Opposers, LT Overseas North America, Inc., a California corporation, located and doing
business at 11130 Warland Drive, Cypress, California 90630 and LT Foods International
Limited, a Great Britain limited company, located and doing business at 1 Fetter Lane, C/O
Legal Linx Limited, London Great Britain EC4A1BR (“Opposers”) believe that they will be
damaged by the registration of the ROYAL MAHOUT & Elephant Design mark (“Applicant’s
Mark”) shown in U.S. Trademark Application Serial No. 87/462010 (the “Application”), filed on
May 24, 2017 by Atalanta Corporation, a New York corporation with an address of 1 Atalanta
Plaza, Elizabeth, New Jersey 07206 (“Applicant”) and therefore oppose the same. A description
of Applicant’s Application is as follows:

As grounds for opposition, it is alleged:
1. Since at least as early as 1989, long before Applicant filed its Application and
allegedly began using Applicant’s Mark in interstate commerce, Opposer LT Overseas North
America, Inc. has been and still is, using its ROYAL® mark in connection with rice. Opposer LT
Overseas North America, Inc. has also been using its ROYAL® mark in connection with grains,
teas and other food and beverage items.
2. In addition, since at least as early as 1995, Opposer LT Foods International
Limited has been and still is, using its elephant design marks in connection with rice, including,
but not limited to its ® mark.
3. Opposers LT Overseas North America, Inc. and LT Foods International Limited
are related companies.
4. Opposer LT Overseas North America, Inc. owns and relies upon incontestable
United States Trademark Registration No. 3,990,952 (“’952 Registration”) for the mark

® for “rice” in International Class 30, which registration
issued on July 5, 2011 and is based on an application filed with the United States Patent and
Trademark Office (“PTO”) on March 30, 2010. The filing date of the ’952 Registration is prior to
the filing date of the Application. True and correct copies of printouts from the electronic
database records (TSDR) of the PTO showing the current status and title of the ’952
Registration are attached hereto as Exhibit 1 and made of record.
5. Opposer LT Overseas North America, Inc. owns and relies upon United States
Trademark Registration No. 4,203,136 (“’136 Registration”) for the mark ROYAL® for
“preserved, frozen, dried and cooked fruits and vegetables; jellies, jams, compotes; eggs, milk;
milk products, namely, milk powder, evaporated milk, sterilized milk, whipping cream, fermented
milk beverages, cultured milk drinks containing lactic acid, yogurt, fermented milk; edible oils
and fats” in International Class 29 and “coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial
coffee; flour; preparations made from cereals, namely, corn flour, whole grain oat, corn bran,
rice; bread, pastry; confectionery, namely, chocolates, candies, gumdrops, mints, caramels,
toffees, chewing gum, frozen confectionery; ices, honey, treacle; yeast; salt, mustard; vinegar,
condiments, namely, sauces; spices; ice” in International Class 30, which registration issued on
September 4, 2012 and is based on an application filed with the PTO on April 11, 2011. The
filing date of the ’136 Registration is prior to the filing date of the Application. True and correct

current status and title of the ’136 Registration are attached hereto as Exhibit 2 and made of

Trademark Registration No. 5,192,223 (“’223 Registration”) for the mark ROYAL AUTHENTIC
ADVENTURES® for “coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial coffee; flour;

bread, pastry; confectionery, namely, chocolates, candies, gumdrops, candy mints, caramels,
toffees, chewing gum, frozen confectionery; ices, honey, treacle; yeast; salt, mustard; vinegar,
condiments, namely, sauces; spices; ice” in International Class 30, which registration issued on
April 25, 2017 and is based on an application filed with the PTO on December 17, 2015. The

status and title of the ’223 Registration are attached hereto as Exhibit 3 and made of record.

1992 and is based on an application filed with the PTO on May 2, 1991. The filing date of the

Trademark Registration No. 5,428,599 (“’599 Registration”) for the mark ROYAL® for “regular
and organic dried lentils and beans” in International Class 30, which registration issued on
March 20, 2018 and is based on an application filed with the PTO on September 27, 2012. The
copies of printouts from the electronic database records (TSDR) of the PTO showing the current
status and title of the ’599 Registration are attached hereto as Exhibit 7 and made of record.
11. Opposer LT Foods International Limited owns and relies upon incontestable
United States Trademark Registration No. 1,308,227 (“’227 Registration) for the mark
® for “rice” in International Class 30, which registration issued on
December 4, 1984 and is based on an application filed with the PTO on May 9, 1983. The filing

date of the ’227 Registration is prior to the filing date of the Application. True and correct copies
of printouts from the electronic database records (TSDR) of the PTO showing the current status
and title of the ’227 Registration are attached hereto as Exhibit 8 and made of record
United States Trademark Registration No. 1,997,257 (“’257 Registration) for the mark
® for “rice” in International Class 30, which registration issued on August
27, 1996 and is based on an application filed with the PTO on March 25, 1993. The filing date
of the ’257 Registration is prior to the filing date of the Application. True and correct copies of
printouts from the electronic database records (TSDR) of the PTO showing the current status and
title of the ’257 Registration are attached hereto as Exhibit 9 and made of record
United States Trademark Registration No. 1,997,256 for the mark ® for
“rice” in International Class 30, which registration issued on August 27, 1996 and is based on an

United States Trademark Registration No. 2,003,335 for the mark ® for
“rice” in International Class 30, which registration issued on September 24, 1996 and is based
on an application filed with the PTO on March 25, 1993. The filing date of the ’335 Registration
is prior to the filing date of the Application. True and correct copies of printouts from the
electronic database records (TSDR) of the PTO showing the current status and title of the ’335
Registration are attached hereto as Exhibit 11 and made of record.
15. Opposers’ registrations identified in Paragraphs 4, 7-9, and 11-14 are incontestable.
As such, they constitute conclusive evidence of the validity of the registered marks and of the
registrations of the marks, of Opposers’ ownership of the marks, and of Opposers’ exclusive right to
use the registered marks in commerce as provided in Section 33 of the Lanham Act, 15 U.S.C. §
1115.
16. Opposers’ registrations identified in Paragraphs 4-14 are valid, subsisting,
unrevoked, uncancelled, and not abandoned. As such, they constitute prima facie evidence of the
validity of the registered marks and of the registrations thereof, and Opposers’ ownership of the
marks shown therein. Said registrations also constitute notice to Applicant of Opposers’ claim of
ownership of the marks shown therein, all as provided in Sections 7(b), 22 and 33(a) of the
Trademark Act of 1946, as amended.
17. Opposer LT Overseas North America, Inc.’s dates of first use for Opposer’s ROYAL
marks set forth in Paragraphs 4-10 above (“ROYAL Marks”) and filing dates for the above
registrations for the ROYAL Marks precede the filing date of the Application.

18. Opposer LT Overseas North America, Inc., through continuous and substantial use
and promotion, has acquired significant goodwill and consumer recognition in Opposer’s ROYAL
Marks. Opposer also relies on its extensive common law rights in Opposer’s ROYAL Marks
throughout the United States as a basis for this Opposition proceeding.
19. Opposer LT Foods International Limited’s dates of first use of Opposer’s Elephant
design marks set forth in Paragraphs 11-14 above (“Elephant Design Marks”) and filing dates for
the above registrations for the Elephant Design Marks precede the filing date of the Application.
20. Opposer LT Foods International Limited, through continuous and substantial use
and promotion, has acquired significant goodwill and consumer recognition in Opposer’s Elephant
Design Marks. Opposer also relies on its extensive common law rights in Opposer’s Elephant
Design Marks throughout the United States as a basis for this Opposition proceeding.
21. Applicant seeks an unrestricted federal registration for the ROYAL MAHOUT &
Elephant Design mark covering “rice; bakery desserts” in International Class 30 as set forth in
Applicant’s Application. As such, if Applicant’s Application matures to registration, such registration
will constitute prima facie evidence of Applicant’s exclusive right to use the registered mark in
commerce or in connection with the identified goods throughout the United States with no limitation
thereon.
22. Applicant’s ROYAL MAHOUT & Elephant Design mark so resembles Opposers’
ROYAL Marks and Elephant Design Marks as to be likely to cause confusion or to cause mistake
or to deceive under Section 2(d) of the Trademark Act. In view of Opposers’ prior statutory and
common law trademark rights, Applicant is not entitled to registration of the Application pursuant to
Section 2(d) of the Lanham Act, 15 U.S.C. § 1052(d).
23. By reason of the foregoing, Opposers will be damaged by registration of U.S.
Trademark Application Serial No. 87/462010 for the mark ROYAL MAHOUT & Elephant Design.
WHEREFORE, Opposers request that U.S. Trademark Application Serial No. 87/462010
for the mark ROYAL MAHOUT & Elephant Design be rejected and stricken, that no registration

be issued thereon to Applicant, and that this opposition be sustained in favor of Opposers.

required, including any fees for additional extension of time, or credit any overpayment to this
