The Constitution and By-laws


Of CARESS
ARTICLE I Name

The name of this association shall be CARESS (Creating Alternative Resources for Employees Support Services)

ARTICLE II Preamble

We, the members of CARESS (Creating Alternative Resources for Employees Support Services) recognize
the importance of teaching and non-teaching personnel of Sta. Catalina District I in delivering services to its qualified
members. We shall strive at all times to maintain the highest level of services to the members such as death-aide,
hospitalization assistance, distressed members support and love and appreciation of retiree's valuable services
rendered in the department.

ARTICLE III Purposes

Section 1. To let the members feel that they are loved, cared and valued by the organization.
Section 2. To sympathize with the family of the active member by giving death assistance.
Section 3. To give hospitalization assistance to the active member of the association.
Section 4. To comfort members in distressed by giving goods and supplies.
Section 5. To extend heartfelt thanks of the services given by the members during his/her retirement in the
department specifically in Sta. Catalina District I.

ARTICLE IV Membership

Section 1. Membership

A. Membership in the association shall be open to all teaching and non-teaching personnel of Sta.
Catalina District I
B. Membership fee of one hundred pesos (Php 100.00) shall be collected upon signing the membership
form on February, 2022 and can avail assistance starting March, 2022 as stated in Article IV Sections 2
and said membership fee shall be deposited to an accredited depository institution with three
signatories of the President, Treasurer and Auditor.
C. Members registered beyond February, 2022 is not entitled to receive any assistance for thirty (30) days
from the date of his/her membership.
D. Only active members can attend Association meetings and vote.

Section 2- Members Privileges

A. Death Assistance
A.1. Members who consistently give his/her contribution to the association shall be given death assistance.
A.2. Member beneficiaries (legitimate children, spouse and biological parents) shall receive fifty pesos only
(Php 50.00) from each member of the association as death assistance.

A.3. Member who doesn’t have beneficiaries as stipulated in Section 2. A.2 shall declare three (3)
beneficiaries in the membership form to avail of the death assistance
A.4. Member of the association shall receive one hundred pesos (Php 100.00) from each member as death
assistance.

B. Hospitalization Assistance

B.1. Members who consistently give his/her contribution to the association shall be given hospitalization
assistance.

B. 2. Hospitalization assistance shall be received by the member if he/she is confined in the hospital for
three (3) days or more and shall receive an amount of one hundred pesos (Php 100.00) from each member
of the association or if the amount spent during the hospitalization is less than the amount to be collected
from each member as to the amount of one hundred pesos then reimbursement shall be done using the
formula (amount spent by the member divided by the number of members) as evidenced by the photocopy
of official receipts of medicines purchased and hospital bills.

B.3. Members can only avail the hospitalization assistance for three times per year of different medical
cases excluding maternity cases.

B.4. Members being hospitalized and confined for three (3) days shall present a proof of confinement or
medical certificate (photocopy/original) for transparency purposes.

C. Person in Distress

C.1. Members who consistently give his/her contribution to the association shall be given assistance.
C.2. Members experiencing distress specifically quarantined personnel identified with positive RTPCR result
from IATF (Inter-Agency Task Force) shall be given assistance in the form of goods and supplies amounting
to one thousand pesos (Php 1000.00) only.
C.3. Each member of the association shall contribute an amount using the formula (1000.00 x No. of
member in distress divided by number of members in the association).

D. Retirement

D.1. Member/s who consistently give his/her contribution to the association shall be given love and
appreciation of his/her valuable services rendered in the department during his/her retirement.

D.2. Member/s who will retire shall be given a love and appreciation of his/her valuable services either cash,
token or gift certificate amounting to two thousand pesos (Php 2000.00 ) per retiree.

D.3. Each member of the association shall contribute an amount using the formula (2000.00 x No. of retiree
divided by number of members in the association).
D.4. Love and appreciation of his/her valuable services shall be given on the annual district gathering of
teachers and honoring of retirees.

Section 2 – Revocation of Membership


A. Members who failed to give assistance for two (2) cumulative contributions shall be given notice of cancellation of
his/her membership by the President of the Association.
B. Upon receipt of the notice of cancellation of membership the member shall pay the two (2) due contributions for 5
working days; failure to do so means he/she cannot avail of assistance in the association.
C. Failure to give assistance for three (3) cumulative contributions, his/her membership is automatically cancelled.

D. Member who is retired, terminated, or transferred to other district automatically cancelled his/her membership in
the association.

ARTICLE V Officers

Section 1 – The officers of the Association shall consist of a President, a Vice-President, a Secretary, a
Treasurer, an Auditor, and a Public Information Officer.

Section 2 President

The President shall:

A. Be the Chief Executive Officer of CARESS;


B. To regularly meet with the District Supervisor to discuss the operation of the association;
C. Administer all affairs and execute all policies of the association;
D. Preside at all meetings of the Executive Board of Directors and general association;
E. Represent or delegate representation of the CARESS with all external groups;
F. Establish committees and appoint committee chairs with the approval of the Board of Directors;
G. Call regular and special meetings of the Executive Board, Board of Directors, or general membership;
H. Fulfill any and all such other duties as the office requires and as are consistent with the Constitution and
Bylaws;
I. Make appointments should any vacancies occur in the Executive Board to fulfill the duration of the term
subject to the approval of the Board of Directors;

Section 3 – Vice President


The Vice President shall:

A. Assume powers and duties of the President in his/her absence;


B. Help the President supervise and coordinate the activities of the committees and be responsible for the
committee reports to the Representative Assembly if the chairperson is unable to attend;
C. Serve as the President’s alternate to all affairs;
D. Perform such other duties as the President may designate;
E. Fulfill any and all other duties as the office requires and as are consistent with the Constitution and
Bylaws;

Section 4 Secretary

The Secretary shall:

A. Keep accurate minutes of the meetings of the Officers, Executive Board, Representative Assembly, and
general membership;
B. Maintain the official accurate current Constitution and Bylaws.
C. Act as keeper of records for the CARESS (attendance / newsletter articles)
D. Distribute to members timely summaries of all Representative Assembly and general membership
meetings through minutes;

E. Perform such other duties as the President may designate;


F. Fulfill any and all such other duties as the office requires and as are consistent with the Constitution and
By-laws;

Section 5 – Treasurer
The Treasurer shall:

A. Deposit the funds of the CARESS and keep custody of the passbook and other financial records of the
association
B. Withdraw funds from the accredited depository institution together with the officers as signatory of the
passbook/withdrawal slip
C. Keep accurate accounts of the receipts and disbursements;
D. Report the status of those accounts at least quarterly during the Executive Board and Representative
Assembly;
E. Prepare and present an annual financial statement for transparency to members as directed by the
Executive Board;
F. A chairman of the finance and budget committee;
G. Perform such other duties as the President may designate;
H. Fulfill any and all such other duties as the office requires and as are consistent with the Constitution and
Bylaws;
I. Maintain a current roll of members;

Section 6-Auditor

A. Audit financial records of the association quarterly.


B. Keep signed and audited financial records.

Section 7- Public Information Officer

A. Relay information to all the members of the association.


B. Serve as chairman of the advocacy and membership campaign of the association
C. Notify members whose membership is at stake of cancellation/termination.

Section 7 – Terms of Office

The officers shall serve for one calendar year term and may be re-elected for two terms. Each officer shall
remain in office until his/her successor assumes the office.

ARTICLE VI. Committees Functions and Responsibilities:

Section 1. Ways and Means Committee. Ways and means committee is a body that is charged with reviewing and
making recommendations for the budgets of the association. Its function is to plan activities that will bring funds to the
association beyond the collection dues.

Section 2. Election Committee. Election Committee formulate election rules and guidelines and recommend to the
general assembly for approval. They are also going to implement election rules and guidelines duly approve by the
general assembly.

Section 3. Advocacy & Marketing Committee. Advocacy and marketing committee promote public awareness and
encourage involvement in the association by:
a. utilizing the developed advocacy and marketing materials from the association to create the mode of
campaign.
b. Reproduce or redevelop advocacy materials.
c. conducting extensive awareness campaign and other marketing activities which may include
interviews/advertisement with local radio, television and newspapers, posting of campaign banners, in line
with the associations mission and vision.
Section 4. Finance Committee. Finance Committee provides financial analysis, advice and oversight of the
organizations budget.
Section 5. Logistics Committee. The logistics committee is primarily responsible for handling activities related to the
accommodation and transport facilities.
Section 6. Education Committee. Conduct pre-membership education seminar to potential members of the
association as well as reorientation seminar to delinquent members.

ARTICLE VII The Executive Board

Section 1 – The Executive Board shall consist of the elected representatives of the schools within Sta. Catalina
District I. It shall be the executive authority of the Association.

Section 2 – Within the policies established by the Association Assembly, the Executive Board shall be
responsible for the management of the Association. It shall carry out policies of the Association, and appoint the
committee on nominations and elections. It shall report its transactions to the members, and suggest policies for the
consideration of the Association Assembly.

Section 3 – Whenever 20 percent of the members of the association, or a majority of the


Association Assembly agree that an officer has been grossly negligent in duties as defined in the
Bylaws, or is incapacitated, the Executive Board shall recommend to the general membership that the office be
declared vacant. If the membership so votes, in a polling by two-thirds majority of those voting, the general
membership shall immediately elect a replacement for the unexpired term for the vacancy created.

ARTICLE VIII Fiscal Year

For accounting purposes, finance committee shall present a financial report for transparency purposes every end of
November each year.

ARTICLE IX Ratification

The constitution replaces all previous Association constitutions as of the date of its ratification.

ARTICLE X Meetings

Section 1 – The Executive Board shall meet at the call of the President or at the request of the chairman of the
Board.

Section 2 – The Association Assembly shall meet on a regular basis, the schedule of which will be
established annually. The President shall prepare the agenda for each meeting and shall include items on the
agenda as requested by the Executive Board or other members of the Association. The prepared agenda shall be
circulated to all the members of the Association Assembly at least three (3) school days prior to the meeting so that

representatives shall have time to discuss it with the members in the school in advance of the Assembly meeting.
The Executive Board as necessary shall assign officers (Head Reps) to specific schools to assist representatives in
such discussions.

A. Special meetings of the Association Assembly may be held at the call of the President, the Executive
Board, or upon written request to the Executive Board from three school representatives. Business to
come before the meeting must be slated in the call, which shall be sent in writing to the representatives.

Section 3 – General Membership Meetings

The members of the CARESS shall meet during the first and last week of the school year for discussion of
professional issues.

A. Special called general meetings may be called anytime by the President, Executive Board, or five (5)
members who submit their request in writing to the Executive Board. An agenda shall be distributed
five (5) school days in advance of the special called meeting. Only items on the agenda may be voted
upon. All other items shall be referred to the Assembly. If a majority of the association members attend
a special called general meeting, there shall be an open agenda.

ARTICLE XII Quorum

Section 1. The members present shall constitute a quorum for all membership meetings.
Section 2. At the Association Assembly meetings, a quorum shall be one-half of the members plus one of
the total members of CARESS.

Section 3 –A majority of the members shall be a quorum at meetings of committee and Executive Board.
ARTICLE XI Duties, Services and Responsibilities of Officers , BODs and Members

All duties, services and responsibilities of Officers, Board of Directors and members to be undertaken in
relation to the operation of the association shall be purely voluntary and is not entitled to any remuneration such as
but not limited to honorarium and other personal necessities of members, officers and BODs.

ARTICLE XII Amendments

The Bylaws may be amended by a two-thirds majority of the votes cast in a vote taken using the same
procedure as used for the election of officers after due presentation to the membership at the previous meeting.

ARTICLE XIII REPEALING CLAUSE

This constitution and by-laws shall remain enforce until revoked or ratified by two-third of its members
through a resolution during the special meeting/general assembly.
