Sub:-Office Order to delegate powers to Environmental Engineer of Regional Offices to


grant/refuse ‘Consent to Establish’ (NOC)/Consent to Operate’ and to issue/sign
notice for installation of towers as well as D.G. set at the site of tower.

The Mobile Service Operators/Companies are giving Mobile/Cell Phone Service to the public in the
State of Punjab for which these companies have to install the towers. The D.G. sets are also being
installed by the Companies at the site of towers. Before installing the tower in any area in the
State of Punjab, the company/project proponent is required to obtain ‘Consent to Establish’ (NOC)
/’Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974, and Air
(Prevention & Control of Pollution) Act, 1981.

The Board vide its Office Order No. SEE(HQ-1)/2013/407 dated 10.10.2013 amended vide Office
Order No. Estt/SA-1/FNO.182-4/2013/1067 dated 23.12.2013, had delegated powers to grant/
refuse ‘consent to establish’ (NOC) ‘consent to operate’ etc. to the Environmental Engineer (HQ-
II), Patiala.

Now, the Competent Authority of the Board has decided to delegate powers to grant/refuse
‘Consent to Establish’ (NOC)/‘Consent to Operate’ and to issue/sign notice to these companies for
installation of towers as well as D.G. set (at the site of tower) to the Environmental Engineer of
the Regional Offices of Punjab Pollution Control Board in their respective jurisdiction.

As such, powers, are, hereby delegated to the Environmental Engineer of Regional Offices of
Punjab Pollution Control Board to grant/refuse ‘Consent to Establish’ (NOC)/‘Consent to Operate’
and to issue/sign notice to these companies for installation of towers as well as D.G. set (at the
site of tower) in their respective jurisdiction.

This Order will supersede the earlier Office Order No. SEE (HQ-1)/2013/407 dated 10.10.2013
(conveyed vide Endst.No.44997-45035 dated 10.10.2013) and amendment issued vide Endst.No.
Estt/SA-1/FN.182-4/2013/1067 dated 23.12.2013 (conveyed vide Endst.No.Estt/SA-1/2013
/54790 - 835 dated 23.12.2013).

This order will come into force with immediate effect.

Sub:-Exemption of Green Category of industries from Inspection

The Board vide references cited above, issued executive instruction exempting Green Industries
with a history of satisfactory compliance from environmental compliance inspection. The
clarification with regard to physical inspection to be carried out by the Pollution Control Board,
Assam as and when necessary is issued as per following:

inspected only in case of Public complaints,
Legal Cases and other mandatory
requirements

The words ‘other mandatory requirement’ may be clarified as follows:


(i) Requirement as per Supreme Court order pertaining to installation of Primary ETP irrespective
of category of industry and similar orders issued by judiciary including NGT time to time.
(ii) Compliance of standards (ETP/Emission) especially in case of Amendments by CPCB/MoEF &
CC time to time.
(iii) If the industry falls in the vicinity of notified area like Eco-Sensitive Zone/Wetland area under
the purview of Wetland Rules and No Development Zone.

This will come into force with immediate effect and all the Board officials shall follow the above
instructions seriously.

The following draft rules further to amend the Environment (Protection) Rules, 1986 which the
Central Government proposes to issue in exercise of the powers conferred by sections 6 and 25 of
the Environment (Protection) Act, 1986 (29 of 1986), is hereby published, as required under sub-
rule (3) of rule 5 of the Environment (Protection) Rules, 1986, for the information of the public
likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken
into consideration on or after the expiry of a period of sixty days from the date on which copies of
the Gazette of India containing this notification are made available to the public.

Any person interested in making any objections or suggestions with respect to the said draft rules
may forward the same in writing, for consideration of the Central Government within the period
specified above to the Secretary, Ministry of Environment, Forest and Climate Change, Indira
Paryavaran Bhawan, Jor Bagh Road, New Delhi-110003, or send it to Member Secretary, Central

Draft Rules
1. Short title and commencement.-
(1) These rules may be called the Environment (Protection) Amendment Rules, 2018.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Environment (Protection) Rules, 1986 (thereinafter referred to as the said rules), in
Schedule,

milligram per litre, however, in case where TDS in intake water is
above 1100 milligram per litre, a maximum contribution up to

(c) For new plants built after 31st December, 1998, a minimum of
80% of total emission shall pass through stacks and if the
calculated stack height is less than 30 metres, a minimum height
of 30 metres shall be provided, and in case there are more than
one stack existing in the plant, following conditions may be met:-
(i) the required height of all stacks shall be based on the
maximum emission rate in any of the stacks i.e. the stacks
emitting CS2 emission shall be of same heights (based on the
maximum emission rate);
(ii) Number of stacks shall not be increased as existing on
31stDecember, 1998; however, the number of stacks may be

reduced by the industry.
(iii) the distance between two nearest stacks should be at least
three times of height of taller stack, in metres and if distance
between two stacks is less, emission being emitted through
such two stacks shall be considered as a single point source
and height of the stacks shall be calculated considering
emissions are being emitted through one stack;
(iv)the industry shall install three air quality monitoring stations
on the periphery (within boundary limits) of plant so as to
monitor concentration of CS2 and H2S in ambient air and the
location of these stations shall be decided in consultation with
concerned State Pollution Control Board; in any case levels of
CS2 and H2S (24 hours daily average) shall not exceed 100
ug/m3 and 150ug/m3 respectively

(ii) Serial numbers 60, 62 and 87 and the entries relating thereto shall be omitted.
3. In Schedule VI to the said rules,-
(i) in Part B “Wastewater Generation Standards”, for serial number 6 and the entries relating
thereto, the following serial number and entries shall be substituted, namely:-

The Central Government hereby makes the following rules further to amend the Environment
(Protection) Rules, 1986, namely:-

D- Storm-Water
(i) Storm water for a plant, a unit (having plot size at least 250 square
metres) shall not be allowed to mix with scrubber water, effluent
and/or floor washings.
(ii) Storm water within the battery limits of a unit shall be channelized
through separate drain/pipe passing through a High Density Poly
ethylene (HDPE) lines pit having holding capacity of 10 minutes
(hourly average) of rainfall.
E- Guidelines for Solvent Losses
The total losses of solvent should not be more than 3% of the solvent
consumed.
*The units shall meet the prescribed limits of heavy metals in treated
effluent, however, in cases where heavy metal concentration in intake
water is more than prescribed limits, State Pollution Control Boards or
Pollution Control Committees may specify higher limits of heavy metals
provided the maximum limits are restricted to the background limits of
intake water.
**In case As is geogenic in ground water, the State Pollution Control
Boards/Pollution Control Committees may relax the limit with respect to it
appropriately, provided the built of As in waste water does not exceed 0.2
mg/l over and above the As in raw water and limit with respect to total
heavy metals is maintained.

scales & having investment up to Rs. 5.0 Crores is delegated to Regional Office of the Rajasthan
State Pollution Control Board, for the units following under their territorial jurisdiction.

The order will become effective from date of issue of this letter.

This bears approval of the competent authority.

In compliance to the Notification No GSR 45(E) dated 19.1.2018 issued by the Ministry of
Environment, Forest and Climate Change, Government of India relating to sale and use of pet
coke in NCR states, the lime kiln industries in the state, names of which have been included in the
above mentioned notification are permitted to use pet coke as a fuel in accordance with the
provisions of the said notification.

coke in NCR States, the cement plants in the state are permitted to use pet coke as a fuel in
accordance with the provisions of the said notification.

Sub:-Notice to health care facilities to apply for grant of authorization for handing the
Bio-Medical Waste generated by them under Bio-Medical Waste Management Rules,
2016.

In accordance to the Bio-Medical Waste Management Rules, 2016, it is to hereby direct all the
Health Care Facilities including Hospitals, Nursing Homes, Clinics, Dispensaries, Veterinary
Institutions, Pathological Laboratories, Blood banks and all such institutions generating Bio-
Medical Waste to apply for grant of authorization immediately which have not yet obtained
authorization for handing the Bio-Medical Waste generated by them.

Further all occupiers of Health Care Facilities are hereby directed to take all necessary steps to
ensure that Bio-Medical Waste is handled without any adverse effect to human health and the
environment.

Further strict legal action under the purview of the environmental laws in force shall be initiated
against Health Care Facilities which are found to be operating without obtaining authorization
leading non compliance to the Bio-Medical Waste Management Rules, 2016.

1. “सौर ऊर्ाा नीतत-2017” के अंतर्ात ग्रिड संयोजर्त सौर िािर िररयोर्नाओं की स्थािना के िूिा बोडा से र्ल (प्रदष
ू ण
तनिारण तथा तनयंत्रण) अग्रधतनयम 1974 यथासंशोग्रधत की धारा 25/26 एिं िायु (प्रदष
ू ण तनिारण तथा तनयंत्रण)
अग्रधतनयम 1981 यथासंशोग्रधत की धारा 21 के प्रविधानों के अंतर्ात ऑनलाइन अनािजत्त प्रमाण ित्र (स्थािनाथा
सहमतत) माना र्ाएर्ा एिं उक्त के अततररक्त प्रथक से उoप्रo प्रदष
ू ण तनयंत्रण बोडा स्तर से तनर्ात अनािजत्त प्रमाण
के आिश्यकता नहीं होर्ी।

Sub:-Direction under Section 16(5) of Food Safety and Standards Act, 2006 regarding
permission for use of stickers/stamping of fortification logo on the labels.

1. Reference is drawn to the direction issued vide Order No. F. No.GRP/EOF/Fortification/01/


FSSAI-2016 dated 14.11.2017 regarding scaling up edible oil fortification.

2. Representations have been received for permitting use of fortification logo with
stickers/stamping on the existing labels. After considering the same, it has been decided to
permit the use of fortification logo with stickers/stamping on the existing labels for edible
vegetable oil fortified with vitamin A or vitamin D, till 30.06.2018, subject to the fulfillment of
all other provision of the Food Safety and standards (Fortification of Foods) Regulations, 2017.

3. This issues with the approval of the Competent Authority in exercise of the power vested under
section 16(5) of the Food Safety and Standards Act, 2006.

(ii) The committee shall meet at least once in a month.

Sub:-Draft Petroleum and Natural Gas Regulatory Board (Technical Standards and
Specifications including Safety Standards for Petroleum Installations) Regulations,
2017

Ministry of Petroleum and Natural Gas Regulatory Board has published the Petroleum and Natural
Gas Regulatory Board (Technical Standards and Specifications including Safety Standards for
Petroleum Installations) Regulations, 2017, on 25-01-2018.

These standards are intended to ensure uniform application of design principles in layout, material
and equipment selection, construction, operations, maintenance etc., as mentioned in
“Application” above for safe operation at the facilities associated with Petroleum Installations.

Requirements of these regulations shall apply to all existing and new Petroleum Installations.
These regulations covers safety in design, material and equipment, piping system components and
fabrication, installation and testing, commissioning, corrosion control, operation and maintenance
and safety of Petroleum Installations. These regulations also cover engineering considerations in
design and installations including fire protection and safety systems. These regulations do not
cover the requirements in respect of LPG installations.
