WHEREAS, Section 17, Article XIV of the 1987 Philippine Constitution provides that the
State shall recognize, respect, and protect the rights of indigenous cultural communities to
preserve and develop their cultures, traditions and institutions;
WHEREAS, pursuant to the provisions of Republic Act 8371 or the Indigenous Peoples
Rights Act of 1997, the State shall ensure that the Indigenous Cultural
Communities/Indigenous Peoples (ICCs/IPs) shall be given mandatory representation in local
legislative councils and policy-making bodies.
WHEREAS, Mr. Macario B. Gudayan was selected and took his Oath of Office as
Indigenous Peoples Mandatory Representative (IPMR) on September 13, 2021 at Vintarinian
Hall, Balay ti Ili, Barangay #2 San Nicolas, Vintar, Ilocos Norte, Philippines;
WHEREAS, the commencement of his duty as IPMR is upon taking his oath of office up to
the end of his term of three (3) years as provided in the Local guidelines for the IPMR in the
Local Legislative Council and other policy making bodies in the Indigenous Cultural
Community of Vintar, Ilocos Norte, Republic Act No. 8371 or the IP Rights Act of 1997 and
its Implementing Rules and Regulations and Republic Act 7160 or the Local Government
Code of the Philippines;
WHEREAS, funds for the position are available since the 45% Personal Services limitation
has not yet been fully utilized;
WHEREAS, IPMR Macario B. Gudayan will receive the full salaries and benefits accorded
to a Sangguniang Bayan member as provided under Republic Act 7160 or the Local
Government Code of 1991 effective on January 2023;
RESOLVED, as it is hereby resolved, to give confirmation to the Certificate of Affirmation
of Mr. Macario B. Gudayan as Mandatory Representative of Indigenous Peoples in the
Sangguniang Bayan of the Municipality of Vintar;
