MAILI COVE CONDOMINIUM

Welcome to Maili Cove! This friendly condominium occupies a place of


exceptional beauty. The following simple House Rules, are based on common
courtesy and consideration, are intended to ensure peace, tranquility and safety
for everyone.

Please take a moment to familiarize yourself with them. All owners, renters and
unattended guests must register with the resident manager. Owners, renters,
and guests must comply with our By Laws and House Rules. Failure to do so
may result in the Board of Directors taking remedial administrative or legal
action against violators – with cost to owners.

Owners and their agents must have a current copy of the Maili Cove House Rules
available in their apartments so their guests and renters can read them and
comply with them. Owners are responsible for their guests and tenants and their
behavior. Any questions or issues can be addressed to the Resident Manager –

A current copy of the Rules can be downloaded from the Owner’ Web Site –
Mailicove.net or emailed to you from the Resident Manager.

The Resident Manager or Site Manager is responsible for enforcement of the


Rules. What the Manager or the security guard on duty says - must be followed.

HOUSE RULES
POOL USE
Maili Cove Management and Security reserves the right to prohibit use of pool
and facilities to any owner, resident or their guests at anytime for violations of
the House Rules or any behavior deemed inappropriate. Violations of the pool
rules may result in the suspension of an owner’s and/or renter’s pool privileges
and/or administrative fine.

The pool and pool deck have a limited capacity, and accordingly, its use is
restricted to owners, residents and their guests. Day guests who are not
owners or residents may not use these facilities without the Resident Manager’s
pre-authorized approval. If approved, all activities will cease at 9 PM when quiet
hours begin. A guest list will be kept.

Owners or residents are allowed no more than two (2) adult guests per unit at
the pool at anytime. All exceptions for additional adult guest must be approved
in advance by the Resident Manager. ALL guests must be accompanied by the
owner or resident while at the pool. Owners and Residents are responsible for
the proper conduct of their guests while at the pool or anywhere on the Maili
Cove property.

Pool Hours: 8:00 a.m. to 9:00 p.m. No lifeguard is on duty. Swim at your own
risk. Children under the age of 12 must be accompanied at all times by an adult
18 years of age or older when using the pool.

All swimmers, including children, are required to wear appropriate swimwear.

Incontinent persons, including children, and those with infections or


communicable diseases, bandages, open wounds or skin diseases may not use
the pool.

Swimmers must shower to remove sand, suntan oil, dirt, grease, etc. before
entering the pool. PLEASE SHOWER, RINSE FEET AND EQUIPMENT AFTER
ENTERING GATE FROM BEACH BEFORE ENTERING POOL AREA.

Diving into the pool is not allowed at any time.

Playing or swinging on the pool ladder or handrails is strictly prohibited.

Aggressive, boisterous, or other inappropriate behavior in the pool is prohibited.


That behavior includes, but not limited to: yelling, shoving, jumping, spitting,
excessive splashing, ball playing, throwing things and so forth.

Goggles, snorkels, swim fins and approved safety flotation devices (Life
jackets, children safety floats attached to the body, exercise belts) are
permitted. Floatation devices such as floats, boards, tubes, etc, are not
permitted. Aquatic equipment such as SCUBA gear is not permitted in the pool
or to be placed against the fence for drying.

No eating, drinking or smoking is allowed in the pool.

For safety reasons and consideration to others, no ball or game playing is


permitted on the common lawn areas (except the area between ocean and
fence), in the parking lot, on the pool deck, or in the pool. Residents are
encouraged to use the park next door.

POOL DECK USE

Violations of the Pool Deck rules may result in the suspension of an owner’s
(includes renters) pool deck privileges.

Hours: 8:00 a.m. to 9:00 p.m.

The deck may be slippery if wet. To prevent accidents, running on the pool deck
is prohibited.

Smoking is prohibited on the pool deck. It is allowed outside of the fenced area.

No breakable items are permitted in the pool area (glass bottles, cups, any glass-
bottled condiments, etc.).
Extremely large coolers and other large food storage containers are prohibited.
Pool furniture may not be borrowed or moved from the pool deck area.

Tables, chairs, and loungers must be returned to their original locations after
use.

Sound devices are not allowed on the pool or pool deck unless earphone type
headsets are worn. Exceptions may be made for social functions and approved
by the Resident Manager.

BBQ hours are 8:00 AM to 9:00 PM. Day guests may not use the grills. If you are
not familiar with the grills, see the Resident Manager for use instructions. Clean
grills after use. Failure to do so could revoke your privilege to use the grills and
possibly an administrative fine.

PARTY USE OF POOL DECK, COURT YARD, AND OCEAN AREA

Traditional Association parties or meetings, such as, on holidays or special


events that are intended for the participation by all residents, may be allowed on

the pool deck and lawn areas. The Resident Manager must approve the event in
advance. Host(s) will be responsible for set up and cleanup.

Private parties are not allowed on the pool deck without prior approval from the
resident manager. Approval for the event and its location must be obtained
from the Resident Manager. Party host(s) must supply all equipment and
furniture, dispose of trash, and provide parking. All house rules apply. Any
liability and/or damage arising from the event are the responsibility of the
owner/renter/guest.

Party requests must be submitted to Resident Manager at least one week in


advance of intended activity. All parties shall cease by 9pm. Guest parking must
be provided off-site.

The host must be in attendance to assure compliance of our House Rules. The
party guests may not use pool, pool deck, or BBQ grill facilities without the
Resident Manager’s approval. Such approval will be rare and limited. Very large
parties must be approved by the Board of Directors.

Only one party per day is allowed.

NOISE
Quiet hours are between 9 p.m. to 8 a.m. Quiet Hours is the period of time when all
residents make an effort to minimize the sound level in and about their apartment
which fellow residents may hear. Thus avoid emptying trash (esp. Bottles) into trash
bins during quiet hours or making loud noises in the stairwells during quiet hours.
Noise shall be kept to a minimum at all times. Any loud disturbing noise should
be reported to the Resident Manager. The Resident Manager or the Security
Guard will be the final authority on acceptable sound levels.

Owners/Renters should behave with decorum at all times, and any abusive
behavior, tirades or loud use of profanity, will not be tolerated and is a violation
of these house rules.

Sound devices are not to be used in the common areas (pool area, stairways,
entries, corridors, laundry, etc.) unless earphone type headsets are worn.
Exceptions may be made for social functions.

There will be no noisy activities on the lanais or in the pool area during quiet
hours. Because of the unique shape of our building, sound travels easily –
especially from the lanais and the pool area. Loud conversation from these
areas can be clearly heard at night. Please be considerate of other residents and
guests.

Continuous barking of dogs is not allowed and is a nuisance to other residents.
Pet owners are responsible for their pet’s behavior and will be subject to
administrative penalties or fines for violations.P

Work hours for contractors or trades people are from Monday through Friday
8:00 a.m. - 5:00 p.m. A contractor may be authorized to work on a Saturday in an
emergency or special situation as approved by the resident manager. Owners
are allowed to work on Saturday from 8:00 a.m. to 5:00 p.m. Work on Sunday &
Holidays is not allowed if it produces noise that disturbs the residents of Maili
Cove.

VEHICLES AND PARKING AREA

Each apartment is assigned exclusive rights to one specific assigned parking


stall for vehicles only. Owners/tenants shall not use any other parking stall at
any time without prior written permission presented to resident manager from
the owner/tenant assigned that parking stall. A parking authorization form is
available on our website. Any vehicle occupying an unauthorized parking space
will be towed away at the owner's expense. All vehicles must park completely
within the parking space. That is, within and not beyond the white lines so as to
allow sufficient clearance for adjacent occupants to gain access to their vehicle
and room to maneuver out of their parking space. All vehicles must be in
operating condition and not dripping oil or other fluids.

Commercial vehicles are allowed only in visitor parking spaces.

Visitor parking spaces are available for temporary use. Those who use these
spaces must register upon arrival at the Resident Manager's Office. Failure to
register will result in the immediate removal of the vehicle, with the towing costs
to the vehicle owner. There is an overnight fee of $10.00 per day, payable in
advance or the unit owner will be billed. Per unit, owners are allowed (3) days of
parking per month at no charge.

Reserve Parking spaces are available. First come; first serve. The monthly fee if
paid annually is $600 or $50 a month. If paid semi-annually is $330 or $55 a
month, and if paid monthly $60 a month. A daily rate is $3.00 per day. Please
see Resident Manager to reserve a parking spot.

Car washing is permitted only in the designated area next to the storage
enclosure on the Waianae side of the building.

Automotive repairs are not permitted on the premises. Minor adjustments are
allowed, such as: changing a flat tire, battery, wiper blades, checking fluid
levels, adding window washing fluid, etc.,

Ball playing, running, chasing and so forth is not permitted in the parking area.

All vehicles using the parking spaces facing the building must pull in head first
to prevent exhaust fumes entering 1st floor units.

OCCUPANCY

Apartments shall not be used for business or similar unauthorized purposes.


The apartment owner shall assume responsibility for the conduct of his/her
family, tenants or guests.

The apartments shall be occupied and used by respective owners and their
families, tenants and the tenants’ families and guests only for residential
purposes and in compliance with the restrictions contained in the respective
apartment deeds. The apartments may not be used for any other purpose. Each
apartment resident is fully responsible for the conduct of his/her family, renters
and guests.

Owners shall register their unaccompanied guests, tenants and property/rental


managers with the Resident Manager in person or by submitting the
“Unaccompanied Guest” form available on the Maili Cove Condominium
website www.mailicove.net. This information shall be used only for emergency

contact or official Association business. For the purposes of this provision, an


“Unaccompanied Guest” is one not accompanied by the property owner, family
member or renter. Unaccompanied and unregistered guests may be considered
trespassers and asked to leave if not properly registered with the Resident
Manager.

APPEARANCES

The appearance of apartment windows, doors, screens, doorways and


entryways are the responsibility of the resident. That includes: washing
apartment windows and screens, keeping them clean and in good condition at
all times. That includes replacing any broken or missing jalousies window
panes or screen doors.

Doorways and entry areas (limited common areas) shall be kept clean and neat.
Such housekeeping will be accomplished by the Association and billed to the
owner if said resident fails to do so in a timely fashion. Because of spalling
concerns, entryway carpeting is not allowed.

Corridor, stairways, entryways, and other walkways shall be kept free of all
items and obstructions. (This will allow unhampered access for emergency
personnel, allow efficient maintenance, and create a uniform appearance.) Only
traditional door mats are allowed in entryways.

Only appropriate houseplants and lanai furniture are permitted on the lanais.
Potted plants must have drip pans or suitable containers placed under them.

The watering of plants and the sweeping and mopping of lanais shall be
accomplished in such a manner as not to create a nuisance to persons residing
in adjacent or lower apartments or to persons on the grounds. Proper safety
precautions must be taken so plants do not fall or are not blown from lanais.

The lanais shall not be used for storage, its railing used to hang items, its walls
used to hang ornamentals or hangings.

No refrigerators, surfboards, boogie boards, or objects of any other kind are to


be stored on the lanais. Nothing shall be hung or attached to lanai railings or
walls. No barbecue devices or hibachis are permitted to be used on lanais or in
the apartments.

Decorative lights may be hung on lanai railings during the winter holiday
season - mid-November to mid-January.

All curtains, drapes, and other window covering visible from outside a unit must
be neutral in color. That would be white or off-white (light beige or light gray).

Window air conditioners shall have lattice covers as depicted in the


architectural standards section.

Rubbish shall be placed in garbage bags. Cardboard boxes must be broken


down. These items can be deposited in dumpsters located adjacent to the
parking area on each side of the building.

24 hours advance notice must be given to the Site Manager or Resident


Manager when household goods, large items or furniture are to be moved
through the corridors or stairways.

Anything spilled or dropped in the stairwells, walkways, parking lot, or other


common areas must be cleaned up immediately by the individual responsible.
Such housekeeping will be accomplished by the Association and billed to the
owner if said individual fails to do so in a timely fashion. Cigar/cigarette butts
are not to be discarded on the Maili Cove grounds, flower beds or any other
common area.

Except for the first floor, carpet or any other flooring material shall not be
attached to the lanais.

PETS
Dogs, cats and other household pets in reasonable size and number, as determined by
the Board, but not to exceed a total of two (2) such dogs, cats, and other household
pets per apartment are allowed, but shall not be kept, bred, or used therein for any
commercial purpose. Tenants with pets (cats and dogs) must receive written
permission (Pet authorization form is available at our website) from the unit owner and
have a copy on file with the Resident Manager. Tenants must also present shot records
and license to Resident Manager. 7
No pets are allowed in the pool or pool deck area or courtyard.

Pets in any common area must be leashed and under the control of its owner.

Pet runs are located on the Waianae or Nanakuli side of the parking lot wall area.

Pet owners are responsible for properly disposing their pet's droppings.

SMOKING

The City’s ordinance and our house rules prohibit smoking in the following Maili
Cove common areas: the laundry/storage room, trash rooms, all stairways, all
walkways, all entryways, pool, pool deck, and the pool breezeway.

Smoking must not become a nuisance, please be considerate of your


neighbor’s needs while smoking in your unit or on your lanai.

PRE-APPROVED REPLACEMENT ITEMS

The Maili Cove’s Board has established architectural designs, standards, and
guidelines for most replacement items. Before you install a replacement entry
door, transom, screen door, security door, window, lanai deck covering, air
conditioner, light fixtures, door hardware, etc.; obtain a copy of the current
Architectural Designs and Standards Guidelines booklet from the Site Manager
or Resident Manager or from Maili Cove website.

MISCELLANEOUS
All owners/tenants/guests are prohibited from feeding feral cats, dogs, birds,
poultry or any other feral or wild animal on the grounds of Maili Cove.

Individuals shall not plant flora on Maili Cove property without approval by the
Board of Directors.

Drone flying on Maili Cove property is prohibited.

NON-COMPLIANCE WITH THE HOUSE RULES

The house rules apply to all who live at or visit Maili Cove. They are enforced
equally for everybody, without discrimination. The Resident Manager is the on-
site authority.

Violations of our House Rules will be cited. You may be verbally warned or cited,
as appropriate by the Property Manager, Resident Manager, Site Manager or
Security Guard. Any violations may result in a written warning to owners and
potential administrative fine as described below. Violations may result in legal
action, with all legal costs charged to the unit owner.

Violations of the rules will be logged and kept as to time and date of notification.

The Board of Directors may modify and/or amend these House Rules from time
to time as may be deemed necessary for the safety, care, and cleanliness of the
premises and for securing the comfort and convenience of all the residents of
Maili Cove.

ENFORCEMENT OF HOUSE RULES AND POLICIES

1. Owners are responsible for the actions of their tenants and guest at all
times.

2. Observed violations should be reported to the resident manager for further


action.

3. The resident/site manager will send copies of all written notices of violation
to the appropriate owner, tenant, and/or rental agent.

4. Schedule of actions:

• Verbal Warning: The Resident Manager or Site Manager has the authority
and responsibility to try to resolve any violation of the House Rules or
Policies through a verbal warning to the owner or guest.

• First Violation: A written warning is given to the person not adhering to


the Maili Cove House Rules and Policies and copy of the written notice of
violation will be sent to the appropriate owner, tenant, and/or rental agent.
Typically, the letter will assign 14 days in which to comply with the house
rules, or then be subject to a second violation notice as described below.
Provided, however, serious violations (violations which, for example,
threaten person of property) shall be the basis for action by the
Association without any requirement of prior notice.

• Second Violation: A fine of $50.00 will be imposed for not rectifying a


discrepancy prior to the deadline imposed by the first letter of warning. In
addition, a repeat, continuance or new violation by the same person or
unit may result directly in a second violation fine. Typically the letter will
assign 14 days in which to comply with the house rules, or then be subject
to a third violation notice as described below. Fines will be collected by
the Property Manager. A written citation will be given to the violator with
copies of the citation being sent to the owner, tenant and/or rental agent.

• Third Violation: A fine of $100.00 will be imposed for not rectifying a
discrepancy prior to the deadline imposed by the second letter of warning.
In addition, a repeat, continuance or new violation by the same person or
unit may result directly in a third violation fine. Typically the letter will
assign 14 days in which to comply with the house rules, or then be subject
to a fourth violation notice as described below. Fines will be collected by
the Property Manager. A written citation will be given to the violator with
copies of the citation being sent to the owner, tenant and/or rental agent.

• Fourth and Subsequent Violations: A fine of $200.00 will be imposed for


not rectifying a discrepancy prior to the deadline imposed by the third
letter of warning. In addition, a repeat, continuance or new violation by
the same person or unit may result directly in a fourth violation fine. Fines
will be collected by the Property Manager. A written citation will be given
to the violator with copies of the citation being sent to the owner, tenant
and/or rental agent. The attorney for the Association will be notified by the
Board of Directors of the violation(s) together with all prior documentation
and instructions to begin legal proceedings appropriate to the violation.

5. Second, third, fourth and subsequent offenses within a 12-month period


need not be for a violation of the same provision before a fine is imposed.
For example, if an owner tenant or their guest violates a “Pool” rule for the
first violation, and then violates a “Noise” rule for the second violation, the
fine would be imposed on the violator, with the owner ultimately
responsible, upon the occurrence of the second violation. It is not
necessary for an owner, tenant or their guest to repeatedly violate the same
rule twice before a $50.00 fine is levied for a Second Violation. A $100.00
fine may be assessed for a third violation of any House Rule and a $200.00
fine may be assessed for fourth and subsequent violations of any House
Rule.

6. Each citation issued shall briefly describe the nature of the violation, the
apartment number, and the name(s) of the party involved, if known, and if
practical a picture of the violation.

7. The Board of Directors will designate its authority to the Resident/Site


Manager to take initial investigative steps to determine the validity of a
reported incident and to write the citation, if necessary.

8. When matters are referred to the Association's attorneys for action, all legal
costs incurred will be paid by the unit owner pursuant to Section 514B-157,
Hawaii Revised Statutes, and the Association's governing documents.

9. Apartment owners shall be liable for their own fines and for fines assessed
against their guests, family members, agents, tenants, their tenants’ guests,
family members, agents and contractors.

10. Right to Appeal:

• Within thirty (30) days of the date of a citation, an owner, tenant, or other
offender may appeal to the Board by mailing or delivering a written notice
of appeal to the Board in care of the managing agent. The Board may
affirm, modify, suspend or cancel any citation after consideration of the
appeal.
• The owner shall have the right to initiate a dispute resolution process as
provided by 514B- l 04(a)( l l ) , Hawaii Revised Statutes.

ALTERATIONS TO COMMON AREAS & INDIVIDUAL CONDO UNITS

Owners wishing to make structural modifications to their units must present


their plans to the Board of Directors for its written approval as stated in Section
V of the Architectural Design & Standards Guidelines booklet. See Resident
Manager for a copy of the booklet. Owners are advised to review the Maili Cove
governing documents and may wish to contact the Resident Manager for
assistance.

NON-DISCRIMINATION POLICY

Pursuant to Hawaii Revised Statutes Chapter 515, Title VIII of the Civil Rights
Acts of 1968 as amended by the Fair Housing Amendments of 1988, and our
non-discrimination policy, the Association does not discriminate on the basis of
race, sex, color, religion, marital status, familial status, ancestry, disability, age
or HIV (human immunodeficiency virus infection) in housing or real estate
transactions. It is our policy to extend to all individuals the full and equal
enjoyment of the advantages, facilities, privileges and services consistent with
Hawaii Revised Statutes Chapter 515 and the Federal Fair Housing Laws. When
providing services and facilities or enforcing the rules at Maili Cove, the
Association will not allow discrimination, except as permitted by law. In
particular, the Association will treat all persons equally:

In granting or withholding any approval or consent required under the


Association's rules.

In enforcing requirements of the Association rules about occupancy restrictions


or use of the recreational facilities which might unlawfully restrict families with
children.

In connection with requests of disabled occupants or visitors to Maili Cove that


have certified guide dogs, signal dogs, or other animals required because of the
occupant's or visitor's disability; except that if the animals become a nuisance
to others they will not be permitted at the Maili Cove and will have to be
removed. In processing requests of disabled occupants to: (I) make reasonable
modifications to an apartment or the common areas at their own expense; and

(ii) have reasonable exemptions from requirements of the association rules, to
enable those occupants to have full use and enjoyment of Maili Cove.
Guidelines of the American Disabilities Act (ADA) and Hawaii Laws will be
followed.

The Board will suspend any requirement of the Association rules which, if
enforced, could result in unlawful discrimination.

BUS SERVICE: “The Bus” stops just outside the condominium - to the left, near
the traffic light, for travel toward Honolulu. There is a bus stop across the street
for travel toward Waianae. For time schedules call “The Bus” at 848-5555.

FRONT GATE HOURS: Closed from 11:00 p.m. to 5:30 a.m. May be opened by
the Security Guard upon request or you may open it yourself.

If the need arises to use the 911 emergency numbers, please notify the Resident
Manager or the Security Guard so they may assist those responding to the
emergency.
