CASE PLAN
Re: Reissuance of Lost Owner’s Title shall be governed by the PD. No. 1529 or
otherwise known as the Property Registration Decree

1. AFFIDAVIT OF LOSS
 It must be notarized by a notary public stating the facts and circumstances for the
reason of the loss of the document by the person who has the personal knowledge.
 The affidavit shall identify the property through title number and tax declaration.
 Notarial fee shall amount to Php 300.00

2. ANNOTATION OF THE AFFIDAVIT OF LOSS TO THE REGISTER OF


DEEDS.
 Section 109 of the Presidential Decree No. 1529 provides that, in case of loss or
theft of an owner's duplicate certificate of title, due notice under oath shall be sent
by the owner or by someone in his behalf to the Register of Deeds of the province
or city where the land lies as soon as the loss or theft is discovered. If a duplicate
certificate is lost or destroyed, or cannot be produced by a person applying for the
entry of a new certificate to him or for the registration of any instrument, a sworn
statement of the fact of such loss or destruction may be filed by the registered
owner or other person in interest and registered.
 Pay annotation fee in the amount of Php 5,000 or more. To inform the whole

3. REQUEST FOR CERTIFIED TRUE COPY WITH ANNOTATION OF LOSS


TO THE REGISTRY OF DEEDS
 Upon the petition of the registered owner or other person in interest, the court
may, after notice and due hearing, direct the issuance of a new duplicate
certificate, which shall contain a memorandum of the fact that it is issued in place
of the lost duplicate certificate, but shall in all respects be entitled to like faith and
credit as the original duplicate, and shall thereafter be regarded as such for all
purposes of this decree.

4. REQUEST CERTIFICATION OF NO PENDING CASE IN THE OFFICE OF


THE CLERK OF COURT IN THE RTC

5. FILE A PETITION FOR REISSUANCE AT THE RTC BY A LAWYER
 Notice of initial hearing, publication, etc. The court shall, within 5 days from
filing of the application, issue an order setting the date and hour of the initial
hearing which shall not be earlier than 45 days nor later than 90 days from the
date of the order.
 The public shall be given notice of the initial hearing of the application for land
registration by means of (1) publication; (2) mailing; and (3) posting

8. WAIT FOR THE CERTIFICATE OF FINALITY


 If granted after months, a Certificate of Finality will be issued after the lapse of 15
days from receipt of the parties of the copy of the decision.

9. FILE A COURT DECISION AND CERTIFICATE OF FINALITY AT THE


REGISTRY OF DEEDS
 This will be the basis of the Registry of Deeds of the issuance. The new title will
contain all the annotations, liens and encumbrances in the lost title.

10. REGISTRY OF DEEDS


 Issuance of Replacement of Owner’s Land Title.

In connection with handling the same, the following are the applicable legal fees in to
the total amount of Php ____________., payable as follows:
a. Php 50,000 as acceptance fee, payable upon your conformity with this agreement;
b. _____________- payable upon the issuance of decision by the court.

APPEARANCE FEES: The amount of _________, shall be due for every Appearance
before the courts or administrative bodies or agencies as well as other offices requiring
our representation of your interests, whether physically or by virtual conference, payable
every after hearing or such other dates as billed.
