MOCK TRIAL INTRA-MURALS 2022

Mr. Manish J. Shah was a chartered accountant in Mumbai and had developed

a good reputation for himself. He had an office in Golden Heights, Office No. 786, 7th

Floor, Old Dadra Road, Bumbai. Mr. Shah was at his office on the fateful night of

January 28, 2022 along with his intern Mr. Nayan Mhetre. He was waiting for one of

his old clients named Mr. Samir Tavde. Mr. Tavde is a partner in his firm M/s.

Tavde Brothers who conducts business of trading of tobacco and cigarettes.

Mr. Tavde arrived at office of Mr. Shah on January 28, 2022 at around 22:50

hours. He straight away entered the chamber of Mr. Shah and the meeting began. Mr.

Mhetre was observing the meeting from his cubicle. He saw the meeting turn violent

as he could hear both of them shouting loudly at each other. Suddenly, Mr. Tavde

came out of Mr. Shah’s chamber and instructed Mr. Mhetre to give his file to Mr.

Shah and left. After searching the file, Mr. Mhetre went to give the same to Mr. Shah

when he found Mr. Shah missing. He saw the window of Mr. Shah’s chamber was

open. When he peaked outside the window he saw a group of people gathered around

a body. He quickly rushed downstairs and to his surprise found out that body was of

Mr. Shah.

House of Mr. Shah was right opposite to his office across the street. His wife

Mrs. Manisha Shah had a bird’s eye view of his office and she had witnessed previous

meetings between Mr. Shah and his clients. She saw the push of her husband

occurring but she says that pusher did not appear like Mr. Tavde but according to

her Blood was oozing out from his head and there was a bullet wound on the chest of

Mr. Shah. She was aware that Mr. Tavde and Mr. Mhetre were in the office aroundthat

time and hence she registered an FIR against Mr. Mhetre and Mr. Tavde.

Mr. Bahadur Thapa is the security guard of the building. He was startled by the

sound of falling of Mr. Shah’s body and went to see what happened. There he saw

body of Mr. Shah and he immediately rushed to his cabin to cal for an ambulance.

He saw Mr. Tavde and Mr. Mhetre leaving the building in their respective

vehicles.

13. Findings of Lab testing:


Article A-1, A-2, and A-4 are samples of blood with same blood group
i.e O+. The blood group of the deceased is also O+.
Article A-3 is a White shirt with blood spots. The blood on the white
shirt is similar to article A-1, A-2 and A-4. There is a black ring
surrounding the hole in the shirt. Article A-5 is black powder consisting
of lead and barium. Article A-6 is a firearm (Glock 17, 9X19) Pistol
which has two distinct fingerprints of both the accused.

On the night of 28th January 2022, at 11.00 PM, Mrs. Manisha Shah came
to the police station and registered a FIR for the unnatural death of the
deceased, wherein he named both the accused as perpetrator of the
crime of committing murder of the deceased. The police reached at the
place of the incident and collected the evidences. The body of the
deceased was sent for the postmortem. Next day i.e 29 th January 2022, the
police recorded the statements of the witnesses.
The statements of the witnesses allege that the both the accused have
conspired together to commit the offence of murder of the deceased.
The sole eyewitness in the case PW-1 has stated that the deceased was
pushed by two persons form the window of his office. The accused were
arrested on 30th January 2022 and were subsequently produced before
the magistrate’ court. The Hon’ble magistrate was pleased to grant
judicial custody of the accused.

Therefore, the Ld. Public Prosecutor be pleased to frame the following


charges before this Hon’ble Court.

I am Manisha Shah w/o Late Mr. Manish Shah. My husband is a chartered accountant by
profession and he is the owner of the firm named Shah and associates. He always used
to come home early but today he was late due to some work. I called him to inquire as to at
what time he will be coming home. He cited some meeting with client and told me that he
will be late tonight. Around 10.30, I was standing in balcony of my room which is facing
the office of my husband. After some time I saw something unusual going on in the office.
There were two people in the room who were having some heated arguments and exchange
of words. I went inside the house to call and inquire about the happenings in the office, but
no one picked the phone. When I came back to balcony, I saw two people pushing my
husband out from the window. Seeing this, I ran towards the officer, where I saw people
gathered around my husband’s body. Later he succumbed to his injuries.
I was not able to clearly identify the two people but I have prior knowledge that Mr.
Sameer Tavde and MR. Nayan Mhetre was present in the office. There were certain
professional issues with Mr Tavde and Mr. Mhetre was not happy with the pay scale. I
strongly believe that these two people have conspired together to kill my husband.

We the undersigned reside at the address mentioned above. We are called by Mr.

Suryaveer Singh, PSI to prepare this panchnama.

We work in a law firm named PSL and our office is in 3rd Floor, 386, Golden

Heights, Old Dadra Road, Mumbai. We were completing an assignment in our office

and were leaving for home at 2300 hrs, when Mr. Suryaveer Singh called us. We see

a dead body with blood oozing out of his head. On asking we came to know that his

name is Mr. Manish Shah and he is Chartered Accountant having office on the 7

floor of Golden Heights. There is a pool of blood near his head. He is wearing a

black blazer, white shirt, red tie, black trousers, black socks and black shoes. We also

see blood coming out of his chest and we see a hole in his chest. The area near the

wound is red because of blood and we see a black ring around the wound. We see that

the window of office on the 7th floor is open.

Mr. Suryaveer Singh collected sample of blood near the head in a glass bottle. He

affixed a label which read Article A1 to it which was signed by him and counter

signed by us. Mr. Suryaveer Singh collected a sample of blood from his chest. He

affixed a label which read Article A2 to it which was signed by him and counter

signed by us. Mr. Suryaveer Singh removed his shirt and placed it in a plastic bag. He

affixed a label which read Article A3 to it which was signed by him and counter

signed by us.

We went to Office No. 786, Golden Heights. The name plate outside the office

reads MJS Associates. The office opens to a bullpen for associates. On the left of the

bullpen, we see a library for storing files and books. After the bullpen and library we

find the chamber of Mr. Manish Shah. We enter the office, there is a desk with

scattered papers. We find that there is black power on the papers. The window of his

chamber is open and there is a pool of blood near the window. We see a gun under

the table of Mr. Manish Shah.

Mr. Suryaveer Singh collected sample of blood near the window in a glass bottle.

He affixed a label which read Article A4 to it which was signed by him and counter

signed by us. Mr. Suryaveer Singh collected a sample of black powder on the papers.

He affixed a label which read Article A5 to it which was signed by him and counter

signed by us. Mr. Suryaveer Singh collected the gun and placed it is a transparent

plastic bag. He affixed a label which read Article A6 to it which was signed by him

and counter signed by us.

REPORT OF FORENSIC INVESTIGATION
We have received six articles from Inspector Suryaveer Singh for investigation

on February 3, 2022 for investigation of various aspects which are detailed as under:

1. ARTICLE A1, A2 and A4

These article are samples of blood. The blood group is O+ve. All these three

blood samples are of the same person. We are given blood of Mr. Manish Shah.

We can say that blood in all these samples match to the sample of Mr. Manish

Shah. Blood in sample A1 and A4 are mixed with dust and blood in sample A2

is mixed with lead and barium.

2. ARTICLE A3

This article is a white shirt. The blood on the white shirt is similar to Article A1,

A2 and A4. There is a black ring surrounding the hole in the shirt. The black ring

consists of lead and barium.

3. ARTICLE A5

The is article is a black powder consisting of lead and barium.

4. ARTICLE A6

This firearm is a Glock 17 pistol. It is a 9x19 mm pistol. It consists finger prints

of two individuals. These fingerprints are of Mr. Nayan Mhetre and Mr. Samir

Tavde.

4. OBSERVATIONS:

4.1. The body is that of a well-developed, well-nourished man who appears

consistent with the above-stated length, weight, and age. Rigor mortis is

fully developed. Livor mortis is posterior, partially blanches with digital

pressure, and extends to the posterior axillary line. The body is cold from

refrigeration.

4.2. The top of the head and the back of the head have large abrasions. The

vault and base of the skull have multiple fractures, many of which are

displaced. Beginning from the right occipital area in the region of the

external occipital protuberance, fractures radiate into the vault, around the

left side toward the region of the upper ear, and then toward the vertex

and the frontal area, with multiple branches radiating from a principal

fracture line. The base of the skull has a transverse fracture line through

the roofs of the middle ears and the body of the sphenoid bone. Other

fracture lines involve the posterior fossa, leaving the petrous ridges

mobile. Some of these fracture lines intersect with the foramen magnum.

The dura mater at the base of the skull is multiply lacerated. A few fracture

lines involve the middle and anterior fossae. The fractures are all

somewhat displaced. The brain has multiple lacerations as follows: The

midbrain is 3/4 lacerated and is also stretched. The pontomedullary junction

is entirely lacerated. The spinomedullary junction is 90% lacerated. The

arachnoid mater is torn open in the region of the Sylvian fissures and the

optic chiasm. Thin subarachnoid hemorrhages are over the cerebral and

cerebellar hemispheres. No spinal fluid remains. The cerebral ventricles are

lined by thin red liquid. The corpus callosum and the septum pellucidum

are lacerated. The inferior surfaces of the temporal lobes have small

lacerations.

4.3. An entrance gunshot wound is in the left pectoral region of the chest,

medial and superior to the left nipple, 14 ½” inferior to the top of the

head, 50 ½” superior to the sole of the left foot, and 2 ¼” left of the

anterior midline. The wound, including the abrasion collar, is round and

0.8 cm in diameter.

4.4. The wound path sequentially runs through the left third intercostal space

anteriorly, the anterior portion of the upper lobe of the left lung, the

pericardial sac, the heart, the lower lobe of the right lung, and the right 8th

intercostal space posteriorly, to end in the subcutaneous tissue on the right

side of the back. The path through the heart is described in further detail:

The path through the heart begins as a circular perforation on the anterior

aspect of the right ventricular outflow tract, then continues as a perforation

of the base of the heart at the root of the aorta and pulmonary artery, and

then passes through the posterior portion of the atrial septum. It leaves the

heart at the origin of the right inferior pulmonary vein.

4.5. Recovered from the end of the wound path is a moderately deformed,

non-jacketed, small-caliber lead bullet, located on the right side of the back

47” superior to the sole of the right foot, and 4 ½” right of the posterior

midline. The bullet is left uninscribed, and is photographed on a labeled

evidence envelope before being sealed in the envelope.

4.6. Associated findings comprise extravasation of blood into tissue along the

wound pathway, a measured 400 milliliters of blood in the right pleural

cavity, a measured 100 milliliters of blood in the pericardial sac, and a

measured 1 liter of blood in the left pleural cavity. The hem thoraces are

associated with partial collapse of both lungs.

4.7. The direction of the wound path, with respect to the standard anatomic

position, is left to right, front to back, and downward.

4.8. The penis is uncircumcised and free of injuries. The testes are descended.

The anus has no injuries.

5. OPINION

As per my opinion cause of death is Haemopneumothorax due to the gun shot

to chest and hemorrhage due to blunt force trauma to head.

STATEMENTS OF WITNESSES

PW-1 Manisha Shah

I am Manisha Shah, aged 43 years. I have been married to Mr. Manish J. Shah

for the last 18 years. We have two children, born out of wedlock. I have been a

house-wife and often indulge into social activities as well. As a woman, I feel that our

society has often oppressed women in some or the other way and hence I’m of the

strong opinion that the perception of the society towards women needs to be

changed. This change can only be brought by the women themselves by asking for

their rights.

I know Mr. Samir Tavde as a client and he used to be a friend of my deceased

husband. I met Mr Tavde in one of the social events related to empowerment of

women. Thereafter, the business relation between my husband and Mr Tavde started

developing. He became one of the permanent clients of my husband’s Charted

Accountant firm.

On the fateful day my husband was late from the office and I called him around

10 to enquire about his return. He told me that he was waiting for Mr. Tavde and

would be late. He also informed me that Mr. Mhetre was also present in the office

for assisting him in the meeting.

I was in my room’s balcony around 10.30 and was looking at my husband’s

office as the same is just opposite our apartment. I could see that some meeting was

going on between my husband and two other persons. I couldn’t clearly see the face

of the other two persons. I could gather that the meeting was turning into a heated

argument and I went inside to call Mr. Mhetre to ask him about the meeting, but he

didn’t answer my phone.

When I returned to the balcony to see my husband’s cabin, I saw the person

pushing my husband’s body from the window. I ran downstairs and directly to my

husband’s office. When I reached there, some people had already gathered there

along with the watchman. After that I rushed to the police station.

I believe that Mr Tavde and Mr. Mhetre conspired to kill my husband. I never

imagined that they would kill my husband over a trivial issue. I want justice for my

husband and I will fight for it till my last breath.

PW-2 Bahadur Thappa

I am Bahadur Thappa, aged 45 years, and have been working as a watchman in

Golden Heights for the past 5 years. I came to Mumbai from Nepal in the year 1999

in search of a job. My working hours are from 12 noon to 12 midnight.

Mr. Shah’s office is in the same building. He was a noble spirited man and was

always ready to help others. Mr. Mhetre had been working with him for the past 2 and

a half years. In the beginning, he used to have a good behaviour, but from last couple

of months there was a sudden change in his behaviour. And when I enquired about

the same, he said there was some financial crises going in his family. He had

requested Mr. Shah to increase his pay scale which Mr. Shah had refused, and he was

not happy with this.

Mr. Tavde used to continuously visit Mr. Shah’s office, and his visits became

more frequent in last couple of weeks. On the day of incident I saw Mr. Tavde

entering the building in his car.

Around 10.30, while I was sitting in my cabin, I heard a sound of something

falling on the ground. When I came out, I saw people gathered around a body. I rushed

to the spot and saw that it was Mr. Shah’s body. I was taken aback and somehow

gathered my senses and I rushed to my cabin to call an ambulance. When I was

coming back, I saw two vehicles leaving the building and the persons driving them

resembled Mr. Tavde and Mr. Mhetre. I didn’t pay much attention as the vehicle

was speeding away.

When the ambulance came, the body was taken to the hospital and next day

I came to know that Mr. Shah was declared dead. May his soul rest in peace and may

God punish his murderers.

DW-1 Mr. Siddhart Tavde

I am brother of Mr. Sameer Tavde and a partner in M/S Tavde Brothers.

Both of us come from a humble background and understand the importance of

money in life. We set up our business without anyone’s help and have always trusted

each other. We are one for both and both for one.

We had business relation with Mr Shah’s firm as we were using his accountant

services for our business. He was the epitome of professionalism and we were always

impressed with his work.

On the day of the incident, I called my brother to enquire about the pending

work on an urgent basis. He went to Mr. Shah’s office, and around 9.30, he called me

and said that the required work was done. He came back home around 10.30pm,

and thereafter we had our daily dose of whiskey together and then went to sleep.

We are equally shocked by the sudden demise of Mr. Shah, and have no clue

why my brother is being framed in this murder. I believe that there is a bigger picture

involved in this crime, which the police are missing out. My brother is being used for

someone else’s ulterior motives and hence has been falsely implicated in this crime.

DW-2 Sameer Tavde

I am Sameer Tavde; Partner in M/S Tavde Brothers. I along with my brother

have worked hard to establish our business. I have always believed in the philosophy

of being a self-made man and have thrived to achieve the goals of my life.

I had good business relations with Mr. Shah as his firm was handling our

asking to visit Mr Shah’s office for some urgent work. I went to his office around

9.15 pm and found that he was already in a meeting with somebody else. Since I was

in a hurry, I went inside his cabin and requested him to hand over the required file.

He smiled and gave me the file. I came out of his office around 9.30 pm and called

my brother about the completion of work. I reached home around 10.30 pm, had

my daily dose of whiskey with my brother and went to sleep.

I’m shocked to know about the death of Mr Shah and god knows why I’m

being made an accused in the whole murder. I strongly believe that there is a total y

different angle to this crime which the police is ignoring totally and is instead, making

me the accused.

DW-3 Mr Nayan Mhetre

I am Nayan Mhetre, aged 25 years. I am pursuing CA as a profession. I have

been working with Mr Shah’s firm as an intern for last 2.5 years. My normal office

timings are 10 to 7. Mr Shah was a good human being and a fine professional. I

always looked up to him as my role model. I have been considered an integral and

important part of the firm.

On that fateful day, I was there at a house party. Since I got late, my phone

battery drained and it got switched off. I was heavily drunk at midnight so I left my

friend’s place in the morning as you know the bachelor parties are too chill. Next

day after waking up, I received a call from one of the colleagues informing me about

the death of Mr Shah and how I was being made an accused to it.

I have no idea why I was being made an accused as even in my dreams, I could

have never imagine the death of my role model. Mr Shah’s death has rendered me

helpless. I have lost the companionship of a noble being. Such a loss will never be

compensated and on top of it, I have been accused of the death of my role model which

further exemplifies my mental agony.
