MOTION TO DEFER HEARING


OR TO CONDUCT HEARING
VIA VIDEO-CONFERENCE

Defendants spouses ADRIANO C. ALAO and RICHELDA E.


ALAO, by counsel, respectfully state:

1. The initial trial in this case is scheduled on 5 July 2022 at 8:30


in the morning.

2. On 26 May 2022, the Defendants filed a Motion for


Reconsideration regarding the Order of the Honorable Court dated 22 March
2022, which denied their Motion to Dismiss.

3. To date, Defendants have not received any order from the


Honorable Court resolving Defendants’ Motion for Reconsideration.
Considering that a favorable ruling on the Motion for Reconsideration would
render the hearing on 5 July 2022 unnecessary and considering further that
this Honorable Court had deferred the hearing last 17 May 2022 for that
specific reason, Defendants respectfully submit that the initial trial
scheduled on 5 July 2022 should again be deferred until such time that the
Honorable Court has resolved the pending Motion for Reconsideration.

4. In the event that the hearing on 5 July 2022 pushes through as


scheduled, Defendants respectfully request that undersigned counsel be
allowed to appear remotely through Microsoft Teams, as a health safety
measure against Covid-19 virus.

5. For the safety of the Honorable Court, the parties and the court
staff and pursuant to OCA Circular No. 67-2021 allowing fully remote
videoconference hearings, it is respectfully requested that undersigned be
allowed to attend the hearing on 5 July 2022 remotely via
videoconferencing.

6. This Motion is not intended to delay the proceedings or to cause


inconvenience to the court and the litigants, but solely for reasons above
stated

PRAYER

WHEREFORE, Defendants respectfully pray that the case be heard


via videoconference on 5 July 2022.

Other reliefs just and equitable under the premises are likewise
prayed for.
