Brief
The undersigned was appointed as enquiry Officer by Chief Engineer

Irrigation Lahore Zone Lahore against Mr. Malik Muhammad Afzal , Sub Engineer &

Mr. Allaha Ditta Mate of Bahrianwala Section Sheikhurpura Division UCC

Sheikhupura ,vide order No. 1464/Admn(II) LHR/2020/20985/E-File dated

22.10.2020 under the “Punjab Employees Efficiency, Discipline and

Accountability Act 2006”,on the charges of in-efficiency, misconduct and

corruption.

To start the enquiry proceedings notices for hearing were served to

accused official with copy to all concern vide this office letter No. 1080-81/27-E dated

02.12.2020 ,No. 1135-36/27-E dt.10.12.2020 No.1225-26/27-E dt.26.12.2020

respectively and directed to appear before the Enquiry Officer along with defense

reply on subsequent dates.

The detail of charges pervaded by the Authority is produced as under:-

CHARGES AGAINST THE SUB ENGINEER

i. He has failed to check, report and control over water theft

offences on Rajbah Beharinwala.

 ii. He failed to perform his legitimate official field duties to ensure

equitable distribution of canal water supply up to tail enders of Rajbah

Bahirinwala.

Due to his serious negligence, the loss to Irrigation Department as well

as public occurred.

CHARGES AGAINST THE MATE

i. He failed to check and report of water theft of water theft offences on

Rajbah Bahrianwala to his seniors.

PROSECUTION PROCEEDINGS

1ST HEARING
 The date of hearing was fixed on 09/12/2020
 The accused Sub Engineer and Mate has attended and received allegation statement .
he requested defense reply will be submitted on next date.
 2nd
HEARING
 The date of hearing was fixed on 23/12/2020
 The accused Sub Engineer and Mate Attended the inquiry proceeding on fixed date
and time, submitted defense reply.
3rd HEARING
 The date of hearing was fixed on 05/01/2021
 The accused Sub Engineer and Mate as well as SDO (D.R) has attended the inquiry
proceeding on fixed date and time, and submitted their reply.
Sub Division Officer, Sheikhurpura Sub Division,UCC Sheikhurpura was
appointed as Departmental Representative in terms of Section 9(1)(c). read with section 12 of
Act ibid by the Authority vide No. 1464/Admn(II) LHR/2020/20985/E-File dated
22.10.2020. The Departmental Representative were called on each date of hearing as fixed
by enquiry officer mentioned above and was requested to furnish his reply, and defend the
case on the prosecution side accordingly and provide the relevant record to the enquiry
officer.

DEFENCE REPLY OF ACCUSED SUB ENGINEER.

The accused Sub Engineer submitted his defense reply, received in this office

on 23/12/2020. He written stated that:-

PMIU staff visited Bahrianwala Minor on 1508-2020 and detected some

offences which were reported vide their office canal wire No.1802, dated: 18-03-

2020. The allegation wise reply is as under.

He has failed to check, report and control over water theft offences on

Rajbah Bahrianwala.

Reply

The charge is denied that preventive measure action taken by

undersigned has been shown in detail attached in tabular form, and documentary

support. It is worth mention that whenever any incident of water theft came into my

knowledge, I rushed to the site, Report it through canal wire, SMS sent to PMIU Data

base and also repair/ Close / remove the offence at the same time.

Charge No.2

He failed to perform his legitimate official field duties to ensure

equitable distribution of canal water supply up to tail Enders of Rajbah Bahrianwala.

Reply

The undersigned performed Govt. Duties with best of my ability and try

to control over water theft by visiting the channel round the clock and whenever any

incident of water theft came under my knowledge, I suddenly remove the same after

necessary reports to the departments and PMIU data base. Sometimes the tails

found short because of water theft in upper reach and growing of weed / grass in the

bed of the channel which was also removed through the departmental establishment.

In the light of above mentioned facts, it is clearly proved that

1- I am not guilty of inefficiency, within measuring of section-3

Act 2006” read with amendment therein.

2- I am not stand corrupt or may reasonably be considered as corrupt within

measuring of section-3 (II) of “ The Punjab Employees Efficiency Discipline

and Accountability Act 2006” read with amendment therein.

It is therefore humbly requested to file the inquiry against me so that I can

perform my duties with mental satisfaction.
