MEMORANDUM OF UNDERSTANDING

KNOW ALL MEN BY THESE PRESENTS:

This Agreement, made and executed this ________________ day of ___________________, 2022 at
______________________________________, by and between

FIRST CITY PROVIDENTIAL COLLEGE (FCPC), a corporation duly organized and existing under
and by virtue of Philippine laws, with address at Brgy. Narra Francisco Homes Subd., City of San Jose del
Monte, Bulacan, represented herein by its duly authorized Vice President for Academic Affairs, Research
and Registrar, Echel Simon-Antero, Ph.D., hereinafter to as the “First Party”;

And

KUYA J RESTAURANT, with address at SM Tungko, City of San Jose Del Monte, Bulacan, represented
herein by its Manager, Mr. Anson Almasan, hereinafter referred to as the “Second Party”;

WITNESSETH:

Whereas, The First Party is a basic education, tertiary training educational institution offering Four-Year
courses; BS Nursing, BS Midwifery, Bachelor of Secondary Education, Bachelor of Elementary Education,
BS Hospitality Management, BS Information Technology, BS Tourism Management, BS Office
Management, BS Business Administration, BS Engineering, BS Criminology, BS Accounting Technology,
BS Psychology, BS Computer Science, BS Information System, Kindergarten, Elementary, Junior High
School and Senior High School duly authorized by the Commission on Higher Education (CHED) and
Department of Education (DepEd);

Whereas, The First Party desires to send Basic Education, Senior High School students and College students
for training in the Second Party’s institution as part of their Learning Experiences, On the Job Trainee,
Immersion Learning Activities, Apprenticeship and Research pursuant to the required curricula mandated by
the Department of Education and Commission on Higher Education.

Whereas, The Second Party, as an institution/company/resort/salon/RESTAURANT/travel agency/tourism


office capable and qualified to provide the facilities necessary as affiliating for the said training, and the First
Party has manifested its desire to use these facilities for the training of its students, likewise, Second Party
has accepted First Party’s request as affiliating institution/company/ RESTAURANT/ salon/restaurant
/travel agency/ tourism office.

NOW THEREFORE, for and in consideration of the foregoing premises, and subject to the mutual term and
conditions herein set forth, the parties hereby bind themselves to undertake a Memorandum of Agreement for
the purpose of supporting the Tertiary On-The-Job Training for Bachelor of Science in Hospitality
Management and Bachelor of Science in Tourism Management Students under the following terms and
conditions:

1. OBLIGATION OF THE FIRST PARTY


a. The FIRST PARTY shall be responsible for briefing the OJT student-trainee for the face to face
practicum exposure in the establishment of the SECOND Party as part of the curriculum.

b. The FIRST PARTY shall provide the OJT student-trainee the basic orientation on application
procedures, work values and proper decorum to ensure smooth cooperation with the SECOND
Party.

c. The FIRST PARTY (thru the supervision of the Dean) shall issue an official endorsement
vouching for the well-being of the OJT student-trainee which shall be used by the Second Party
for processing the application of the student-trainee.

d. The FIRST PARTY represented by the practicum coordinator/dean shall be allowed to monitor
OJT student-trainee to ensure the deliverance of quality education in the New Normal through
virtual approach.

e. The FIRST PARTY shall voluntarily withdraw a student-trainee who is found to misbehave
and/or act in defiance to existing standards, rules, and regulations of the Second Party and impose
necessary sanctions to the said student-trainee.
2. OBLIGATION OF THE SECOND PARTY
a. The SECOND PARTY shall provide necessary information in the conduct of face to face
practicum to student-trainee.

b. The SECOND PARTY is responsible for providing a lecture and restaurant


familiarization/orientation within the duration of less than or (2) months to complete 200 hours
practicum requirement; (8) weeks meetings /lectures/ actual training, quizzes, submission of
portfolios, summative assessment and evaluation.

c. The SECOND PARTY shall allow student trainee to render duty during vacant hours listed in
their class schedule for the 1st semester of sy 2022-2023.

d. The SECOND PARTY shall allow student trainee to render over time until 8pm only.

e. The SECOND PARTY shall provide Practicum Certificate to student-trainee, however,


Certificate of Practicum Training with corresponding number of hours will be given upon
completion of the required hours.

f. The SECOND PARTY shall assess the student trainee in accordance with the evaluation
provided by the FIRST PART. If the SECOND PARTY has an evaluation/assessment form, the
FIRST PARTY will also take that into consideration and incorporate it into the student grade.

g. The SECOND PARTY shall require and monitor their daily attendance and performance.

h. The duration of the program shall be equivalent to 200 working hours unless otherwise agreed
upon by the Second Party and First Party;

i. Any violation of the foregoing provisions will warrant cancellation of the Memorandum of
Agreement by the Second Party within thirty (30) days upon notice to private HEI (FCPC);

j. This Memorandum of Agreement shall become effective upon signature of both parties and
implementation will begin immediately and shall continue to be valid hereinafter until written
notice is given by either party thirty (30) days prior to the date of intended termination;

3. TERM OF AGREEMENT – The term of this agreement shall be for a period of maximum (2)
Months; 200 hours at the instance of the FIRST PARTY, provided that any intention to renew the
agreement shall be made in writing at least thirty (___) days prior to the intended On-the Job-
Training (OJT) period.

4. The parties herein agree that failure to comply with any of the provisions herein shall constitute a
breach thereof and shall be a ground for immediate termination of the agreement which shall be
litigated exclusively in the appropriate court of Quezon City. The erring party shall pay the cost of
Litigation and Pin attorney’s fee.
