BAC RESOLUTION NO. 513, series of 2022

A RESOLUTION REPEALING BAC RESOLUTION NO. 167, SERIES OF 2020 DATED

18 MARCH 2020 AND BAC RESOLUTION NO. 513, SERIES OF 2020 DATED 27
OCTOBER 2020

WHEREAS, on March 8, 2020, the Office of the President issued Proclamation No. 922
“Declaring a State of Public Health Emergency Throughout the Philippines” due to the local
transmission of the Corona Virus Disease (COVID-19) in the country, which enjoins government
agencies and local government units “to render full assistance and cooperation and mobilize
necessary resources to undertake critical, urgent and appropriate response and measures in a
timely manner to curtail and eliminate the COVID-19 threat” among others;

WHEREAS, in response thereto, the Government Procurement Policy Board (GPPB)

issued Resolution No. 03-2020 dated March 9, 2020 entitled “Approving the Adoption of
Efficient, Effective, Expedient Procurement Procedures During a State of Public Health
Emergency” providing certain measures to ease the procurement process;
WHEREAS, on March 18, 2020 the Bids and Awards Committee of the Provincial
Government of Albay issued BAC Resolution No. 167, series of 2020 to “Authorize the end-user
to directly negotiate with a legally, technically, and financially capable supplier for procurements
determined by the BAC to be procured under Negotiated Procurement (Emergency Cases) under
Section 53.2 of the Revised IRR of RA 9184 and Item V(D)(2a) of Annex “H” of the same
IRR”;
WHEREAS, on October 27, 2020 the Bids and Awards Committee of the Provincial
Government of Albay issued BAC Resolution No. 513, series of 2020 “Authorizing the end-user
to directly negotiate with a legally, technically, and financially capable supplier for procurements
determined by the BAC to be procured under Negotiated Procurement (Emergency Cases) under
Section 53.2 of the Revised IRR of RA 9184 and Item V(D)(2a) of Annex “H” of the same IRR
during Typhoon “Quinta”.
WHEREAS, on September 10, 2021, the Office of the President issued Proclamation No.
1218, series of 2020 entitled “Further Extending the Period of State of Calamity Throughout the
Philippines due to Corona Virus Disease 2019 Declared under Proclamation No. 1021, series of
2020” for a period of one (1) year, effective September 13, 2021 to September 12, 2022.

NOW THEREFORE, :
NOW THEREFORE, after a thorough discussion, review and study of the attendant
issuances and circumstances, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, TO
RECOMMED TO THE HONORABLE GOVERNOR THE FOLLOWING:
1) Repeal BAC Resolution No. 167, series of 2020 dated March 18, 2020 and BAC
Resolution No. 513, series of 2020 dated October 27, 2020.
2) Authority vested in the end-user by virtue of the abovementioned BAC
Resolutions be revoked.
UNANIMOUSLY APPROVED.
