CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENT:

This contract of lease made and entered into this ______________ at ____________ by
and between:

SPOUSES VIVIANA T. BAYSANTOS AND FLORENCIO B. BAYSANTOS, both of


legal ages, Filipinos and a resident of Lumil, Silang, Cavite, hereinafter referred to as the
LESSORS;

-and-

MERCEDES LOPEZ RAMOS, of legal age, Filipino and with office address at No. 9 4 th
Avenue, Barangay Bagong Lipunan ng Crame, Quezon City, hereinafter referred to as the
LESSEE;

WITNESSETH: THAT

WHEREAS, the LESSORS, SPOUSES VIVIANA T, BAYSANTOS AND FLORENCIO B.


BAYSANTOS, registered owner of an ESTATE situated at Silang, Cavite, hereinafter referred as
the LEASED PREMISES;

WHEREAS, the LESSEE desire to lease the aforesaid estate with an area of Two
Thousand (2,000) Square Maters, part and parcel of land Twenty Four Thousand Five Hundred
Seventy Three (24,573) Square Meters, more or less covered by OCT No. 425, CLOA No.
00086764, Rep. Act No. 6657 dated June 10, 1988, situated at Tartania, Silang, Cavite;

NOW THEREFORE, for in consideration of the foregoing and the mutual covenants, the
LESSOR has agreed to Lease and get and by there presents, does hereby lease unto the
LESSEE the LEASED PREMISES, and the LESSEE hereby accept the same by way of leave
subject to the following terms and condition:

1. LEASE PERIOD: That the term of lease shall be for a definite period of ten (10)
years commencing __________________ to __________________ renewable
every five (5) years under terms and condition mutually acceptable to both parties

2. RENTAL RATE: In consideration of this Contract, the herein parties agree that the
monthly rental of this Leased Premises shall be SIXTEEN THOUSAND PESOS
(Php16,000.00);

3. SECURITY DEPOSIT – Upon signing of this contract, the LESSEE shall pay the LESSOR
the sum of NINETY SIX THOUSAND PESOS (Php96,000.00) in Cash, remaining balance
shall be settled after the 6th month period also in cash.

4. DEFAULT, PRE-TREMINATION OF THE LEASE, FORFEITURE- The LESSOR


guarantees at closure possession and enjoyment by the LESSOR as the property for the
entire period of the lease and all extensions thereof as long as the LESSEE fulfills all the
obligations under this Contract;

5. CARE AND IMPROVEMENT OF THE LEASED PREMISES – The property subject


matter of this Contract shall be used exclusively for residential/business purposes.

That Lessee shall have the right to build a tenable place, introduce furniture’s and
fixtures, ornamental plants and other movable improvement and the Lessee shall have
the right to remove said objects at the termination of the lease.

The Lessee agrees to secure appropriate government permits/taxes and other


repairs thereafter shall be for the Lessee’s account.
6. SALE, TRANSFER AND MORTGAGE: In case of sale and transfer of ownership from
LESSOR to any person, the LESSEE has the right to purchase the property hence she
must be notified of the intention to sell the property. The new owner/s or success-in-
interest shall honor and abide entirely on the terms to buy the lease property subject to
the terms and conditions by the LESSOR.

7. THIRD PARTY LIABILITY – The LESSEE during the occupancy of the leased premised
shall hold the LESSOR free and harmless from any person or property arising out of or
as consequence of the use of the leased premises of the LESSEE, employee domestic
help and guest.

This instrument consisting of two (2) pages, where the parties and their instrumental witnesses
signed on each and every page thereof, refers to a Contract of Lease.
