Respected Sir,

This is to inform you that the father of the below mentioned Sri Rajib Dhar namely Late
Tulsi Dhar during his lifetime in order to settle all their sons and daughter arrived at an
oral family settlement with respect to the dwelling house standing over the land described
in the Schedule ‘A’ hereinbelow and by virtue of that family settlement the plaintiff has
been granted/allotted the below scheduled ‘B’ premises at the Ground floor of the
dwelling house to live there alongwith his wife and children and since then the plaintiff is
in actual khas and physical possession of the below scheduled ‘B’ premises.
In the month of November 2018, the mother of said Rajib Dhar and below mentioned
Anindita Dhar (Paul) namely Smt. Sandhya Dhar wife of Late Tulsi Dhar in collusion
with her other sons namely Sri Santanu Dhar and Santu Dhar all of a sudden asked the
plaintiff to leave the dwelling house alongwith his wife and son. Said Smt. Sandhya Dhar
since long is residing in a separate building with said Santanu Dhar. Said Sandhya Dhar
has also sent a legal notice dated 17/08/2019 to said Rajib Dhar and the same was
received by Rajib Dhar on 19/08/2019. Subsequently again on 30/08/2019 one Sri
Deepak Talreja, Son of Shyam Lal Talreja whom said Sandhya Dhar appointed to
develop the below scheduled ‘A’ and ‘B’ property, also threatened said Rajib Dhar in
presence of said Sandhya Dhar to vacate the below scheduled ‘B’ premises or else he will
throw their belongings out of the house.
At this said Rajib Dhar on 02/9/2019 filed a Title Suit being T.S. No. 176/2019 against
said Sandhya Dhar and Deepak Talreja in the Court of the Learned Civil Judge Junior
Division at Siliguri for declaration, permanent injunction and consequential reliefs in the
manner as prayed for in the plaint of the said suit along with an application under Order
39 Rule 1 and 2 read with section 151 of the Code of Civil Procedure with respect to the
Scheduled ‘B’ premises and the said application was moved before the Learned Civil
Judge Junior Division at Siliguri on 02/09/2019 and the Learned Court on hearing the
said application was pleased to show cause said Sandhya Dhar on 01/10/2019 and the
said suit is pending for adjudication before the Court with the next date being fixed by the
Learned Court on 01/10/2019..
That on 05/9/2019 at around 5PM said Sandhya Dhar together with said Santanu Dhar,
Santu Dhar and Deepak Talreja again threatened Rajib Dhar and his wife namely below
mentioned _________ and her sister said Anindita Dhar (Paul) and her husband
_________ with dire consequences if said Rajib Dhar and his wife and children does not
leave and vacate the below scheduled ‘B’ premises immediately and demanded a huge
sum of money from them and on their refusal to vacate the premises said Sandhya Dhar
together with said Santanu Dhar, Santu Dhar and Deepak Talreja misbehaved and
assaulted them.
In the said circumstances I would request you to kindly look into the matter and take
necessary action against said Sandhya Dhar, Santanu Dhar, Santu Dhar and Deepak
Talreja.

ALL THAT piece and parcel of land measuring 04 Katha recorded in Khatian No. 1462/1
appertaining to and forming part of Plot No.5061 within Mouja- Siliguri, J.L. No.
110(88),

Pargana- Baikunthapur, within SMC Ward No. 26, P.S. Siliguri, District- Darjeeling,
West Bengal alongwith a three storied building standing thereon.
The aforesaid land is presently butted and bounded as follows:
By the North : Land and flat of Late Binoy Biswas and others
By the South : Land and house of Sri. Moti Paul
By the East : 20’-00” wide SMC Road
By the West : Land and house of Sri. Sankar Samaddar.
SCHEDULE- ‘B’
[Suit premises being possessed by said Rajib Dhar]
ALL THAT piece and parcel of a Flat measuring about 600 Sq.ft. consisting of two bed
rooms, one Drawing Room, One Kitchen and one attached bathroom cum toilet situated
at the Ground floor of the building standing over the land measuring 04 Katha described
in the Schedule-‘A’ hereinabove.
