AFFIDAVIT OF DESISTANCE

I, MERLINDA GARBO MANDADO of legal age, married, and a resident of

Bagumbayan II, Brgy. Maribago, Lapu-Lpau City, Philippines, after having duly
sworn to in accordance with law, do hereby depose and state:

1. That I am the private complainant in a criminal case for Violation of RA

9262 (Anti-Violence against Women and their Children Act of 2004)
against my husband, DINDO D. MANDADO filed before the Office of the
Prosecutor in Lapu-Lapu City docketed as NPS-Docket No. VII-12-INV-
21I-00408.

2. After careful thinking and reflection, I decided that we should settle our
problems out of court and be in a long- term separation with my husband,
as this has been a result of pure misunderstanding and misapprehension
of facts.

3. I also took into consideration the interest of our child since filing a criminal
case against my husband would affect our child.

4. I manifest that I now withdraw my complaint against the accused and that I
am no longer interested, and I hereby desist, in prosecuting the above-
mentioned case

5. I hereby release the accused from any and all criminalliabilities and waive

any right of action against the accused in connection with the above case

6. I am executing this affidavit to attest to the truth of the foregoing

statements and respectfully pray that the aforementioned case against
Dindo D. Mandado be dismissed or withdrawn.

7. I fully understand the legal consequences of this Affidavit.
