CONTRACT AGREEMENT FOR THE

XXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXXX

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT executed and entered this 27th day of April 2019 in the City of Santa Rosa,
XXXXXXXXXXX

Laguna by and between:


“CLIENT”

XXXXXXXXXXXXXXXXX, Filipino, with address at XXXXXXXXXXXXXXXXXXX herein


referred to as “CLIENT”;
- and -

EYARTI CONSTRUCTION SERVICES, duly organized and existing under and by virtue of the
laws of the Philippines, with address at #7 St. Thomas St., San Jose Village, Alabang
Muntinlupa City herein represented by its Owner, Engr. Art Jester C. Ramos, hereinafter
referred to as the “CONTRACTOR”.

W I T N E S S E T H:

WHEREAS, the CLIENT engaged the services and resources of the CONTRACTOR to do the
XXXXXXXXXXXX herein referred to as “PROJECT”, and the CONTRACTOR has agreed to
undertake the same.

NOW THEREFORE, for and in consideration of the foregoing premises and the mutual
covenants, stipulations and agreements herein and said AGREEMENT, and the payment by
the CLIENT of a sum of money in the manner hereinafter specified, the CLIENT and the
CONTRACTOR have agreed, as they do hereby agree, and contract as follows:

1. The amount of xxxxxxxxxxxx, shall be the cost for the PROJECT. The CLIENT does
“CONTRACTOR”

hereby agree to the amount and the scope of work and hereby awarded to the
Owner

CONTRACTOR;

2. An amount of equivalent to Php xxxxxxxx of the total contract price shall be given to the
CONTRACTOR upon the execution hereof and by way of mobilization fund. The remaining
XXXXXXXXXXXXXXXXXXX of the total contract price should be paid by the CLIENT to the
CONTRACTOR through accomplishment billings. CLIENT will be given five working days to
pay the progress billing. Work stoppage can be made by the CONTRACTOR if no payment
has been made by the CLIENT.

3. The CONTRACTOR has agreed that the construction of the project will be completed
within ONE HUNDRED EIGHTY (180) working days excluding Saturday, Sundays and
Holidays upon the release of the building permit. The CONTRACTOR will commence the
application of permits once the CONTRACT has been signed together with the release of the
down payment.

4. The CONTRACTOR shall be responsible in purchasing materials, recruiting personnel,


coordinating with the architect and CLIENT with regards to design details and approval of
materials and perform all the works required;

5. The CONTRACT price only includes the following:

i. Signed and sealed architectural, structural, electrical, and plumbing plans


ii. House construction

6. The following items are not included in the CONTRACT:

i. Cost for construction bond and building permits


ii. Post-construction and/or move-in requirements (occupancy permit, etc.)

7. It is hereby expressly agreed and understood that the employees of the CONTRACTOR
are not employees of the CLIENT, and hence, the CLIENT shall not in any way be liable
and/or responsible for any personal injury including disability or death, or damage to
property sustained by or caused by any of the employees of the CONTRACTOR and/or
his sub-contractors, agents, whether or not occurring the performances of their duties. The
CONTRACTOR shall indemnity the CLIENT for any and all injuries or damages the latter
may suffer or incur due to the act, omission, fault, negligence or conduct of the
CONTRACTOR and/or its employees, sub-contractor, agents arising out of in connection
with or when the performance of this CONTRACT. The CONTRACTOR shall always,
stand solely liable and/or responsible for the enforcement and compliance with all existing
laws, rules and regulations that binds itself to save and hold the CLIENT free and
harmless from any and all liability in respect thereof and/or there from and/or by reason of
this CONTRACT and/or is implementation.

8. All materials & workmanship is guaranteed for a period of Three (3) months upon turn-
over. Consumables such as electrical and plumbing fixtures are not included in the warranty.

9. In the event additional or revised work not shown in the contract documents and
therefore is to be required by the CLIENT, such work shall be requested and authorized by the
CLIENT only through written change orders. All change orders, including deletions/omissions
shall state the agreed cost of the additional, revised, deleted/omitted work, resulting an
adjustment of the contract price, as mutually agreed upon by the CLIENT and CONTRACTOR
together with any corresponding time extension the additional or revised work would entail.

All additional cost shall be based on prevailing market price at the time the request is made
together with labor cost plus fifteen percent (15%) to cover profit and overhead. No change
orders shall be started without a written approval of the agreed cost.

IN WITNESS WHEREOF, the parties have hereunto signed this CONTRACT on the date and
place herein above written.
