EXPLANATORY NOTE
WHEREAS, Section 16 of the Local Government Code of 1991 provides that “every local
government unit shall exercise the power expressly granted, those necessarily implied
therefrom, as well as powers necessary, appropriate, or incidental for its efficient and effective
governance, and those which are essential to the promotion of the general welfare”.
WHEREAS, Section 17 of the said Code provides that “ local Government units shall likewise
exercise such other powers and discharge such other functions and responsibilities as are
necessary, appropriate, and incidental to efficient and effective provision of the basic services
and facilities enumerated under the Code, such as, but not limited to, those related to general
hygiene and sanitation, beautifica2tion, and solid waste collection.
WHEREAS, Section 153 of the said Code provides that “local government units may impose
and collect such reasonable fees and charges for services rendered”.
WHEREAS, consistent with RA No. 9003, also known as the Ecological Solid Waste
Management Act of 2000, SP Ordinance No. 3589-2010 or the Solid Waste Management Code
of Butuan City recognizes the vital role of the barangay in the successful implementation of the
Solid Waste Management Program, particularly in the segregation, collection, and recycling of
waste at source to substantively reduce the generation of waste.
WHEREAS, the imposition under this Ordinance were approved during the public hearing
conducted by the Sangguniang Barangay on March 2019.
SECTION 1. TITLE. This Ordinance may be known as the GARBAGE COLLECTION FEE
ORDINANCE OF BARANGAY 18-OBRERO, BUTUAN CITY.”
SECTION 2. SCOPE . This Ordinance shall govern the garbage collection fees within the
territorial jurisdiction of Barangay 18-Obrero, Butuan City.

SECTION 3. DEFINITION OF TERMS. To facilitate a better understanding of this Ordinance,
the following terms have been operationally defined:
2. Micro Enterprises - refers to an entity in the selling of goods and services with a capital of
not more than Php 50,000.00.
3. Small Enterprise -– refers to an entity in the selling of goods and services with a capital of
Php 50,001.00 to Php 250,000.00
4. Medium Enterprises – refers to an entity in the selling of goods and services with a capital
of Php 250,001.00 to Php 500,000.00
5. Large Enterprises – refers to an entity in the selling of goods and services with a capital of
Php 500,001.00 and above.
CATEGORY RATE
1. Residential Homes 20.00
2. Micro Enterprises (Capital of not more than 50,000.00) 30.00
3. Small Enterprises (Capital of 50,001.00 to 250,000.00) 100.00
4. Medium Enterprises (Capital of 250,001.00 to 500,000.00) 200.00
5. Large Enterprises (Capital of 500,001.00 and above) 300.00
SECTION 5. ROLE OF THE BARANGAY TREASURER – The fees hall be collected by the
Barangay Treasurer who shall in turn issue a corresponding receipt for every payment made.
SECTION 7. MATERIAL RECOVERY FACILITY (MRF)– all segregated wastes collected from
residential homes and business establishment shall be brought to the designated Material
Recovery Facility (MRF) of the barangay.
SECTION 9. TIME OF PAYMENT – The garbage collection fee shall be paid within the 1 st 20
days of each month or each subsequent quarter, as the case may be..
SECTION 10. SURCHARGE AND PENALTIES ON UNPAID FEES – The barangay shall
impose a surcharge of Twenty Five Percent (25%) of the amount of fees not paid on time at the
rate of Two Percent (2%) per month of the unpaid fees including surcharges, until the amount
is fully paid but in no case shall the total interest on the unpaid amount or portion thereof
exceed Thirty Six (36) months.
SECTION 11. SEPARABILITY CLAUSE – If for any reason, any provision, section or part of
this ordinance is declared not valid or unconstitutional, such judgement shall not effect or
impair the remaining provisions, sections or parts herein.
SECTION 12. REPEALING CLAUSE. All Barangay Ordinance , rules and regulations, or part
thereof, in conflict or inconsistent with any provisions of this Ordinance are hereby repealed,
amended or modified accordingly

SECTION 13. EFFECTIVITY. This Ordinance shall take effect after Ten (10) days following the
completion of its posting in a bulletin board at the entrance of the Barangay Hall and two other
conspicuous places in the Barangay.
