Summary: The appellant was a member of the Malaysian Bar (‘MB’) and was duly elected to thfe Bar Council
(‘BC’) in November 1999 and in two succeeding years, 2000–2001 and subsequently 2002–2003. On 14 July 2001,
the appellant was elected the Vice President of the political party, Parti Rakyat Malaysian (‘PRM’). He applied for a
declaration that: (1) notwithstanding the appellant’s appointment as Vice President of PRM on 14 July 2001, he was
not disqualified from being a member of the BC in 2001–2002; and (2) a declaration that s 46A (1)(c)(ii) (‘the
impugned statutory provison’) of the Legal Profession Act 1976 (‘the Act’) — which disqualifies a person who
holds any office in any political party from being a member of the Bar Council — was inconsistent with the Federal
Constitution (‘FC’) and was in consequence void. This application was dismissed by the High Court, thus this
appeal. The issue was whether the impugned statutory provision offended art 10(1)(c) and[sol ]or art 5 of the FC
and should therefore be struck down by virtue of art 4, as being null and void.
