INFORMATION

The undersigned accuses, ENRIQUE MONTEMAYOR and CATHERINE

RAMOS, of Concubinage committed as follows:

That on November 12, 2020, a sex scandal video of his husband

and Catherine Ramos was sent to the complainant in which the

complainant confronted both defendants in which they denied. That on

January 20, 2021, while complainant was using her laptop, her husband

unknowingly left his messenger logged in on complainant’s laptop, and

received a message from Catherine Ramos saying that she is pregnant

and likewise sent a picture of a pregnancy test. The complainant again

confronted both of defendants and again denied such allegation. On

March 1, 2021, the complainant again received a sex scandal video of Mr.

Montemayor and Ms. Ramos from an unknown facebook friend, in which

after the complainant confronted her husband he again strongly denied.

On July 15, 2021, Ms. Ramos sent a letter to the complainants house

demanding Mr. Montemayor for money and support of their child and on

May 2, 2022, Ms. Ramos sent a letter to complainants house addressed

to Mr. Montemayor, a copy of the birth certificate of the child as well as a

DNA test to prove that Mr. Montemayor was the father.

CERTIFICATE OF PRELIMINARY INVESTIGATION

I hereby certify that a preliminary investigation in this case

was conducted by me in accordance with law; that I examined

the Complainant and her witnesses; that there is reasonable ground

to believe that the offense charged had been committed and that

the accused is probably guilty thereof; that the accused was informed of

the Complaint and of the evidence submitted against him and was given

the opportunity to submit controverting evidence; and that the filing of

this Information is with the prior authority and approval of the

City

JUDICIAL AFFIDAVIT

“I, ELIZA MONTEMAYOR, of legal age, Filipino, married, and a resident of

Iloilo City, after having been duly sworn according to law, hereby depose
and say:

PRELIMINARY STATEMENT

The person examining me is Assistant Prosecutor Amara Gayle

B. Yulo, with address at 2nd Floor, Iloilo City Hall. The examination is
being held at the said address. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for false
testimony and perjury.

Q1: Why are here in the office of Prosecutor Yulo?

A1: I am here to give my statement.

Q2: What is your statement in relation to?

A2: It is in relation to Criminal Case No. 59-0092 in which I am the
private offended party.

Q3: What is your relationship with the accused?

A3: Mr. Montemayor is my husband and Ms.
Ramos is my bestfriend.

Q4: On what date did the crime happen?

A4: It happened on or about August of 2020 until now.

Q5: How did you have come to know such information that
they are committing the crime of concubinage?
A5: On November of 2020, someone from facebook sent me a sex video
scandal involving my husband and my besfriend..

Q6: What is your reaction when you saw the

video?
A6: I was shocked, angry, and confused. I did not believe at first that is
why I confronted them both first.

Q7: Do you have any reason to believe that it was them in the video?
A7: Yes. I know my husband very well and he was wearing the same
shirt I gave him. And both of their faces was clearly shown in the video.

Q8: Can you tell me what happened that lead you

to strongly believe that they have committed
such crime?
A8: When I was using my laptop, a message from Catherine poped-up
since my husband left his messenger logged-in. Catherine sent him a
message saying she was pregnant and even sent a pregnancy test.

Q9: Can you tell me what happened next ?

A10: Yes. Several month after, another sex scandal of them was again
sent to me and finally Catherine sent a letter to our house demanding
support from my husband for their child. She even included a birth
certificate and a DNA test in the envelope.

ATTESTATION

I, STEPHANIE ERICA LOUISE RICMONTE., of legal age, Filipino,

single and a resident of Jaro, Iloilo City, after having been duly sworn
according to law, hereby depose and say:

1. That I faithfully recorded the questions I asked Mrs. Montemayor

and the corresponding answers she gave me;

2. That neither I nor any other person then present coached Mrs.
Montemayor regarding her answers.
