SUMMARY:

While working a detail at the Michigan International Speedway (MIS) I attempted to break up a fight between
two subjects. Upon splitting the two subjects up, one of the subjects involved, identified as
seized hold of me twice in an attempt to stop me from breaking up the assault and battery that was
occurring.

INFORMATION:

I was working a detail at the MIS with the Michigan State Police Tactical Bike Team. At the time I was working
with D/Sgt Issac Mills of the MSP Lansing Post. During this detail D/Sgt Mills and I were wearing fully marked
MSP uniforms which identified us as being with the Michigan State Police. D/Sgt Mills and I were monitoring
pedestrian traffic when we observed two subjects fighting along the fence line. One subject later identified as
was pushing a subject, later identified as against the fence forcefully. The
subjects where then being separated by other members of their group, but continued to go at each other.

D/Sgt Mills and I rode our bikes over to the fight activating our bike emergency lights. I arrived on scene first.
When I arrived on scene the two subjects had been pulled apart by another subject, however, separated from
the subject attempting to break up the fight and continued to fight one another. I dismounted my bike and got
in between the subjects and told them to stop. I grabbed the smaller subject, and pulled him away and
told him again to stop. At that time, the other subject involved in the fight, grabbed me by the shirt and
forcefully shoved me away. I instructed not to put his hands on me and pushed him away from me.
came back at me again and grasped my shirt pulling me towards him. At that time D/Sgt Mills arrived on
scene and tackled to the ground. I grabbed and instructed him sit on the ground. D/Sgt Mills got
under control and instructed him to put his hands behind his back. At first refused and kept his
hands underneath his body. D/Sgt Mills told again to put his hands behind his back. After a few
moments complied and was placed in handcuffs.

After the situation had settled down I advised that he was under arrest for assaulting a police officer.
stated that he didn’t know I was a police officer and thought I was somebody else. I advised him that I
am in uniform identifying myself as a police officer. then stated that he never assaulted me and only
pushed me away. then stated that if he had assaulted me then he would have “beaten me to a pulp”.
further stated that he was trying to pickup off the ground as he was heavily intoxicated. He stated
when he tried to pick him up, started to fight him. I advised that I witness the encounter and came
over to break them up and send them on the way. I advised him again that he wasn’t in trouble for fighting with
his friend but for assaulting a police officer.

All the subjects involved were highly intoxicated. A PBT was not available so no PBT was conducted on .

INJURIES:

suffered an abrasion to his left elbow from making contact with the ground when he was tackled by D/Sgt
Mills. He denied any medical attention. D/Sgt Mills nor I sustained any injuries.

INTERVIEW

As I was obtaining information he asked me why his friend was going to jail as they had just been
arguing. I advised him that his friend was not going to jail for fight with him but for assaulting a police officer. I
advised him that I saw them fighting and only wanted to break up the fight and send them on their way,
however his friend chose to put his hands on a police officer and he was now going to jail.

SUMMARY:

While working a detail at the Michigan International Speedway (MIS) Sgt. Gonzalez attempted to end an active
assault between and . Upon separating the involved subjects,
seized hold of Sgt. Gonzalez twice, to include forcefully shoving Sgt. Gonzalez, in order to stop him from
ending the ongoing assault. In order to stop the active aggression was conducting against Sgt.
Gonzalez, I performed a takedown to cease the use of force and effect an arrest of .

INFORMATION:

I was working a detail at the MIS with the Michigan State Police (MSP) Tactical Bike Team (TBT). Sgt.
Gonzalez, of the MSP First District Hometown Security Team (HST), was my partner for this event. Both Sgt.
Gonzalez and I were wearing fully marked MSP uniforms which identified us as being with the MSP. Further,
Sgt. Gonzalez and I were riding fully marked MSP bicycles, equipped with emergency lights, which further
identified us as being with the MSP.

CIRCUMSTANCES / OBSERVATIONS:

Sgt. Gonzalez and I were monitoring pedestrian traffic at the venue when we observed two subjects actively
fighting along the nearby fence line.

Sgt. Gonzalez and I rode our patrol bicycle’s over to the fight activating our bicycle’s emergency lights enroute.
I was momentarily caught up on railing set up for the event causing Sgt. Gonzalez to arrive on scene first.

Upon my arrival on scene, I observed Sgt. Gonzalez separating and while using verbal
directions ordering them to stop fighting. I observed to aggressively clutch Sgt. Gonzalez’ uniform shirt
(ACTIVE AGGRESSION) and violently shove Sgt. Gonzalez away (ACTIVE AGGRESSION). As I dismounted
my patrol bicycle, I observed Sgt. Gonzalez push away from him while using verbal directions ordering
to not touch him. I then observed to combatively seize Sgt. Gonzalez again by his uniform shirt
(ACTIVE AGGRESSION) and pull Sgt. Gonzalez towards him (ACTIVE AGGRESSION).

THREAT ASSESSMENT:

My assessment of the threat level on scene was as follows:

1) was portraying active aggression against both and Sgt. Gonzalez. did not heed
Sgt. Gonzalez’ verbal directions to cease fighting or to stop grabbing him, thus a verbal de-escalation
was not possible. Due to this behavior, I assessed the circumstances as a non-discretionary / exigent
event.
2) I feared violence from to Sgt. Gonzalez. had already assaulted and Sgt.
Gonzalez and showed no signs of stopping his violent actions.

THREAT ASSESSMENT CONTINUED:

3) portrayed a consistent behavior of acting violently and using active aggression by assaulting
and Sgt. Gonzalez [multiple times].
4) size was significantly greater than Sgt. Gonzalez’. This assessment caused me greater fear of
a more substantial injury to Sgt. Gonzalez.
5) With the considerable consumption of alcohol and marijuana at the event, using my training and
experience, I suspected to be intoxicated [he later advised he had been drinking] which I
assessed posed a further safety risk to Sgt. Gonzalez.
6) was not contained and alone. There were other pedestrians in the vicinity who were potentially
at risk of harm. already assaulted another subject prior to Sgt. Gonzalez.
7) had associates with him in the vicinity who could have posed a potential risk to both Sgt.
Gonzalez and I.
8) portrayed an escalation in degree of violence by combatively seizing Sgt. Gonzalez a second
time and pulling Sgt. Gonzalez towards him. I interpreted this action as an immediate threat to Sgt.
Gonzalez’ safety.
9) Due to the immediate danger to Sgt. Gonzalez, there was no opportunity to use or consider a tactical
repositioning or disengagement.
10) There was no cover, concealment, or shielding between myself, Sgt. Gonzalez, and to use as a
barrier.

OFFICER ACTIONS / USE OF FORCE:

Due to my above noted assessments to the scene, I performed a takedown on to stop the immediate
threat to Sgt. Gonzalez and to de-escalate the scene. Due to the exigent circumstances, I did not give
a verbal warning prior to performing a takedown.

I attempted to perform a double leg take down, however, due to positioning and stance, along with the
factor that I came from a perpendicular angle to , I used a modified double leg take down on to
cease the assault and de-escalate the scene.

Once on the ground, I gave verbal directions to place his hands behind his back. initially
resisted by refusing to comply and kept his hands underneath his body [Active Resistance]. After further
verbal commands to place his hands behind his back complied. I then placed into handcuffs
and sat on his buttocks.

When was TOT the Lenawee Sheriff’s Department his handcuffs where double locked and tension
checked.
