Committees to the Producer/Importer/Brand owners under the clause 9 (Extended
Producers Responsibility (EPR)) of the Plastic Waste Management Rules, 2016.

1. The Ministry of Environment, Forest and Climate Change has Notified Plastic Waste
Management Rules, 2016 vide notification dated 18th March, 2016.

2. Ministry has received a number of suggestions/comments regarding the Rules and also
requests for clarifying a number of issues related to the Rules. The Ministry has constituted a
committee to deliberate on the issues raised by stakeholders relating to the plastic waste
Management Rules, 2016 and solid Waste Management Rules, 2016.

3. It has come to the notice of the Ministry that several State Pollution Control Boards/Pollution
Control Committees have issued notices to the “Producers” for not submitting modalities for
waste collection system based on EPR, Action Plan for setting up plastic waste management
system, obtaining authorization/registration etc.

4. Since the committee constituted by the Ministry has yet to finalize its reports and submit to
the Ministry, SPCBs/PCCs are advised not to initiate further action against ‘producers’ pursuant
to the notice issued by them until further orders of the Ministry.

This issue with the approval of the Competent Authority.

Sub:-Notice to prevent and control noise pollution emanating from automobile silencer,
audio music system, pressure horn use of loudspeaker, bursting of crackers etc.

In pursuance to the order of the Hon’ble National Green Tribunal, Eastern Zone Bench, Kolkatta
O.A. No.158/2016/EZ dtd 03rd October, 2017 it is hereby publicised that all concerns and drivers
in particular are requested to aware on the health hazards caused by noise pollution.

(1) Noise is unwanted sound and causes annoyance and displeasure.


(2) Noise is a nuisance that is detrimental to the overall physical and mental health and
wellbeing of a person.
(3) Noise disturbs the peace and tranquility of a place or locality.
(4) Noise causes disturbance especially in and around hospitals, educational institution and
courts.
(5) Noise during the night time, especially from 10 p.m. to 6 a.m., disturbs rest and sleep.
(6) Noise interferes with communication and work performance.
(7) Noise causes stress and has adverse effects on the cardiovascular system of the bpdy.
(8) Noise causes temporary loss of hearing and under long duration of exposure, even
permanent loss of hearing.
(9) Noise from pressure horns has severe impact on human health not only physically but
psychologically as well.
(10) The frequent exposure to pressure horns can hearing disabilities or permanent damage to
tympanic membrane (ear drum).
(11) Pressure horns responsible for stress, anxiety, high blood pressure and hypertension. It is a
source of irritation and restlessness especially for senior citizens and patients.
(12) The different mode of transportation such as motor- cars, buses etc. produces sound which
disturbs the human health.

As a concerned citizen, one needs to have the responsibility to prevent and control noise pollution
emanating from automobile silencer, audio music system, pressure horn use of loudspeaker,
bursting of crackers etc.

Sub:-Draft New Drugs and Clinical trials Rules, 2018.

Ministry of Health and Family Welfare has published draft New Drugs and Clinical trials draft Rules,
2018 via notification no. G.S.R. 104(E) on 01st February, 2018.

These draft rules apply to all new drugs, investigational new drugs for human use, clinical trial,
bioequivalence study, bioavailability study and Ethics Committee.

These draft rules are published for information of all persons likely to be affected thereby and
notice is hereby given that the said draft rules shall be taken into consideration on or after the
expiry of a period of forty-five days from the date on which copies of the Gazette of India
containing these draft rules are made available to the public.

Objections and suggestions which may be received from any person within the period specified
above will be considered by the Central Government.

Objections and suggestions, if any, may be addressed to the Under Secretary (Drugs), Ministry of

Sub:-The Draft Food Safety and Standards (Prohibition and Restrictions on Sales)
Amendment Regulations, 2018.

The following draft of certain regulations, further to amend the Food Safety and Standards
(Prohibition and Restrictions on Sales ) Regulations, 2011, which the Food Safety and Standards
Authority of India proposes to make with the previous approval of the Central Government, in
exercise of the powers conferred by section 92 of the Food Safety and Standards Act, 2006 (34 of
2006), is hereby published as required by sub-section (1) thereof, for the information of all
persons likely to be affected thereby; and notice is hereby given that the said draft regulations
shall be taken into consideration after the expiry of a period of thirty days from the date on which
copies of the Official Gazette in which this notification is published are made available to the
public.

Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety
and Standards Authority of India, FDA Bhawan, Kotla Road, New Delhi-110002 or sent on email at
regulation@fssai.gov.in.

Objections or suggestions, which may be received from any person with respect to the said draft
regulations before the expiry of the period so specified, shall be considered by the Food Authority.

Draft Regulations

1. Short title and Commencement.-


(1) These regulations may be called the Food Safety and Standards (Prohibition and
Restrictions on Sales) Amendment Regulations, 2018.
(2) They shall come into force on the date of their final publication in the Official Gazette.

2. In the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011,-
(a) in regulation 2.1, in sub-regulation 2.1.1, the third and fourth provisos shall be omitted;
(b) in regulation 2.3, in sub-regulation 2.3.15, for the clause (3), the following clause shall be
substituted, namely-
(3) Vanaspati, interesterified vegetable oil or fat, bakery shortening, bakery and industrial
Margarine, table Margarine and fat spreads shall be prepared from any of the edible
vegetable oils whose standards are specified in sub-regulation 2.2 of the Food Safety
and Standards (Food Products Standards and Food Additives) Regulations, 2011 or
from any other edible vegetable oil with prior approval of the Food Authority.

Sub:-Renewal of license/registration certificate due to FLRS system failure.

1. This is in continuation to this Office letter No 15(6)2017/FLRS/RCD/FSSAI dated 05.02.2018


wherein it was communicated that FSSAI will provide a temporary window to such FBOs whose
license/Registration expired during the period of 15th Dec, 2017 to 15th Feb, 2018.

2. In view of the above, it is decided that an extended window on Food Licensing and Registration
system (FLRS) will be provided to all such FBOS till 31st March, 2018 without charging any
penalty, Further, in case, if any FBO fails to submit their renewal for License/Registration
within the extended time period i.e. till 31st March, 2018 such FBOs shall not be able to apply
for renewal and will have to submit a fresh application.

The Central Drugs Standard Control Organization (CDSCO) in pursuance to implementation of E-


Governance has launched an online portal ‘SUGAM’ (www.cdscoonline.gov.in) on 14.11.2015.

A reference is also invited to the stakeholders meeting held on 10.01.2018 wherein it has been
agreed upon that, filling of application for Clinical Trial, Marketing Authorization, Registration
Certificate and Import License for r-DNA Derived Drugs will be initiated with effect from
01.02.2018 in SUGAM portal.

In view of above, it has been decided that applications pertaining to Clinical Trial, Marketing
Authorization, Registration Certificate and Import License for r-DNA Derived Drugs shall be
accepted only through online mode from 01stFeb, 2018 and no offline applications will be accepted
thereafter.

Sub:-The Central Motor Vehicles (First Amendment) Rules, 2018 regarding new motor
vehicles conforming to Emission Standard Bharat Stage-IV.

Whereas, the draft of certain rules further to amend the Central Motor Vehicles Rules, 1989 were
published, as required by sub-section (1) of section 212 of the Motor Vehicles Act, 1988 (59 of
1988), vide notification of the Government of India in the Ministry of Road Transport and
Highways number G.S.R.1432(E), dated the 20thNovember, 2017, in the Gazette of India,
Extraordinary, Part II, Section (3), Sub-section (i), inviting objections and suggestions from all
persons likely to be affected thereby before the expiry of the period of thirty days from the date
on which copies of the official Gazette containing the draft rules were made available to the
public;

And whereas, copies of the said Gazette notification were made available to the public on the
20thNovember, 2017;

And whereas, the objections and suggestions received from the public in respect of the said draft
rules have been duly considered by the Central Government;

Now, therefore, in exercise of the powers conferred by section 110 of the Motor Vehicles Act, 1988
(59 of 1988), the Central Government hereby makes the following rules further to amend the
Central Motor Vehicles Rules, 1989, namely:-

(1) These rules may be called the Central Motor Vehicles (First Amendment) Rules, 2018.
(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Motor Vehicle Rules, 1989, in rule 115, after sub-rule (20), the following sub-
rule shall be inserted, namely:-

(21) New motor vehicles conforming to Emission Standard Bharat Stage-IV, manufactured
before the 01stApril, 2020 shall not be registered after the 30thJune, 2020:

Provided that the new motor vehicles of categories M and N conforming to Emission Standard
Bharat Stage-IV, manufactured before the 1stApril, 2020 and sold in the form of drive away
chassis, shall not be registered after the 30th September, 2020.

Sub:-The Rajasthan Rationalisation of Forms and Reports under Certain Labour Laws
Rules, 2017.

Whereas, a draft of certain rules to amend the Rationalisation of Forms and Reports under Certain
Labour Laws Rules, 2017 was published vide notification of the Government of India in the
Ministry of Labour and Employment number G.S.R. 1333(E), dated the 27th October, 2017, in the
Gazette of India, Extraordinary, Part II, section 3, sub-section (i), inviting objections and
suggestions from all persons likely to be affected thereby on or before the expiry of a period of
thirty days from the date on which the copies of the Official Gazette containing the said
notification were made available to the public;

And whereas, the copies of the said Official Gazette were made available to the public on the 27th
October, 2017;

And whereas, no objections and suggestions were received from public on the said draft rules;

Now, therefore, in exercise of the powers conferred by,-


(a) section 35 of the Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970);
(b) section 35 of the Inter-State Migrant Workmen (Regulation of Employment and Conditions of
Service) Act, 1979 (30 of 1979); and
(c) section 62 of the Building and Other Construction Workers (Regulation of Employment and
Conditions of Service) Act, 1996 (27 of 1996), after consultation with the expert committee,
read with Chapter III of the Information Technology Act, 2000 (21 of 2000), the Central
Government hereby makes the following rules, namely:-
1.
(1) These rules may be called the Rationalisation of Forms and Reports under Certain
Labour Laws (Amendment) Rules, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Rationalisation of Forms and Reports under Certain Labour Laws Rules, 2017,-
(a) in rule 2, in sub-rule (1), the following proviso shall be inserted, namely:-
Provided that the Central Government may, by order, require that such Forms specified
in the Schedule annexed to these rules and specified in that order shall be filed online
on the Shram Suvidha Portal of the Ministry of Labour and Employment for the
purposes of the aforesaid enactments and the rules made thereunder.
(b) In the Schedule after Form XII, the Forms inserted.

Sub:-Amendments to the notification no. S.O. 1248(E) dated the 5th November, 2004.

In exercise of the powers conferred by sub-section (4) of Section 41 of the Motor Vehicles Act,
1988 (59 of 1988), the Central Government hereby makes the following amendments to the
notification of the Government of India, the erstwhile Ministry of Shipping, Road Transport and
highways, Department of Road Transport and Highways number S.O. 1248(E) dated the 5th
November, 2004, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section
(ii), namely:-

In the said notification, in the Table, under the heading ‘non-Transport Vehicle’, after item (xiv),
the following items shall be inserted, namely:-

(xv) Motor cycle (L1 and L2 category motor vehicles) with luggage box.

Sub:-An Advisory Committee for a period of three is constituted by the Central


Government under section 9 of the Dock Workers (Safety, Health and Welfare)
Act, 1986.

In exercise of the powers conferred by section 9 of the Dock Workers (Safety, Health and Welfare)
Act, 1986 (54 of 1986) read with rule 9 of the Dock Workers (Safety, Health and Welfare) Rules,
1990, the Central Government hereby constitute an Advisory Committee and appoint the following
persons as Chairman and members for a period of three years from the date of publication of the
notification in the Official Gazette, an, namely:-

1. The Chief Inspector of Dock Safety, Directorate General Factory Advice Chairman
Service and Labour Institutes, Mumbai.
2. The Director/Deputy Secretary, Member
(In charge of Industrial Safety and Health Division), Ministry of Labour

issue certificate on Labour Department Portal.

Kindly refer to your Memo No. HEPC/2017/1215 dated 23.10.2017 and Memo No. HEPC/2017/
2146 dated 29.12.2017 on the subject notes above.

It is hereby intimated that Labour Department, Haryana has enabled the Nodal Officers posted/
deputed in Haryana Enterprise Promotion Centre (HEPC) at EEC (Empowered Executive
Committee) or DLCC (District Level Clearance Committee) level to exercise the powers for issuing
the final certificate to below mentioned online applications on Labour Department web portal
www.hrylabour.gov.in.

1. The registration and License/renewal/amendment under the Factories Act, 1948.


2. The approval of Factory Building Plan under the Factories Act, 1948.
3. The registration of establishment engaged in building and other construction activities under
the Building and Other Construction Workers (RE & CS) Act, 1996.
4. The registration of principal employer under the Contract Labour (Regulation and Abolition)
Act, 1970.
5. The licensing along with its renewal/amendment of contractor under the Contract Labour
(Regulation and Abolition) Act, 1970.
6. The registration under the Inter State Migrant Workers (RE & CS) Act, 1979. It is further
intimated that besides enabling the Nodal Officers for issuance of final certificate they shall be
assisted by the existing infrastructure and resources of the Labour Department in terms of
backend processing and recommendations.
