In case the above conditions are not met, the Contractor reserves the right to defer the date for the release of material and subsequent activities, and any additional cost arising there from shall be subject to the agreement of the parties before Contractor resumes work. In such an event, @ new Schedule will be established depending upon the ‘minimum installation period established in the offer and subject to availabilty. Installation works at the site shall only start on the satisfaction of the following conditions: + Completion of all activities as per the Installation Pre-requisites mentioned above, + Fuifiment of any payment obligation existing upon equipments arrival at site/warehouse. Contractor shall not be liable for any delay, or for any consequence of any delay, resulting from any force majeure event or any other cause beyond Contractor's control. Returns, Refund and Cancellation Policy Return Policy: It the product is delivered defective or damaged, the customer_needs to inform us through email (info@nibavifts.com) within 48 hours, The supplied lift/ part / iter must be unused by the customer and all items must be returned in their original condition, with price tags intact, user manual, warranty cards, original accessories and in’ the original manufacturer's box / packaging as delivered to you. ‘An invoice should be available. A request for reverse pickup willbe initiated from our end. Once the pickup is arranged our courier partner will collect the product within 3 business days. After receiving the product, a quality check will be done over the product by our team which takes 2 working days. If the product is found damaged / defective by our team, we will ry to arrange a replacement. However, it depends on the availability of the product. In exceptional cases, where our Logistic Service Provider doesn't provide a reverse pickup facility, the customer themself will have to send the product only through India post or any logistics agent to the below-mentioned address ‘once the reverse pickup request is raised, for which the cost shall be borne by NIBAV Lifts Pvt. If the order gets cancelled, owing to non- availabilty of space to fit the lift / not enough floor height to ft the head cylinder as ascertained by our technical team, after deducting the service charges the amount will be refunded to the customer based on the payment mode chosen by the customer at the time of placing the order. Every elevatorlescalator will be considered as individual equipment for payment purposes. the commencement of defects liability period, and free maintenance, if applicable, and final payment for each elevator /escalator will not be linked to any other elevatoriescalator of the group or the Contract. The contractor will be entitled to demand payment and commence a free maintenance period when each elevator! escalator is physically complete. The contractor will have the right to stop its installation for other units due to a delay in the final payment of the earlier elevatorlescalator. The contractor also has the right to change the delivery dispatch and installation schedule of the full projectf the payment is not received as per payment terms of the Contract Any delay arising from the above circumstances shall not be the responsibilty of the Contractor. B. In the event of non-payment of any progress claim, the Contractor reserves the right to suspend execution of the works until all progress claims due have been paid. In addition, the Contractor may sever any demountable equipment which has been incorporated into the works and remave it from the ‘Rottssite to reduce any potential damage suffered by breach of Customer's payment obligations. The Customer shall pay to Contractor on demand all costs, expenses, losses, and damage incurred by Contractor in exercising or consequent upon exercising such right. Should the suspension exceed 30 days, the Contractor shall be entitled to terminate land claim cancellation costs, General Liability: ‘The Customer agrees that he will not make use of any of the equipment or goods, in any way shape, or form, until such time as all works is properly handed over by the Contractor and the relevant handover documentation, provided.
