Sresta Natural Bioproducts Private Limited is a Non-


govt company, incorporated on 09 Mar, 2004. It's a
private unlisted company and is classified as' company
limited by shares Company's authorized capital stands
at Rs 2620.0 lakhs and has 69.60832% paid-up capital
which is Rs 1823.74 lakhs. Sresta Natural Bioproducts
Private Limited last annual general meet (AGM) happened
on 25 Sep, 2017. The company last updated its
financials on 31 Mar, 2017 as per Ministry of Corporate
Affairs (MCA). Sresta Natural Bioproducts Private
Limited is majorly in Agriculture and Allied Activities
business from last 18 years and currently, company
operations are active. Current board members &

Brief Facts of the Case:-


1.That Defendant (i.e.Sresta Natural Bio Products
Private Limited)representative Mr. Sanjeev (Manager
of Defendant Company) Kumar had visited Plaintiff
Mr. Sandeep Gupta Proprietor M/s Ganesh Enterprises
and appointed him as a Modern Trade distributor for
Defendant for the location of Ghaziabad, Noida, and
Greater Noida from November 2016.
2.That Plaintiff raised his Purchase order on
21st November 2016. Since 2016, Mr. Sanjeev (Manager
of Defendant Company) and their team have managed
to raise Purchase orders for different channels and
send the same to Plaintiff.

3.That after raising the order by Plaintiff. Items


(Products) are delivered to Plaintiff's godown from

Defendant(i.e., Sresta Natural Bio Products Private


Limited). From there, Plaintiff distributed the
purchase order raised by your team from different
locations and sent these products to different
channels through transport arranged from the open
market by Plaintiff.

4.That if the products are damaged during transit,


they are returned to Plaintiffs godown.

5.That if the products are expired at your


channels(different locations/stores), they are also
returned to Plaintiffs godown.

6.That after sometime these products were checked by


Defendant representatives. They make a NRGP slip in
which they mentioned the items(products) details
and they take the same damaged/expired products
from Plaintiffs godown to their warehouse. Their
representative and Plaintiffs signed the NRGP slip
before dispatch of damaged/expired products.
7.That On 04thJune 2018 Mr, Saikat (representative of
Defendant company) (Mobile:-7003060959) visited
Plaintiff's godown and prepared 4(four)NRGP (Non-
Returnable Gate Pass) sheets. Details of the same
is extracted and produced below.
The NRGP Sheets prepared by Mr. Saikat
(representative of Defendant company)
A)1st sheet of 636 pieces.
B)2nd sheet of 847 pieces.
C)3rd sheet of 497 pieces.
D)4th sheet of 710 pieces.
8. That after preparing the NRGP sheet of 2690 pieces,
it was duly signed by Defendant(i.e.Sresta Natural
Bio Products Private Limited) representative Mr,
Saikat (representative of Defendant company), and
by Plaintiff.

9. That as this was a regular practice by


Defendant(i.e.Sresta Natural Bio Products Private
Limited), Plaintiff never had to chase this
process. Month-on-month credit Plaintiff used to
get.

10. That NRGP sheet prepared by Defendant(i.e., Sresta


Natural Bio Products Private Limited)
representative Mr.Saikat (representative of
Defendant company), and by Plaintiff for July 2018
for Rs.177809/- get credited in Plaintiff's
account.
11. That as there is no mechanism for claims which were
raised through NRGP sheets prepared by
Defendant(i.e.Sresta Natural Bio Products Private
Limited), Plaintiff then started asking for his
June credit as a matter of abundant caution, then
Mr. Saikat (representative of Defendant company)
started making excuses and said, "Sir aap kyun
tension lete ho aapka refund aajaiga main baitha
huan aapke liye. Aap business par dhyan do. Aap
kisi choti moti company ke Saath kaam nahi kar rahe
ho our authorized share capital is Rs 200,000,000
and its paid up capital is 187,488,576. Itna toa
aapke national aur multinational companies ka bhi
nahi hoga jahan aap business karte raho. Our
company is committed to farmer satisfaction and
towards customer's as well. We are committed to our
product quality, and for our customer's health, we
can't compromise the quality of the products. We
dispose of all items/products picked from your
godown. We have a dedicated team for the disposal
of the product. Once we get confirmation, aapka
credit aa jaiga".

12. That with this assurance given by Defendant (i.e.,


Sresta Natural Bio Products Private Limited)
representative Mr, Saikat (representative of
Defendant company), Plaintiff got confidence that
he will get the credit sooner or later.
13. That Plaintiff, with Defendant's (i.e., Sresta
Natural Bio Products Private Limited) assurance,
diverted his mind on business and forgot the same
as Defendant representative assured him for the
credit of June 2018.

14. That Plaintiff was astounded when Mr Saikat


(representative of Defendant company) and Mr
Sanjeev (Manager of Defendant Company) left
Defendant (i.e., Sresta Natural Bio Products
Private Limited). They started not picking up
Plaintiffs phone. Then Plaintiff has apprehension
that Defendant(i.e., Sresta Natural Bio Products
Private Limited) is ignoring Plaintiff's call.

15. That from 2016 till 2019 Plaintiff did a business


of Rs 2.10 Crores and never raised any unnecessary
and undue claims from 2016 to 2019. But as per, the
statement of account and ledger book shows an
outstanding amount of Rs.2,21,000/- approx for 2690
pieces.

16. That Plaintiff then realize that there is something


dubious and visited Defendant(i.e.,Sresta Natural
Bio Products Private Limited)many times for credit,
but all in vain.

17. That Plaintiff has constantly been highlighting and


keeping the Senior Management in the loop for the
long overdue outstanding amount by Defendant, but
on one pretext or the other Defendant(i.e., Sresta
Natural Bio Products Private Limited), have not
paid the said outstanding amount to Plaintiff till
date and doubted Plaintiffs integrity.
