GENERAL TENANT CONSTRUCTION GUIDELINES PRE-CONSTRUCTION,

CONSTRUCTION AND POST-CONSTRUCTION PHASES (DETAILED DESCRIPTION OF


THE MERCHANT ACTIVITY LIST)

This chapter guides the merchant in going through the three phases of his leased space construction: Pre-
Construction, Actual Construction, and Post-Construction phases.

1. PRE-CONSTRUCTION PHASE
1.1 Award letter
This is the formal communication from the owner, Century City Development Corp. (CCDC) officially
informing a prospective merchant of the acceptance of his application and indicating basic information, terms
and conditions. A copy of the Award Letter with the merchant's conforme must be returned to CCDC. This
letter is necessary for securing municipal permits.

1.2 Contract of Lease


This is the legal instrument between CCDC and the merchant formally detailing all the terms and
conditions that govern the lease. The specified number of copies of the signed contract must be returned to
CCDC upon contract signing

1.3 Site Visit/Turn-over of Leased Space

1.3.1 Site Visit


The merchant, together with his designers and other technical team members are obliged to
visit the leased space to verify actual space conditions prior to the preparation of Preliminary
Designs and Plans.

1.3.2 Turn-over & Re-measurement of Leased Spaces


CPGI will schedule a turn-over date wherein the merchant's space will be formally turned
over to him as ready for construction. The merchant will affirm that all provisions in the space are
present and in good condition. Common area charges will commence on the date of turn- over.
Likewise, the merchant shall be responsible for its security upon turn-over date and must abide by all
guidelines set by Century City Development Corp. (CCDC)/Century Properties Management, Inc.
(CPMI). A fixed rate for use of utilities (electricity, water, etc.) shall also be charged to the merchant
during construction. The awarded space shall undergo lease re-measurement procedure as described in
"Annex A".

1.3.3 Technical meeting


It is imperative that prior to beginning any design of the retail spaces, the merchant, his
designers and contractors and CCDC/CPMI should meet to discuss pertinent matters regarding
merchant construction.

1.4 Submission of Plans


All drawings shall conform to the guidelines specified hereinafter and shall be submitted in
20” x 30” blueprint to:

1.4.1 Schedule of receiving plans
TIME DAY PLACE
9:30 a.m. – 3:00 p.m. Mon. - Fri. Admin Office

1.4.2. CCDC shall notify the merchant when the plans are ready for pick-up.

1.4.3 Processing and evaluation period shall be Ten (10) working days from the receipt of the plans.
1.4.4 Plans received after 3:00PM shall be considered submitted the following day.
1.4.5 Incomplete plans shall not be received. It is the merchant’s responsibility to comply all
requirements to prevent any delay in the process.

1.4.6 Plans Requirements


All drawings submitted by the merchants to CCDC for review must a) be signed by the
owners; b) be signed and sealed by the professional; c) be complete; and d) shall comply with the
following guidelines on sheet presentation and contents to facilitate evaluation. Format for
Preliminary and Final Plans
All working drawings shall be in standard size sheets measuring 20 inches by 30
inches and shall follow the front/cover sheet format, margins and title block standards as
stipulated in the latest edition of the National Building Code.

All sheets of drawings submitted must properly indicate the Store Name/Office
Name, Shop Number/Office Number, Nature of Occupancy/Operation (e.g. Boutique, Men's
Shoe Store, Restaurant, etc.), specific floor, via a key plan.
For example: Store XYZ, Novelty Store, Shop # L100, Ground floor, Century City
Mall
All working drawings submitted for review must be properly collated, arranged
and stapled on the upper, middle and lower left side of each set of drawings. This is to enable
CCDC/CPMI to immediately: 1) establish the number of sets of drawings, 2) determine how
many sheets per set have been submitted and, 3) ensure that no sheets are detached from the
set so as to avoid misplaced drawings/sheets.
Construction Plans – Complete 11 sets
Plans submitted must contain the following:
o Architectural Plans (duly signed by registered and licensed Architect
or Interior Designer only)
Colored perspective
- Submit a separated print in 1/8 size illustration board
A plan showing the location of the Merchant store
Floor Plan
Longitudinal and Cross Sections
Elevations
Reflected Ceiling Plan
Furniture layout
Sign Details
Board-Up Details (if applicable)

o Structural Plans and Drawings (If applicable)


Design and Computations (and duly certified by licensed Structural or Civil
Engineer)
Specifications
Floor Framing Plan
 Location of heavy equipment, its weight, loading and dimensions,
specifications (if applicable)

Important Notes: INCOMPLETE PLANS SHALL NOT BE RECEIVED FOR


EVALUATION
o The owner (CCDC) and the design consultants reserve the right to
approve, disapprove or give conditional approval to the merchant's
submitted plans and drawings.
o The efficiency of the design for the merchant space & the performance
of the materials used shall be the responsibility of the merchant's
designer/contractor.
o Approved plans must always be at the construction site. These plans are
considered the construction plans and must be followed by the
merchant contractor (any deviation from the approved plan is
considered a violation).
CCDC/CPMI RESERVES THE RIGHT TO ISSUE A WORK STOPPAGE
TO THE MERCHANT IF THIS REQUIREMENT IS NOT MET.

1.5 Municipal Permits


The merchant shall secure the following permits from the Makati Municipal Office and must be
submitted to the Property Management Office (CPMI) thru CCDC prior to construction:

1.5.2 Electrical Permit
1.5.3 Structural, Mechanical, Sanitary Permits (when applicable)
The merchant shall properly display/post all necessary municipal permits on exterior of
barricade/board up at all times. Copies of these permits must be submitted to the Property Management
Office (CPMI) thru CCDC.

1.6 Comprehensive General Liability Insurance


The merchant shall secure Comprehensive General Liability Insurance from a CCDC approved
insurance company for bodily injury, for property damage to the building and/or any third party for the whole
duration of construction. A copy of the insurance coverage must be submitted to the Property Management
Office (CPMI) thru CCDC prior to construction.

1.7 Construction Bond


The merchant shall deposit with CCDC a Construction Bond as indicated in the Award Letter to
answer for all violations or non-compliance with any guidelines and requirements or deviations from the
approved plans. This must be paid prior to construction and an official receipt be submitted to the Property
Management Office (CPMI) thru CCDC

1.8 Other Requirements


The following additional requirements must be submitted to CPMI thru CCDC:
- List of Workers (2 copies)
- Worker's ID's

The merchant must provide ID cards for the proper identification of his construction workers/personnel
to be given access to the premises during the construction phase. The ID's must be properly filled out and sealed
to avoid tampering. These should be worn at all times within the construction site.

1.9 Notice to Proceed


This is the written notice from CPMI thru CCDC signifying the go-signal to start with construction. The
Notice to Proceed will only be released after all items from nos. 1- 11 of the Merchant Activity List have
been strictly complied with. A copy of the Notice to Proceed must also be prominently displayed at the
merchant space at all times.

2 CONSTRUCTION PHASE
2.1 Board Up (if applicable)
2.1.1 Before any construction is allowed, leased premises must be properly boarded up.
2.1.2 Board up shall be constructed of plywood, painted white (unless there is specific design for the
building) with a provision for an access door for CCDC/CPMI inspection purposes. This door shall swing
towards the merchant space so as not to obstruct mall traffic. It shall remain closed at all times during
construction and shall be properly padlocked during non-construction hours.

2.2 Schedule of Construction


2.2.1 24-hour construction schedule may be allowed upon securing the proper clearance from the
administration office (CCDC).
2.2.2 Should there be merchant construction when the Mall becomes operational, the following
schedule should be followed:
Any Time
- Minor carpentry work
- Masonry
- Laying of electrical circuits

Non-Operating Hours (to be cleared with the administration office)


- Major carpentry works
- Demolition

- Spray Painting
- Welding
- Electrical Testing
- Sanding
- All other works which disturb operations of adjacent spaces and which endanger the safety of the
building and its occupants.

2.3 Access to the Building

2.3.1 All tenants, their workers, supervisors and other parties involved in the construction of the space
must log in with the building security guard upon entry into the building. The Property Management Office
(CPMI) shall announce the location of designated entry/exit points.
2.3.2 Identification cards must be worn at all times while inside the building premises. Those without
ID's shall not be allowed to enter.
2.3.3 All construction workers must be in Shirts bearing the tenant’s / contractor's logo, long pants and
shoes. Workers must wear hard hats at all times. Sandos, short pants, sandals or slippers and the like are
prohibited. Those not properly attired shall not be allowed to enter the premises.
2.3.4 Workers and their supervisors are not allowed to loiter within the building premises.

2.4 Delivery of Construction Materials


2.4.1 Delivery of construction materials by vehicles larger than private cars shall be from 11:00PM to
8:00AM daily.
2.4.2 Sand, gravel, cement and the like must be delivered in sacks. Any fallen debris must be cleaned
up immediately.
2.4.3 All deliveries, including equipment, must be logged in with the building security guard, who then
issues a gate pass for the said purpose. Any item that is not properly logged will not be allowed to be brought
out of the building.
2.4.4 All deliveries shall immediately be brought to the construction site.
2.4.5 Deliveries shall not be received by the building guard or any of the building personnel. An
assigned representative should be present to receive the deliveries.
2.4.6 Tenant/contractor must secure a Gate Pass from the Administration Office which should be
signed by an authorized representative at least One (1) day prior to the scheduled delivery.

2.5 Pullout of Excess Materials


2.5.1 The schedule of pullout of all construction debris, excess materials, and equipment, which will no
longer be used, is the same as the Delivery Schedule.
2.5.2 Construction debris must be hauled out of the building every day.
2.5.3 Tenant/contractor must secure a Gate Pass from the Administration Office which should be
signed by an authorized representative at least One (1) day prior to the scheduled delivery.

2.6 Conformity with Plans


2.6.1 All construction works must be done in accordance with the plans evaluated by CCDC/CPMI. It
is highly recommended that the existing utilities (smoke detector, sprinkler heads, LPG etc.) provided by the
owner (CCDC) remain in their given locations upon award of the merchant space. The designs of the shops
could be worked around the actual location of these utilities. However, should the designers wish to exercise
their prerogative and relocate the utilities to conform to their designs, they should realize that this relocation is
still subject to the approval of the engineering and design consultants. Also, the merchant should be aware that
relocations should mean additional costs, which shall be borne by the merchant.
2.6.2 Any proposed revision of the merchant space must be approved in writing by CCDC/CPMI.
2.6.3 For minor revisions, written approval may be given on site (during routine inspections) by the
CCDC staff member concerned.
2.6.4 For major revisions, four (4) copies of the revised shop drawing must be submitted for approval
prior to any implementation of changes.

2.7 Fire Safety
2.7.1 One (1) unit- 20lb. ABC type fire extinguisher must be provided for every 11.40 radius. An
extinguisher must be provided and a fire watch assigned where welding and/or gas cutting operations is
performed.
2.7.2 Smoking is strictly prohibited within the construction site.
2.7.3 Cooking is strictly prohibited within the construction site.
2.7.4 Water supply and distribution facilities for firefighting purposes shall be provided and
maintained in the construction site in accordance with the Local Fire Code.

2.8 Others
2.8.1 Tapping of Utilities - Tapping of electrical, mechanical, fire protection, and plumbing utilities
must be done in coordination with the Property Management Office (CPMI).
2.8.2 Security - Security within the space is the sole responsibility of the merchant.
2.8.3 Sanitation - The leased space as well as the common areas must be kept clean and free from foul
odor. Garbage/Construction debris must not remain lying outside the merchant space. This must be hauled out
of the building every day.
2.8.4 Portable Toilets - Portable toilets shall be available for the use of all workers. These shall be
placed in an area accessible to all.
2.8.5 Medical Facilities - First Aid Kits must be provided by each merchant at the construction site for
the use in case of emergency.
2.8.6 Protective Apparel - Personal protective devices (hard hats, gloves, boots, etc.) shall be
furnished by the contractor as needed.
2.8.7 Safety Materials/Equipment - The contractor shall provide safety measures such as
construction nets, sheeting, shoring etc. whenever necessary.
2.8.8 Obstruction - Work will not be permitted outside the merchant's leased space. Construction
materials will neither be allowed to lie outside the merchant space nor in any other common area of the
building.
2.8.9 Damages - The merchant/contractor shall be responsible for any damages incurred resulting from
the construction of the space. Likewise, death and/or injuries within the premises shall be the merchant's sole
responsibility.
2.8.10 Behavior of Workers - The merchant is responsible for controlling the conduct of their
contractors and workers. CPGI/CPMI has the right to remove a worker for any misdemeanor.
2.8.11 Routine inspections – CCDC/CPMI and their assigned representatives shall make their routine
inspections of all construction sites as often as necessary. All observations and instructions given by the
inspectors (indicated on merchant construction checklists - See "Annex C") must be taken note of and
strictly followed. CCDC/CPMI reserves the right to issue construction changes on approved plans when
deemed necessary.
2.8.12 Pre-Final Inspection - Merchant shall request CPMI thru CCDC (in written form) at least three
(3) days in advance, to conduct a pre-final inspection prior to the following critical construction activities:
Permanent closure of ceiling.
Pouring of concrete.
2.8.13 Testing and Commissioning - The Merchant shall inform CPMI thru CCDC (through a written
request) at least three (3) days in advance, to witness the following:
Hydrotest - fire protection
Flow test - plumbing and sanitary
Smoke alarm test - fire protection
Insulation test – electrical
Flood test - plumbing and sanitary (if applicable)
Load test – electrical
Leak test - mechanical (LPG and exhaust system )

2.8.14 Supervisors - Merchant shall assign key personnel (Project Manager, Supervisor or Foreman)
to be present at all times at the construction site for coordination purposes. All communications related to
Merchant construction will be directed to designate key personnel.
2.8.15 Compliance - Violations and/or non-compliance with any or all of the above guidelines and
requirements and deviations from approved plans shall constitute grounds for the stoppage of construction
especially when previous notices remain uncorrected or unresolved. A written Work Stoppage shall be issued
for this purpose. The merchant shall be responsible for the communication and implementation of all
Construction Guidelines to his assigned contractor.
2.8.16 Monetary Penalties - Monetary penalties shall be imposed upon the merchant for any and all
violations and/or non- compliance with the above Construction Guidelines and deviation from approved plans:

First offense - P500.00/violation/person plus one week ID confiscation


Second Offense - P1,000.00/violation/person plus two weeks ID confiscation
Third Offense - P2,000.00/violation/person plus permanent ID confiscation
Fourth Offense - P3,000.00 Work Stoppage

Gross violations even on the first offense shall be automatically penalized with a Work
Stoppage Order and a fine of P3,000.00.

3. POST - CONSTRUCTION PHASE


3.1 Written Notice of Completed Construction
The merchant shall inform CPMI thru CCDC in writing of the completion of construction works for
the leased space. This shall also serve as a written request for final inspection by CPMI. After the final
inspection, the merchant is given 7 calendar days for rectification works if any.

3.2 Temporary Permit to Operate (TPO)


A Temporary Permit to Operate (TPO) shall be issued by the Administration Office (CCDC) thru
CPMI once the space is deemed acceptable. The TPO shall enumerate all requirements for release of the Final
Acceptance for the space.

3.3 Submission of As Built Plans


Three (3) complete sets of As - Built plans, which should include all revisions required in the TPO,
shall be submitted to CPMI thru CCDC.

3.4 Operating Permits/Certifications


Copies of the following must be submitted to the Property Management Office (CPMI) thru CCDC
prior to store operations:
Occupancy Permit (Municipal Engineer's Office)
Business Permit (Mayor's Office)
Certificate of Final Electrical Inspection (Municipal Engineer's Office)
Fire Safety Inspection Certificate (Fire Department)

3.5 Re inspection in Compliance with Technical Requirements enumerated in the TPO


A re-inspection shall be made to ensure that all technical requirements by CPMI have been complied
with by the merchant.

3.6 Submission of Merchant Information


Each merchant shall submit to CCDC the following information:
Store name
Name of owner and sample signature
Company name
Name of store manager & other authorized representatives, if any

Main office address and telephone number (Only the signatures of the owner (s) and their
authorized representatives.
Store telephone number representatives shall be honored for permit purposes.)
Emergency telephone number(s) (This shall be used in case of any emergency during non-
operating hours.)

3.7 Acceptance letter


After the merchant has complied with all requirements, a Final Acceptance Letter shall be released by
CPMI thru CCDC.

3.8 Release of Construction Bond


CCDC shall release the merchant's construction bond only after the release of the Final Acceptance
Letter.

ANNEX "A"
STANDARD GUIDELINES FOR CONDUCTING LEASE RE-MEASUREMENTS (LR) IN CENTURY CITY
MALL

1.1 GENERAL PROCEDURE


1.2 Present on the day of Lease Re measurement are Tenant or his/her duly authorized Representative and
CCDC Representatives. Lease Re measurement shall not begin if any of the aforementioned parties are absent.
1.3 CCDC Representative shall proceed to get dimensions of the perimeter walls as witnessed by the merchant
and as specified hereinafter. All dimensions shall be indicated on the plan.
1.4 Once the Lease Re measurement exercise is completed, all Representatives shall affix their signature on the
Plan as witnesses. A copy will be given to the merchant in the next working day.
1.5 Tenant is given a period of 5 working days upon receipt of the CAD Drawing from CCDC to contest the
validity of the Floor Area presented. Absolutely no complaints regarding the Plan and Floor area shall be
entertained after this period.

2.1 SPECIFIC GUIDELINES


The Floor Area computation guidelines for all Century City Development.Corp.
RETAIL merchants shall be as specified below:
2.2 Multiple Tenant Floor (if applicable)
2.2.1 The Rentable area on a Multiple Merchant Floor be measured FROM THE OUTSIDE
FINISH OF:
2.2.1.1 PERMANENT OUTER BUILDING WALLS
2.2.1.2 WALLS DIRECTLY FACING MALL AREA
2.2.1.3 WALLS DIRECTLY FACING OTHER COMMON AREAS (e.g. SERVICE
CORRIDORS)
2.2.2 NO DEDUCTIONS SHALL BE MADE FOR COLUMNS LOCATED WITHIN THE
LEASED PREMISES.
2.2.3 Rentable Mezzanine areas (if applicable) shall be measured from the outside finish of
permanent outer building walls, from the sides facing mall areas and other common areas, and from
outside finish Mezzanine walls, and from the center of partitions that separate the premises from
adjoining Rentable Areas.

2.3 Single Merchant Floor


2.3.1 Rentable Area for RETAIL shall include all areas within outside walls EXCLUDING:
2.3.1.1 STAIRS
2.3.1.2 ELEVATOR SHAFTS
2.3.2 Toilets within and exclusively serving only that floor shall be measured from the outside
finish of the toilet walls.
2.3.3 NO DEDUCTIONS SHALL BE MADE FOR COLUMNS AND

PROJECTIONS NECESSARY TO THE BUILDING.


CCDC/CPMI RESERVES THE RIGHT TO ADD OR MAKE CHANGES IN ANY OF THESE
CONSTRUCTION GUIDELINES OR REQUIREMENTS WITHOUT PRIOR NOTICE.
