MAY IT PLEASE YOUR HONOUR:

1. That the Complainant through its Authorised Officer has

filed the Application Under Section 138 Negotiable
Instrument Act, 1881.

2. That Mrs. Carman Assumption could not appear before

this Hon’ble Court as she has been retired from service of
the Complainant and hence Mrs. Lata Lobo has been
appointed in her place to appear before this Hon’ble
Court.

3. That Mrs. Lata Lobo, Authroised Representative of

Complainant Bank is empowered and competent to sign
 and verify the complaint, affidavit, application, file
documents, as may be just necessary in the interest of the
Complainant Bank and to do all and every co-related acts
as may deem fit and proper in the interest of the
Complainant Bank in connection with the present case.
The copy of Authority Letter is annexed and marked as
Exhibit-A.

PRAYER

It is therefore most respectfully prayed before this Hon’ble Court that

the Authorized Officer of Complainant Bank be substiuted in the
interest of justice and her Authority Letter be taken on record.

I, Mrs. Lata Lobo, aged about __ years, Authorized Representative of

Complainant Bank, having address at UTI Building, 1st Floor, Plot No.
12, Road No. 11, Behind Tunga Paradise, MIDC, Marol, Andheri (East),
Mumbai-400093, do hereby state and declare on solemn affirmation
as under:

1. That I am the Authorized Officer of the complainant and I am

fully conversant with the facts of this case and as such
competent to swear the present Affidavit.

2. That the accompanying Application has been drafted by the

counsel under my instructions, the contents of which have
been read over and explained to me and I have acknowledged
 them to be true & correct as per my knowledge based on
records maintained by the Complainant.

3. That the contents of accompanying Application may be read as

part and parcel of the present affidavit which is not being
reproduced for the sake of brevity.
