‫الممخص ‪-:‬‬

‫مقدمة ‪ :‬يحاول الباحث من خالل المقدمة الوصول إلي تعريف لمديمقراطية من خالل استعراض التعريفات الفقيية السابقة ‪،‬‬
‫وتحديد مدلول لعناصر الديمقراطية وفقا لرؤية الباحث حتي يمكن الوقوف عمي الضمانات الدولية لحماية الديمقراطية ومقارنتيا‬
‫بأطر الحماية الدستورية في النظام القانوني المصري ‪.‬‬

‫حرية الرأي والتعبير‪ :‬تعد حرية الرأي والتعبير العنصر االول من عناصر الديمقراطية وترتبط ارتباطا وثيقاً بالديمقراطية‬
‫وحقوق االنسان فيي وسيمة اإلصالح الفعالة لممجتمع لمنيوض بو واستغالل القوة الكامنة داخل أفراده ‪ ،‬وقد اىتمت المواثيق‬
‫الدولية اىتماما بالغا بيا حيث سعت نحو توفير الضمانات الالزمة ليا وكفمت األجيزة الدولية التي اختصت بالرقابة والتى‬
‫تعرض عمييا الشكاوي والقضايا المتعمقة والتي اصدرت العديد من االحكام التي تعد انتصا ار لحرية الرأي‪ ،‬وكما فطن واضعي‬
‫الدساتير المصرية المتعاقبة إلي أنو ال مناص من إقرار حرية األفراد في التعبير كما كفمت حرية الصحافة في العديد من‬
‫المواد الدستورية حيث التزمت الدولة بضمان استقالل المؤسسات الصحفية ووسائل اإلعالم ‪.‬‬

‫حرية تكوين االحزاب السياسية‪ :‬ال يمكن أن تتحقق الديمقراطية إال بوجود أحززاب سياسزية متعزددة وحقيقيزة يمكزن مزن خالليزا‬
‫زردا‪ ،‬نلزك ألنيزا تعمزل عمزى تنشزيط الحيزاة السياسزية داخزل الدولزة عزن‬
‫تداول السمطة بيدف منع اسزتبداد تيزار حزبزي بالسزمطة منف ً‬
‫طريق خمق روح التنافس عمى السمطة ‪ ،‬وقد ُثبت مدى اىتمام اتفاقيات حقوق اإلنسان بحزق األفزراد فزي تكزوين الجمعيزات بكافزة‬
‫أنواعيززا بمززا فييززا األحززاب السياسززية‪ ،‬وكيززف اشززتممت االتفاقيززات اإلقميميززة عمززى نصززوص تؤكززد حززق األفزراد فززي تكززوين األحززاب‬
‫السياسية ‪ ،‬كما ان االجيزة الدولية عيدت بحماية نلزك وفقزا لمزا ٌعزرض عمييزا مزن شزكاوي مزن االفزراد فزي نلزك الشزأن ‪ ،‬كمزا ان‬
‫الدستور المصري ومنن تعديل دستور ‪ 1791‬وكل الدساتير الالحقة أخنت بمبدأ التعددية الحزبية‪ ،‬حيزث تتابعزت الدسزاتير عمزى‬
‫مصر عقب ثورة يناير ‪1111‬م وكميا أكدت عمى حق األفراد في تكوين األحزاب السياسية إيمانزاً مزن واضزعي الدسزاتير بأىميزة‬
‫التعددية الحزبية وتداول السمطة بطريقة سممية‪ ،‬وأثر نلك في ترسيخ مبادئ الديمقراطية‪.‬‬

‫الحق في المشاركة في إدارة شئون البالد ‪ :‬يعد جوىر الديمقراطية ىو مشاركة األمة في الحياة السياسية‪ ،‬وأي ديمقراطية‬
‫ال توفر المشاركة وال تستجيب إلى نداءاتيا ىي قطعاً اسماً عمى غير مسمى‪ ،‬فالمشاركة ىي دعامة أساسية لنظام الحكم‬
‫الديمقراطي ‪ ،‬وال شك ان االنتخاب أحد أىم صور المشاركة في إدارة شئون البالد حيث يستطيع المواطنون أن يشاركوا في‬
‫الحياة السياسية بغية توجيو السياسات العامة عمى حسب إرادتيم وتطمعاتيم ‪ ،‬وقد عنت االتفاقيات الدولية باالىتمام بالحق في‬
‫ال مشاركة والنص عمى ضرورة أن تكون ىناك انتخابات دورية نزيية تعمل عمى تداول السمطة والتعددية السياسية ‪ ،‬كما كفمت‬
‫الدساتير المصرية الحق في المشاركة واعتبرت الحق في التصويت حقاً دستورياً وليس مستمداً من القانون ‪.‬‬
،ً‫ يؤصل البحث الحماية الدولية والدستورية لمديمقراطية باعتبارىا حقاً من حقوق االنسان فيي مبدأ معترف بو عالميا‬: ‫خاتمه‬
‫ وىو ما يقتضي بالضرورة إبجاد كافة الضمانات الدولية‬، ‫وىدف يقوم عمى القيم المشتركة لمشعوب في المجتمع العالمي بأسره‬
‫ ويتطمب تفعيل دور األمم المتحدة في رعاية الديمقراطية‬، ‫التي تكفل التزام الدول بالمبادئ الديمقراطية وعناصرىا االساسية‬
‫ فضال عن‬، ‫ وحماية الديمقراطيات الناشئة وتييئة العالم لمتحول الديمقراطي‬،‫حول العالم خاصة فيما يتعمق بمراقبة االنتخابات‬
‫إنشاء اجيزة دولية تعمل عمي متابعة سير الديمقراطية في العالم وتسمح بتمقي تقارير دورية من الدول وشكاوي من االفراد فيما‬
‫ اضافة الي ضرورة إنشاء ىيئة دستورية مصرية مستقمة تختص بمتابعة حالة الديمقراطية في‬، ‫يتعمق بممارسة الديمقراطية‬
‫ ويكون ليا الصالحيات الالزمة التي تخول ليا التحقيق والتأكد من أي انتياك لمديمقراطية وتضمن‬، ‫مصر وخطوات تقدميا‬
. ‫تطبيق كافة نصوص الحماية الدستورية لمديمقراطية‬

Abstract

Introduction:

Throughout the introduction the researcher tries to find out an exact definition to the “Democracy”
by reviewing the previous Jurisprudence Definitions, put a criteria to the elements of democracy to
identify the international safeguards for the protection of democracy and comparing it with the
Constitutional protection laws in the Egyptian legal system.

Freedom of speech:

The freedom of speech is considered as the main and the first factor of the democracy factors. It is
closely related to the democracy and the human rights. It is the effective reformation tool that
participates effectively in the community renaissance and exploiting the positive inner powers of
the community members. Because of the importance of the Freedom of speech, the international
agreements considered it and strived to ensure the needed safeguards to the freedom of speech and
the international specialized systems that work mainly as a censorship tool to investigate the
complaints and cases related to the freedom of speech, and there are a lot of judgments that prove
the victory of the freedom of speech. And also, the authors of the sequential Egyptian constitutions
has recognized that there is no way but to admit the individual’s freedom of speech, besides
ensuring the freedom of the press in various constitutional articles: since the country committed to
guaranteeing the independency of press institutions and the media.

Freedom of the political parties’ formation:

Without a real and different political parties there is no democracy. The political parties are the
legal and the only way of the devolution of power and the prevention of the despotism of a definite
party. It works to activate the political life in the country through creating a competitive
environment over the authority, and it is known how human rights protocols lay great interest to
people’s right in establishing all kinds of associations including political parties. Besides, the
regional protocols included some texts assures the individuals’ rights in forming political parties.
Also the international organizations assured protecting this according to the complaints made by the
individuals in that matter. And also, the Egyptian constitution since the changes made to 1971
constitution and all the followed constitutions admitted the multiparty, since a lot of constitutions
have been worked with in Egypt after January 2011 revolution and all of them admitted the
individuals’ right to form political parties as the constitutions authors believe in the multiparty and
the peaceful devolution of power, and all of this affected the establishment of democracy principles.

The right of participating in the management of the country affairs:

The main core of democracy is the citizens’ participation in the political life of their country.
Participation is main pillar in any democratic system. No doubt that election is one of the
democratic evidences that show the citizens participation in managing their country affairs and its
political life in order to directing the general policies according to their will and aspirations. So, the
international agreements considered the right of participation and the importance of putting clear
law to insure regular and honest election that ensure the devolution of power and the political
pluralism. The Egyptian constitutions also ensured the participation right and considered it as
constitutional right not just a legal right.

Conclusion:

The research stabilizes the constitutional and international protection of the democracy as one of the
human rights. It is internationally recognized and it is an aim that all the nations seek to achieve. So,
finding out all the international safeguards that can ensure the commitment of all the counties to the
principles and factors of democracy, became a must. Also activating the role of the United Nations
to protect democracy all over the world became a must, especially its role in election observation,
protecting the emerging democracies and configuring the whole world for the democratic
transformation. It’s a must also to establish international systems to follow the progression of the
democracy and to deliver regular reports and any related complaints from the citizens. It’s
recommended also establish an independent Egyptian constitutional organization that is concerned
with following up the state of democracy in Egypt and the steps of its progress. This organization
shall have the necessary powers to investigate and verify any violation of democracy and ensure the
application of all the constitutional protection laws of democracy.
