‫حماية المزرعة وعدم دخول أي مواشي الى المزرعة وفي حال دخولها واتالفها للمحاصيل يتحمل الطرف‬ ‫‪-‬‬

‫الثاني أي خسائر تنتج عن ذلك‬

‫تزويد الوقود لكافة آليات الطرف األول العاملة في مشروع الطرف الثاني‬ ‫‪-‬‬
‫قبل تحرك كل شحنة من الموقع يدفع مستحقات الزكاة وأي ضرائب أو رسوم حكومية نافذة على بضاعته‬ ‫‪-‬‬
‫حسب القوانين واألنظمة المعمول بها حاليا أو التي تقر مستقبال‬
‫صيانة وفتح الشوارع داخل المزرعة وبين المزارع من أجل وصول الشاحنات الى مواقع التحميل‪ ،‬وكذلك من‬ ‫‪-‬‬
‫مدخل المزرعة الى الشارع الرئيسي على أن يستكمل فتح جميع الشوارع قبل بدء العمليات‬
‫تجهيز وتسوية مواقع تخزين الباالت حتى ال تتأثر خالل الفترة المطلوبة للتجفيف بين الكبس والتحميل على أن‬ ‫‪-‬‬
‫يستكمل العمل قبل موعد بدء الحصاد‬
‫تأمين السكن المناسب لكافة العاملين والمشرفين على األعمال من موظفي الطرف األول ودفع مبلغ‪.....‬لكل‬ ‫‪-‬‬
‫عامل للطعام والشراب عن كل يوم طيلة فنرة العمل‪ ،‬باالضافة لترحيلهم من موقع مشروع الطرف األول‬
‫ب‪.......‬الى موقع مشروع الطرف الثاني ب‪......‬واعادتهم الى موقع مشروع الطرف الول ب‪.....‬بشكل‪.......‬‬
‫سداد أي ضرائب أو رسوم حكومية نافذة يدفعها الطرف األول عن بضاعة أو التزامات الطرف الثاني نظير‬ ‫‪-‬‬
‫مستند رسمي‬
‫سداد ثمن خيوط التربيط المستخدمة في عملية الكبس‬ ‫‪-‬‬
‫يلنزم الطرف الثاني طوال فترة سريان هذا العقد ب‪:‬‬
‫بيع كامل المحصول المنتج من المساحة المتفق عليها والمطابقة للمواصفات (الملحق) للطرف األول ووفقا‬ ‫‪.1‬‬
‫للسعر الوارد في المادة (‪ )5‬الفقرة (‪ )1‬لهذا العقد‬
‫تخزين الباالت في األرض موضوع العقد (تخزين خارج المزارع) لمدة تتراوح بين ‪ 4-1‬اسابيع تقريبا‬ ‫‪.2‬‬
‫من تاريخ الحصاد لضمان عدم تجاوز نسبة الرطوبة المطلوبة (وهي ‪ .)%12‬ويجب عدم البدء في عملية‬
‫التحميل حتى الوصول الى نسبة الرطوبة المطلوبة (‪)12%‬‬
‫عدم التصرف بأي كمية من المحصول النتج المتعاقد عليه اال بعد الموافقة الخطية للطرف األول‬ ‫‪.3‬‬
‫تزويد الوقود لكافة آليات التحميل الخاصة الطرف األول العاملة في مشروع الطرف الثاني‬ ‫‪.4‬‬
‫حماية جميع آليات الطرف األول من السرقة والتلف‬ ‫‪.5‬‬
‫تأمين السكن واألقامة واالعاشة لفريق التحميل المكلف من قبل الطرف األول‬ ‫‪.6‬‬
‫قبل تحرك كل شحنة من الموقع يدفع مستحقات الزكاة وأي ضرائب أو رسوم حكومية نافذة على بضاعته‬ ‫‪.7‬‬

‫مستقبال‬ ‫حسب القوانين واألنظمة المعمول بها حاليًا أو التي تقر‬
‫صيانة وفتح الشوارع داخل المزرعة وبين المزارع من أجل وصول الشاحنات الى مواقع التحميل‪ ،‬وكذلك‬ ‫‪.8‬‬
‫من مدخل المزرعة الى الشارع الرئيسي على أن يستكمل فتح جميع الشوارع قبل بدء عمليات التحميل‪.‬‬
‫وفي حالة التأخير ألكثر من ‪ 24‬ساعة يتحمل الطرف الثاني قيمة رحالت النقل المتأخرة‬
‫تجهيز وتسوية مواقع تخزين الباالت حتى ال تتأثر خالل الفترة المطلوبة للتجفيف‬ ‫‪.9‬‬
7- Protecting the farm and preventing any instance of cattle entrance, failing
which any losses on account thereof shall be borne by the Second Party
8-Providing fuel of all the machinery of the First Party engaged in the project of the
Second Party
9-Prior to the departure of each load from the site, any such taxes or
governmental fees as may be imposed on the goods of the First Party shall
be paid by the First Party in accordance with the laws and regulations
currently in force or shall be enacted
10-Maintaining and opening the routes within the farm and between the farms for the
arrival of trucks at loading sites and additionally from the entrance of the farm to the
main road, provided that the opening of all routes is completed before commencing
operations
11-Readying and levelling the sites of bales storage in order not to be affected during
the period between compression and loading required for drying, provided that the
work is completed before the time of commencement of harvest
12-Securing appropriate accommodation of all the personnel and superintendents of
the First Party and paying a sum of ……. every day to each employee for the food and
drink thereof for the period of employment, in addition to transporting the them from
the project site of the First Party for an amount of……to the project site of the Second
Party for an amount of…… and transporting the same back to the project site of the
First Party for…… per……
13-Paying any such applicable taxes or governmental fees as may be paid by the First
Party for the goods or obligations of the Second Party against documentation
14 repaying the cost of the fastening cord used in compression
The Second Party shall for the duration of this contract be obligated to:
1-Selling the entire yield produced on the agreed-on area agreed in
compliance with the specifications of the First Party and in accordance
with the quotation set forth in article 5 paragraph 1 herein
2-Storing bales on the land contemplated hereunder (outside-farm storage)
for a period varying between approximately 1-4 weeks from the date of the
harvest to ensure that the required percentage of humidity (which is 12%)
is not exceeded. Loading must not commence until reaching the required
percentage of humidity (12%).
3- Any quantity of the contractual yield shall not be disposed of without
the prior written consent of First Party
4-Providing fuel of all the machinery of loading belonging to the First
Party and engaged in the project of the Second Party
5-Protecting all the machinery of the First Party against theft and damage
6-Securing accommodation, housing and lodging to the loading team of
First Party
7-Prior to the departure of each load from the site any taxes or
governmental fees as may be imposed on the goods of the Second Party in
accordance with the laws and regulations currently in force or will be
enacted
8-Maintaining and opening the routes within the farm and between the farms for
the arrival of trucks at loading sites and additionally from the entrance of the farm
to the main road, provided that opening of all routes is concluded before
commencing the operations of loading. In the event of a delay of later than 24
hours, the Second Party shall bear the cost of late transportation
