I, RAMON D. MONDRAGON, Filipino, 35 years old, single and a resident

of Urgello St., Brgy. Sambag I, Cebu city, Philippines, after having been
duly sworn to in accordance with law, hereby depose and say:
1. That I am an accused in the above-entitled case filed by JOAN

KALOOY MERCADO;
2. That this Counter Affidavit is taken upon examination of ATTY.

JAYSON ANAD at his law office at ANAD & ASSOCIATES LAW
OFFICE, Melgo Bldg., Sanciangko Street, Cebu City, Philippines, where my
statements were taken;
3. That I am answering the questions asked of me, fully conscious that I

am doing this under oath and that I may face criminal liability for false
testimony or perjury if I state a falsehood in my testimony. The whole
process has been done in Visayan which language/dialect is understood by
me, and translated into English and explained to me;
4. That the following are the questions asked of me and answers that I
gave to the questions:

A3: Yes sir, because we are classmate when we are elementary].
P3: Pila naman na katuig nimo nga kaila si Joan Kalooy Mercado?
T3: Nakaila ko ni Joan Kalooy Mercado mga 13 ka tuig na.
[Q3: How many years have you known Joan Kalooy Mercado?
A3: I know Joan Kalooy Mercado for about 13 years already.
P4: Masulti ba nimo nganung inosente man ka ani nga kaso?.

T4: Oo, kay ako usa ka boutan nga taw, dili nako na mabuhat niya ug sa
laing taw. Ako pa gani siya gitabangan pagpangita og trabaho didto sa
Canada.
[Q4: Can you tell why are you innocent in this case?
A4: Yes, because I am a good person, I cannot do that to her or to
any person. In fact, I helped her to get a job in Canada].
P5: Unsa man ang mga nahitabo didto sa Canada pag abot ninyo ni Joan?
T5: Pag December 13, 2021, naabot mi ni Joan sa Canada og didto sa balay
sa among manager. Pila ka adlaw sa iyang pagtrabaho wala raman toy
problema pero mga pila ka simana ang nilabay, naay reklamo among
manager nga naay higayun nga si Joan sige daw og gamit sa iyang selpon ug
dili na maasikaso iyang trabaho, ang uban malimtan na.
[Q5: What happen when Joan arrived in Canada?

A5: On December 13, 2021, Joan and I arrived in Canada and in
the house of our manager. Days have past, there is no problem on
her job but weeks later, I hear a complaint from our manager
that there are times that Joan is always busy on her phone and
forget to do or finish her duties.]
P6: Nganong nakahibaw man ka ana nga estorya?

T6: Kay naa man mis sa opisina ato nisulti among manager kabahin ana.
[Q6: Why did you know that issue?

A6: Because we are at the office at that time and our manager
open up that issue to me.]
P7: Niadtong December 15, tuig 2021, ilabina niadtong mga orasa alas 7:00
sa gabie didto sa Canada dis-a ka ni adtong panahona?
T7: Niadtong petsaha ug oras, nagsakay nako ug bus para mosulod sa
trabaho.
[Q7: On December 15, 2021, particularly around 7:00 o’clock in
the evening in Canada, where were you?
A7: On that date and time. I was on my way riding a bus to go to
work.]
P8: Unsa may sunod nga panghitabo?

T8: Pag 7:20 sa gabie anang adlawa, naabot ko sa opisina ug nagkadungan
mig sulod sa among manager. Pagtaud-taud naabot si Paul usab.
[Q8: What happened next?

A8: At around 7:20 in the evening of the same day, I arrived at
the office together with our manager. Minutes later Paul arrived
as well.]
P9: Kabahin atong giingon ni Joan nga girape siya sa inyong manager anang
adlawa og orasa unsa man imong masulti ana?
T9: Buhat-buhat rana niya kay among manager buotan kaayo og dili na niya
mabuhat. Ilang balay naay mga CCTV kamera kada kilid, kahibaw ko ana
kay kapila nako nakasulod sa ilang balay, pwede nato to ichek para makita
ang kamatu-uran. Ug wala pa unta among manager sa opisina anang orasa
nga 7:30 kung gibuhat niya na kang Joan kay 45 ka minuto ang kalay un sa
opisina og sa ilang balay. Naa sad mi CCTV kamera sa opisina nga
magpakita nga amo manager naa didto anang orasa
[Q9: What can you say about the accusations of Joan of your
manager raping her at that time and date ?
A9: It was all fabricated because our manager is very polite and
he cannot do those things. Their house has many CCTV cameras
in every side and I know it because I’ve been there many times,
we can check it to see what is the truth. Also, if our manager did
that, he won’t be present in our office at 7:30 in that evening
because his house is 45 minutes away from the office. We also
have CCTV cameras in our office that will show our manager is
present at that time.]
P10: Ug kato tanan kay buhat-buhat ni Joan, unsa man ang rason nganu
buhaton na niya?
T10: Kahibaw ko nga si Joan nasuko ni nako kay atong usa ka adlaw, niadto
siya sa amoa kay manghuwam ug kwarta ug gabuhat- buhat ug storya nga
operahanan iyang manghud pero gitawagan man nako iyang mama og
naklaro nako nga okay ra yang manghud og dili operahanan maong wala
nako hatagig kwarta si Joan, kay kahibaw jud ko nga ipusta nasad na sa
online sabong kay nasakpan nako na si Joan nga nagduwa ana, ug kana ang
rason nganu mahurot iyang sweldo ug wala nay ikapadala sa iyang pamilya.
Tungod ana, nasuko siya nako og gipanglabay niya iyang gamit, katong
iyang passport ug visa. Ako nalang magpadala ug kwarta sa iyang pamilya
kay maluoy ko, ako sad raba siyang responsibilidad didto sa Canada, pero
pabayran rasad nako to niya.
[Q10: If all of those accusations are fabricated by Joan, what is
her reason on doing such things?
A10: I know that Joan was angry at me because there was a day
that she went to me to borrow money because according to her,
her younger sister needs an immediate operation but I confirms it
from his mother that it was not true and her sister was okay, that
is why I did not give her money because I surely know that she
will bet it on the online “sabong” which is the reason why she
always consumes all of her money and not sending money to her
family. Because of that, she is very angry at me to the point that
she was throwing her thing to me such as her passport and visa.
Also, because I was pity on her family and I have a responsibility
for bringing her in Canada, I used my money to send to her
family instead but I will make her pay for it.]

T11: Pagsunod adlaw ana, wala na daw ni balik si Joan sa balay sa among
manager. Pag January 18, 2022 nitext ko ni Joan nga nagplano kong mobalik
sa Pilipinas para makig storya sa iyang pamilya bahin sa iyang mga gibuhat
pero pag abot nako sa Mactan-Cebu International Airport, natingala ko nga
gidakop man kog pulis og gepusasan.

A11: On the next day, my manager told me that Joan did not
come back to their house. On January 18,2022, I texted her that i
planned to go back in the Philippines to talk to her family about
what she did but when I arrived at the Mactan-Cebu
International Airport, I was confused that I get arrested by the
police and put handcuffs on me.]
P12 : Kaila baka sa nagpusas nimo?

T12 : Pag una wala pa , pero nag paila na siya sa pag basa niya sa Miranda
rights na siya si PCpl. Nelson Kamandag.
[Q12 : Do you know the person who handcuffed you?

A12 : In first I don’t know him but he introduced himself as
PCpl. Nelson Kamandag by informing me my Miranda
rights.
P13 : Nangutana baka unsay sala nimo sa nagdakop kanimo?

T13 : Oo. Ni sulti sya nga akong nabuhat kay Human trafficking daw.
[Q13 : Do you ask why did they arrest you ?

A13 : Yes, they say that I committed a crime of human
trafficking.

piskal kalabot sa hitabo diin ikaw ang biktima?

[Q14 : In what language were you asked by the fiscal in relation
to the incident where you are the victim?
A14 : In the Visayan language].

T15 : Ang piskal misulti kanako nga ilang hubaron sa pinulungan English
ug unsay akong naestorya kanila panahon sa imbestigasyon unya ila akong

A15 : The fiscal told me that they translated what I said to
English and let me sign the affidavit which I signed because it
would be filed here in Lapu-Lapu City.]

I, RAMON D. MONDRAGON, Filipino, 35 years old, single and a resident

of Urgello St., Brgy. Sambag I, Cebu city, Philippines, after having been
duly sworn to in accordance with law, hereby depose and say:
1.That I am an accused in the above-entitled case filed by JOAN

KALOOY MERCADO;
2. I vehemently deny under oath the Complaint Affidavit of JOAN

KALOOY MERCADO for being false and fabricated. The truths of the
matter is hereby stated hereunder;
3. That last December 1, 2021 it is true that I text and her if she was
interested for a job in Canada. We meet up on or about 7:00 o’clock in the
evening on the same day to discuss the job I was talking about;
4. My manager in Canada is looking for a house maid and I offer it to her

if she was interested and she agree. I also helped her to process her
requirements with the help of my friend;
5. On December 11, 2022 I gave her Temporary Resident Visa and

Passport. Few days after I gave her ticket for Canada;
6. When we arrived at the house of my manager in Canada, I introduce

her to them and he explain what would be her duties to be done there. I leave
her at their house and I proceed to my workplace. As the days Past by, I did
not hear any bad information from my manager and from her as well, I
supposed that everything went smoothly;
7. Weeks later, on December 30, 2021 I received a complain from my

manager that Joan is often busy using her phone and forget to do some of her
duties in the house as a maid. From that matter, I asked her about it and she
said it is just some important business in the Philippines. I also believed and
advises her do it after her responsibilities at the house;
8. Few days later, her mother called me and ask how is Joan doing on her
job because since she gets there, they haven’t received even a peso yet. It
turns out that Joan is not sending money since her first pay because I
confirmed it to my manager that every three weeks, she received 1,000
Canadian dollars. I decided to confront her about the issue and on January 3,
2022 at around 9:00 o’ clock in the morning, I went to the house of my
manager to talk to her. Instead of doing her job, I caught her using her phone
and betting to an online “sabong”;
9. When she saw me, she immediately hides her phone and ask me why I
am here. At that time, I realized why she is not sending money to her family.
She begged not to tell her family about it and she promised to change for
good. I gave her a chance and make a deal with her that if she did not
change, I will tell her family, and because I feel pity on her family who are
expecting to receive money, I lend my money and send to her parents;
10. On January 15, 2022 at around 5:00 o’clock in the morning, she went
to my apartment and said there was an emergency, her younger sister was
brought to the hospital and needs an immediate operation but she doesn’t
have any money to send because she spent it all to the online “sabong” and
her payday is still next week. She asks if I could lend money to send to her
family, because I am doubtful, I confirm to her mother if the emergency was
true, but it turns out that it was just a fabricated story and she will only use
the money to bet in the online “sabong” ;
11. I did not give her money but she still insist that she really needs it, she
begs me but I still refuse. She threatened me that if I will not give her
money, I will regret it. After our argument, because of her anger, she threw
her things at me such as the passport and visa which I prepared for her,
slams my door and left;
12. On the next day, my manager told me that Joan did not come back to
their house, because I am tired of her attitude and the things that she is
doing, I gave up on her and regret on helping her to get a good job here in
Canada. On January 18, 2022 I texted her that I am planning to go back to
the Philippines to talk to her parents formally about what she’s been doing. I
brought her Passport and Visa because she left it and I’m afraid that it might
get lost there since I will just come back immediately after few days;
13. When I arrived at the Mactan-Cebu International Airport, I was

confused and scared when I get arrested by the police.
14. Furthermost, the complaint is uncorroborated and clearly fabricated

for it is not corresponded to the facts that really exist;
15. The complaint was brought only for the purpose of shamming,
harassing, degrading and humiliating me;
16. That I execute this affidavit to attest to the truth of the foregoing case.

5. That it is impossible for our manager to do what she was talking because

6. That she is only making a false story against Ramon because she wants to

failing to support her family.

A5: Yes, because I know Ramon since we are still here in
Philippines and he was very polite. At the time when he said that
he will help Joan to have a job in Canada, I helped Ramon to
process the Temporary Resident that Joan needs].

reklamo sa among manager nga naay higayun nga si Joan dili kaayo
motrabaho og sige daw og gamit sa iyang selpon. Usahay dili na maasikaso
iyang trabaho ang uban malimtan na. Nakakita sad mi jud nga si Joan
gaduwa anang online sabong didto sa balay sa amo manager katong gisugo
mi ni sir, kami to duha ani Paul, kay ipakuha ang dokyumento nga
kinahanglan niya sa ilaha.
A6: On December 13, 2021, Joan arrived in Canada and in the

house of our manager. Days have past, there is no problem on her
job but weeks later, I hear a complaint from our manager that
there are times that Joan don’t want to work and is always busy
on her phone. Sometimes she forgets to do or finish her duties. We
also saw it personally that Joan is playing online “sabong” at the
house of our manager, when he told us, me and Paul, to go to his
house to get the document that he needed.]

A10: It was all false and fabricated because our manager is very
polite and he cannot do those things. Their house has many CCTV
cameras in every side and I know it because I’ve been there once.
Also, if our manager did that, he won’t be present in our office at
7:30 in that evening because his house is 45 minutes away from
the office. We also have CCTV cameras in our office that will
show our manager is present at that time.]

her younger sister needs an immediate operation but Ramon did
not give her money because he know also that she will bet it on the
online “sabong” which is the reason why she is not sending money
to her family.]
