DESIGN PROPOSAL

AND
CONTRACT AGREEMENT

Thank you for giving us this opportunity to submit our proposal for the Architectural and
Engineering Design of your Proposed 2-Storey Residential Building. This proposal covers
Comprehensive Architectural and Engineering Design which will be broken down as follows:

1. ARCHITECTURAL SCOPE OF WORK

The scope of work covers the comprehensive design, from the initial conceptual
discussions to schematic plans, developed forms and elevations, detailed engineering
and architectural drawings, and interpretation during construction. It is broken down to
the following phases:

F. Basic Interior Perspectives
G. Basic Exterior Perspectives

1.1 PHASE I: CONCEPT DESIGN. This phase includes initial discussions with the Owner or
the Project Representatives regarding their project requirements and design
preferences. From this initial data, suggested conceptual design schemes shall be
presented for the Owner’s approval. Revisions will be made at this phase until
such time that the design requirements of the Owner have all been satisfied.

1.2 PHASE I: SCHEMATIC DESIGN. Following the client’s approval of a preferred


concept design, modification and development will be made based on
applicable inputs suggested. Reviews, adjustment and further refinements
between key elements and character take place at this stage. Such changes in
the design scheme must take place in this phase prior to the Design Development
Phase, otherwise, further changes in design and general layout of plans shall be
charged as additional work.

1.2.1 SCHEMATIC DRAWINGS. Schematic drawings such as refined floor plans


and elevations will be presented to the client for approval. Schematic
drawings will also be presented to be able to further convey the
Architect’s concept. In-house sketches of major areas of the project will
be produced; and/ or image of other projects will be presented to the
Owner for approval.

1.3 PHASE II: DESIGN DEVELOPMENT. Upon Client’s approval of a schematic design,
the Architect would further refine the design in coordination with various related
disciplines such as structural, electrical and plumbing consultants. The drawings
would now be set up as the basis for commencing working drawings. Further

adjustments in plans must take place at this stage of the work before proceeding
to the working or construction drawings. Sample mouldings, casings, color
swatches, and other finishes will be presented to provide the owner a preview of
the color and finishing combinations of each area covered.

1.4 PHASE III: CONTRACT DOCUMENTS. This phase represents the final development
and production of the working drawings for both exterior and interior architectural
including major detail drawings where necessary.

1.4.1 CONSTRUCTION DRAWINGS. Separate construction drawings will be


produced for the various related fields including Structural, Sanitary and
Electrical Plans.

1.4.2 FINAL SPECIFICATIONS. Specifications of materials and other equipment


will also gather, presented for the client for approval, and finalized.

1.5 PHASE IV: CONSTRUCTION SUPERVISION. The Architect’s scope of service in this
phase shall be limited to 2 periodic site visits and supervision, and to attend
meetings for the coordination of works and urgent meetings if so required by the
Architect to familiarize himself with the progress of work and to assure whether the
intent of his design is being met and the quality of workmanship is proceeding in
accordance with the Contract Documents prepared by the particular design
professional. Any additional request of Site Visits shall be charge accordingly.

2. ESTIMATED PROJECT SCHEDULE

The following is an estimated proposed schedule for the above-mentioned design service:

3. SERVICES NOT INCLUDED

The following are related services in the design process but are not included as part of this
proposal:

3.5 Landscape Architectural Design
3.6 Photographs or Brochures
3.7 Signage and Graphic Design
3.8 Professional Rendering for Brochure/ Marketing Purposes
3.9 Full Time Supervision of the Project During Construction
3.10 Furniture Design
4. PROFESSIONAL FEE / FEE SCHEDULE

a. The professional fee for the scope of services outlined in this proposal shall be lump
sum amount equivalent TWO HUNDRED THOUSAN PESOS ONLY, upon the execution of
this agreement EXCLUSIVE OF EVAT & other charges.

b. This lump sum amount will be broken down according to the scope of works
mentioned and shall be payable as follows:

Total Contract Amount Php 150,000.00


Phase I (25%)
CONCEPT/SCHEMATIC DESIGN
Payment shall be made upon signing of this proposal
Php 50,000.00
Phase II (50%)
DESIGN DEVELOPMENT
Payment upon the completion of the schematic
designs, ready for the commencement of the
working drawings
Php 50,000.00
Phase III (25%)
CONTRACT DOCUMENTS
Payment shall be made upon the completion of the
working drawings and specifications (signed and Php 50,000.00
sealed)
SPECIAL SITE VISITS/ITEM SOURCING FROM
SUPPLIER WITH THE OWNER/PER DIEM

Construction Period and Supervision


Php 5,000.00

TERMS AND CONDITIONS

c. The Client will pay all invoices within thirty (30) days upon receipt. Failure to pay
undisputed invoices or the undisputed portions of invoices shall constitute sufficient
reason to suspend all services until payment is received. Our company shall not be
responsible for any consequences to the project schedule and other delays due to
suspension of services in the event of Client’s non-payment. Invoices remaining
unpaid after thirty (30) days will also accrue a service charge of 1% per month.

d. Sales, value-added, withholding and other government imposed taxes on the


provision of Architectural or Engineering services are not included in the amount of
fees. No deduction shall be made from the compensation described herein on
account of such taxes.
e. Down payment shall be forfeited, in our favor in case the client
discontinue work already in progress. Furthermore, in the event of discontinuance in
any phase of the work, the Architect shall be duly compensated for the work already
done based on the percentage of accomplishment for each phase of work.

f. Any revisions made by the client after the Design Development Phase and/ or during
the implementation of the construction, the Architect shall be compensated for
under a new set of negotiations as additional work. Owner-instituted changes in
previously approved designs, therefore delaying the project schedule and other
cause and delays beyond the control of the Architect are examples of such
additional services. Both parties shall mutually agree to the ensuing and the
corresponding time extension.

6. SUBMITTALS

We will provide Ten (10) sets of working drawings (which include 8sets for permit and 2
sets for contract signing) and specifications to the client.

Request for additional copies of working drawing and/ or specification will be furnished
at reproduction cost to be borne by those who requested them.

7. REIMBURSABLE EXPENSES

a. In addition to the professional fees herein stated, the following items shall be
considered as reimbursable expenses by the client, being separate and apart from
the professional fees.

i. Costs of all white printing, photo reducing, copying, etc.

ii. Professional contract renderings, with the prior approval of the client.

iii. Photography of presentation materials, including rendering, color/ material


boards, model artwork, and special samples, and for jobsite surveys.

iv. Special samples and models constructed for study and/ or for presentational
and for other out-of-pocket expenses incurred in the performance of such
services, subject to prior approval of client.

v. Costs of import/ export fees, customs or duties, license or declaration levied on


any presentation materials deemed necessary for the projects, i.e. sample,
models, presentation boards, drawings and specifications.
8. ARCHITECTURAL DESIGN CREDIT AND PRESS RELEASE

The architect shall be given full credit for the architectural design of the project within
their scope. With the client’s prior approval, the architect shall prepare press material
describing the architectural concepts of the project and will cooperate with the client
to gain maximum press coverage for the project.

9. GOVERNMENT LAW

This contract and all questions arising hereunder shall be governed exclusively by the
laws applicable to contract made and as wholly performed in the Philippines.

10. CONCLUSION

This proposal shall constitute the agreement between the parties whose
acknowledgment of acceptance shall be affixed with their corresponding signatures
