EXECUTIVE ORDER NO. ___
Series of 2022

AN ORDER RECONSTITUTING THE BOARD OF INQUIRY FOR THE


PROVINCIAL GOVERNMENT OF ALBAY

WHEREAS, Section 1, Article XI of the 1987 Philippine Constitution


specifically mandates that public office is a public trust. Public Officers and employees
must at all times be accountable to the people, serve them with utmost responsibility,
integrity, loyalty and efficiency, act with patriotism and justice, and lead modest lives;
WHEREAS, Section 2 of the Local Government Code of 1991 provides that the
state shall provide for a more responsive and accountable local government structure
instituted through a system of decentralization whereby local government units shall be
given more powers, authority, responsibilities, and resources;

WHEREAS, Section 3 (j) of the Local Government Code of 1991 provides that
effective mechanisms for ensuring the accountability of local government units to their
respective constituents shall be strengthened in order to upgrade continually the quality of
local leadership;

WHEREAS, Section 83 of the Local Government Code of 1991 provides that in


every local government unit, the local chief executive shall establish a procedure to
inquire into, act upon, resolve or settle complaints and grievances presented by local
government employees;

NOW THEREFORE, I, NOEL E. ROSAL, Governor of the Province of Albay


by virtue of the powers vested in me by law, do hereby order:
SECTION 1. CREATION AND COMPOSITION. – It is hereby created a
committee composed of the following:

Vice-Chairman : Board Member Vicente Baltazar III

Members : Provincial Administrator

: Provincial Tourism, Culture & Arts Office

: Provincial Human Resource Management


Office

: Provincial Engineering Office

: Provincial General Services Office

: Provincial Youth Development Office


: Provincial Engineering Office

: Committee on Tourism, SPA

: Local Budget Committee

: SK Federation

Except for the Provincial Administrator, Chairman – Ethics Committee SP, Provincial
Legal Officer and the Head – Internal Audit Services, The Governor shall designate from among
the employees in the Human Resource Office who shall sit as member thereof. The
representative from the Civil Service shall be designated by the Regional Director of the said
Office. However, failure to designate a representative from the Civil Service Commission shall
not affect the exercise by the Board of its functions.

SECTION 3. POWERS AND FUNCTIONS OF THE BOARD OF


INQUIRY. – The Board shall have the following powers and functions:

1. To hear and determine any complaint or redress of grievance against any


employee in relation to the performance of their official function;
2. To hear such complaints in accordance with the prescribed administrative
procedure as prescribed by the civil service law;
3. To resolve such complaints after such proceedings and to recommend the
filing of the necessary action, civil, criminal or administrative, in relation to
such findings;
4. To investigate, motu proprio, or upon verified and anonymous complaint on
any violation of the Civil Service Law by any of the aforementioned
employees including but not limited to graft and corruption, usurpation of
authority and dereliction of duty. The power to investigate carries with it the
power of subpoena; and
5. To perform such other functions as may be delegated to them by the
Governor.

SECTION 4. MEETINGS AND QUORUM.- (a) The Board shall convene once
a case is being heard and investigated.

(b) A majority of the members of the Board shall constitute a quorum. The
affirmative vote of the majority of the members present, there being a quorum shall be
necessary to pass a decision for the final approval of the Governor.
SECTION 5. Any lawsuit filed against the members of the Board of Inquiry in
the Performance of their functions and duties, whether civil,
criminal or administrative, shall be provided with the appropriate
legal assistance by the provincial government.
SECTION 6. FUNDING. Expenses relative to the performance of the Board’s
duties and functions shall be charged to funds appropriated to the Governor’s Office as
may be authorized by the Governor.
SECTION 7. REPEALING CLAUSE. Previous issuances inconsistent with this
order shall be deemed amended, or modified or superseded.
SECTION 8. EFFECTIVITY. This Executive Order shall take effect
immediately.
