cheques and even the security amount cheque back to them, the aforesaid accused persons are continuously blackmailing and threatening me to return their money back, by claiming that the actual rent of the aforesaid property was Three Lakh Fifty Thousand Rupees, and that they used to pay the rest of the amount i.e. Rs. Two Lakhs Eights Thousand in cash, which is absolutely false, as no such amount was taken by me in the name of rent by me, and the rent was mere Rs. 70,000/- only, which was paid from March 2018 to December 2018 in my account by the aforesaid accused persons. Sir, the aforesaid accused persons are claiming the refund of security money, which according to them, they had given me more than Rs. 16,00,000/- (Sixteen Lakh) in cash as a security amount in the month of February 2018, i.e. one month before the execution of the aforesaid lease deed dated 23.03.2018, which is completely false, as no such amount or any amount in the name of security was taken by me from the aforesaid accused persons, and when I refused to comply with their illegal demands, aforesaid accused person Shiv Kumar clearly threatened me that he would implicate me in false and fabricated criminal cases, with further threatening that he is a man of money and muscle power having high profile relationship with the Delhi police and politician of the Delhi as well as country and I must prepare to face dire consequences, despite the fact that I had terminated the lease deed dated 23.03.2018 as per their terms and conditions, without even retaining the security amount of Rs. 5,00,000/-. Sir, the aforesaid accused persons are extending the threatening to me to face dire consequences, due to the threat and cheating I and my family has been living under the threatening and apprehension of any miss happening with me, which has taken the peace and tranquillity of our lives. Therefore in view of the aforesaid facts and circumstances, I would like to request you to take appropriate legal action against the aforesaid accused persons and do justice with me.
