COMPROMISE AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Compromise Agreement is executed this ____ day of

_________________ 2022 by and between:

JAYSON M. NACARIO, of legal age, Filipino citizen, and a resident

of Block 11 Lot 2, J. Avenida St., Xevera Subd., Brgy. Calibutbot, Bacolor,
Pampanga, hereinafter referred to as “FIRST PARTY”;

And

EZRA M. TABELISMA and EDDIESON P. CAPITULO of legal ages,

Filipino citizens, and residents of San Miguel, Tarlac City, hereinafter
referred to as the “SECOND PARTY”;

WITNESSETH – THAT:

WHEREAS, the FIRST PARTY is the private complainant in a

criminal case entitled: People of the Philippines vs. Ezra T. Nacario and
Eddieson P. Capitulo for Adultery under Criminal Case No. ____________
currently pending before the Municipal Trial Court in Cities, Branch 2,
Tarlac City, Tarlac;

WHEREAS, the FIRST PARTY has agreed to put to rest his

differences with the SECOND PARTY and withdraw and desist from
prosecuting the above-mentioned criminal case;

WHEREAS, the SECOND PARTY undertakes to faithfully comply all

the terms and conditions that the FIRST PARTY has given to them.

NOW THEREFORE, in pursuance with the foregoing premises, the

parties have voluntarily agreed as follows:

1. The SECOND PARTY undertakes to give to the FIRST PARTY the

amount of TWO HUNDRED FIFTY THOUSAND (Php250,000.00)
Philippine Currency, which is payable within SIX (6) months from
the execution of this Compromise Agreement. As collateral for the
payment of the agreed amount, we are giving the possession of a
Kawasaki RS 200cc motorcycle with plate no. _________;

2. The SECOND PARTY (Ezra T. Nacario) gives full and sole

custody of their minor child, Johan Dale Xandre T. Nacario who is
currently living with SECOND PARTY’s (Ezra T. Nacario) mother
at Block 11, Lot 2, Joven Avenita, Xevera Subd., Brgy. Calibutbut,
Bacolor, Pampanga. SECOND PARTY likewise waives her
visitation rights over the child during the latter’s minority.
 3. The SECOND PARTY likewise waives and renounces her share
over the house and lot located at Block 11, Lot 11, Joven Avenita,
Xevera Subd., Brgy. Calibutbot, Bacolor, Pampanga in favor of the
minor child Johan Dale Xandre T. Nacario which is currently under
the Housing Loan Program of PAG-IBIG.

4. The SECOND PARTY finally waives her rights and interests over
the investment she entered into with EMMRJ Loan Consultancy
Corporation, amounting to FOUR HUNDRED THOUSAND
(Php400,000.00) to the FIRST PARTY.

5. The FIRST PARTY agrees on the provisional dismissal of the

Honorable Municipal Trial Court in Cities and the SECOND
PARTY undertakes to comply with their obligations as set forth in
this agreement. It is hereby understood by the SECOND PARTY
that failure to comply with the terms and conditions would warrant
the revival of the case against them.

IN WITNESS WHEREOF, we have hereunto set our hands this ___ day
