GEOTHERMAL RESOURCES DEVELOPMENT
y©!åtR¥L hBT t-BöÂ lMè lአገሪቱ WHEREAS, it is necessary to ensure the
x!÷ñ¸ÃêEÂ ¥~b‰êE _QM XNÄ!h#M :DgT mêl#N conservation and development of geothermal resources
¥rUg_ አስፈላጊ bmçn#¿ for the social and economic benefit and growth of the
country;
y©!åtR¥L hBT x@l@KT¶K `YL ¥mN WHEREAS, it is necessary to ensure that the
=TN =Mé lአገሪቱ kFt¾ x!÷ñ¸ÃêE -q»¬ geothermal resources are utilized for the most
§§cW አገልግሎቶች mêl#N ¥rUg_ አስፈላጊ bmçn#¿ economically benefits of the country, including
electricity generation;
bmNG|TÂ bGl# zRF y¸µÿÇ y©!åtR¥L WHEREAS, putting in place the legal and
`YL ¥mN=T tGÆ‰TN y¸dGF y?G XÂ regulatory framework to support geothermal power

WHEREAS, it is essential to promulgate a

፪. TRÙ» Resources Development Proclamation No. 981/2016”.

bStqR bz!H xêJ WS_፦ In this Proclamation, unless the context otherwise
፩¼ “y©!åtR¥L |‰” ¥lT bz!H xêJ requires:
m\rT y¸s_ f”D y¸ÃSfLUcW 1/ “geothermal operations” means activities
tGÆ‰T ÂcW፤ requiring a license to be issued pursuant to this

Proclamation;

2/ “geothermal resources” means the natural heat

of the earth, neither mineral resources, water

resources or real property, but for the purposes

3/ “geothermal energy” means energy, in
h#n@¬ kmÊT gi(MDR b¬C y¸g" çñ
whatever form, exist below the surface of the
ktf_éxêE ymÊT ÑqT ytgß wYM
earth, resulting from, or created by, or which
ytf-r wYM kz!h# ytf_é ÑqT WS_
may be extracted from such natural heat;

፬¼ “y©!åtR¥L trf-MRT” ¥lT zYT½
4/ “geothermal by-products” means any mineral
y¦YDé µRïN UZÂ £l!yMN úY=MR
exclusive of oil, hydrocarbon gas, and helium
bm-N½ b_‰T wYM bt& K n!K rgD
but which are found in solution or in
l¥WÈT wYM l¥MrT xScU¶
association with geothermal steam and which,
bmçn# MKNÃT ‰úcWN ClW XNÄ
because of quantity, quality, or technical

difficulties in extraction and production, are not

of sufficient value to warrant extraction and

5/ “geothermal fluids” means those fluids
XNÍlÖTN xµè b¸g"bT kF¬ wYM associated with geothermal resources, including
_LqT Ñqt$ W¦ y¸f§bT dr© water, brines, and vapour, that have value by
ydrsM Yh#N k² b§Y XNÄ!h#M Ñqt$ virtue of the heat contained therein, whether or
not such fluids have a temperature that is the
ytgßW btf_éM Yh#N b¶x!NËK>N
boiling point of water or greater than the
kJåtR¥L hBT UR ytÃÃz fú> nW፤ boiling point of water at the altitude or depth of
the occurrence, and whether the heat contained
therein is naturally occurring or is transmitted
in fluids artificially introduced into an
underground formation;

y©!åtR¥L hBT ytgßbT wYM yhBt$ where geothermal resources have been
mg¾ XNdçn ¬Mñ bf”D sÀW discovered or is believed to be a source of
Æl|LÈN b?ZB ¥S¬wqEÃ ytsym geothermal resources and is so designated by
¥N¾WM mÊT nW፤ the licensing authority by public notice;
፯¼ “yNGD ማህበር” ¥lT bx!T×ùÃ yNGD ?G 7/ “business organization” shall have the meaning
yts-W TRg#M YñrêL፤ provide for under the Commercial Code of
Ethiopia;
፰¼ “dr© I y©!åtR¥L hBT” ¥lT yx@l@K 8/ Grade I geothermal resources” means a type of
T¶K `YL l¥mN=T B”T ÃlWÂ geothermal resources capable to generate

ሙቀትና ኃይል የመሣሠሉ xgLGlÖèC direct heating and combined heat and power;

9/ “Grade II geothermal resources” means a type

T¶K `YL ¥mN=TN ሣይጨምር የሙቀት of geothermal resources used for the purposes

፲¼ “xGÆB ÃlW xµL” ¥lT ሐረጉ yt-qsbT 10/ “competent body” means any government
DNUg@ bሚመለከተው g#ÄY §Y b?G organ empowered by law with responsibility
`§ðnT እና ሥልጣን የተሰጠው መንግሥታዊ and authority related to the subject specified in
the provisions in which the phrase is used;

!1¼ “x§qE :”ãC” ¥lT ለ©!åtR¥L |‰ 11/ “consumables” means anything may be utilized
y¸ÃSfLg#Â b©!åtR¥L |‰W wQT for geothermal operations and that is
b_QM §Y y¸Wl# wYM y¸tk# expendable or may be replaced during service
k@¸µlÖC½ ሲ¸NèN =Mé f”D sÀW such as chemicals, other items including
Æl|LÈN bmm¶Ã x§qE :”ãC BlÖ cement that the licensing authority may, by
y¸sY¥cW ÂcW፤ directive, designate as consumables;
02¼ “ሰnD” wYM “¶kRD” ¥lT yx@l@KTén!KS 12/ “document” or “record” means any writing or
{/#æCN wYM ¶kRìCN =Mé ¥N¾WM record, including electronic writings or records;
{/#F wYM ¶kRD nW፤
03¼ “möfR” ¥lT l©!åtR¥L |‰ y¸drG 13/ “drilling” means an operation in which a well is
yg#DÙD q$Íé nW፤ drilled for the purposes of geothermal

operations;

መኖሩንና የሀብቱን መጠንና የኢኮኖሚ ጥቅም 14/ “exploration license” means a license that gives

includes States where appropriate;

y¬wq y©!åtR¥L hBT KLል tBlÖ 18/ “known geothermal resource area” means an
area designated by the licensing authority by

09¼ “mÊT” ¥lT kmÊT b¬CM Yh#N b§Y
yNBrT xgLGlÖT mBT ወይም ጥቅም ytg 19/ “land” means any land under whatever tenure
ßbT በማንኛውም ዓይነት ይዞታ ሥር የሚገኝ held and any servitude, right or privilege in or

mgÂ¾ zÁ bz!H xêJ WS_ ytµtt$ substantive material addressed in this
mሠr¬êE g#Ä×Cን ይፋ ማድረግ ነው፤ Proclamation through widely accessible mass
media or electronic media;
@2¼ “yQ"T f”D” ¥lT አንድ ቦታ የጂኦተርማል
ሀብት ሊኖረው እንደሚችል ለማረጋገጥ ሲባል 22/ “reconnaissance license” means a license that

wYM mmlS UR btÃÃz# MKNÃèC licensee by an act, including expiration,

@8¼ “¥St§lF” ¥lT የ©!åtR¥L f”D ወይም 28/ “transfer” means a sale, encumbrance,

qM f”D” ¥lT y©!åtR¥L የሀብት license” means a license that gives right to

of the Federal Democratic Republic of Ethiopia.

4. Objectives
4. ›§¥ This Proclamation shall have the following

consumption and export;

3/ promoting the use of Grade II geothermal

resources for various uses;

4/ ensuring security of tenure for all investors in

05. yMRm‰ f”D 15. Exploration License
1¼ yBÒ yçn mBT y¸ÃSg" yMRm‰ f”D 1/ An exclusive exploration license shall be

upon approval by the licensing authority;

f”D License
1¼ ፈቃድ ሰጪው ባለሥልጣን yBÒ yçn mBT 1/ The Authority shall grant a license for an
y¸ÃSg" y©!åtR¥L g#DÙD mSK exclusive geothermal well-field development
y¥L¥TÂ ym-qM f”D የሚሰጠው የሚከ
and use to an applicant who satisfies the

following conditions:

h) bf”D sÀW Æl|LÈN tqÆYnT a) who has submitted work program,

from the licensing authority;

b) has acquired a valid power purchase

agreement;
/) y¬sbWN |‰ bqrbW y|‰ PéG‰M c) has demonstrated financial capability or
m\rT l¥kÂwN y¸ÃSCL ygNzB access to the financial resources and the
xQMÂ xSf§g!W yt& Kn!K ClÖ¬ ያlW technical ability to conduct the proposed
wYM l¥GßT y¸CL mçn#N ላrUg-፤ exploration in accordance with the

approved work program;
m) ከዚህ በፊት የጂኦተርማል ሥራ f”D d) is not in breach of any obligation of a
ynbrW kçn yz!Hn# f”D GÁ¬ãC geothermal operation license, if any.
ላLÈsÝÝ
2¼ የጂኦተርማል ጉድጓድ መስክ የማልማትና 2/ A geothermal well-field development and use
የመጠቀም ፈቃድ በፈቃዱ ላይ ለተገለፀው ጊዜ license shall be valid for an initial period
ፀንቶ ይቆያል፤ ሆኖም ይህ ጊዜ ከሃያ አምስት specified in the license; and such period shall
not exceed twenty five (25) years.
(፳፭) ዓመት በላይ ሊሆን አይችልም።
3¼ y©!åtR¥L g#DÙD mSK y¥L¥TÂ ym- 3/ When the validity period of the geothermal
qM f”ድ ጸንቶ የሚቆይበት ጊዜ ሲያበቃ well-field development and use license expires,
መንግሥት በሚመቸው መንገድ y©!åtR¥L Government may continue the development of
ሀብት ልማቱን ሊያስቀጥል ይችላል፡፡ the geothermal resource as it finds feasible.

4¼ y©!åtR¥L g#DÙD mSK y¥L¥TÂ ym- 4/ A geothermal well-field development and use
qM Ælf”D በdr© I ጂኦተርማል ሀብት ላይ licensee shall have the right to undertake power
y`YL ¥mN=T tGÆRN BÒ y¥µÿD generation activities on Grade I geothermal
wYM btÙÄ" _QM §Y yêl y©!åtR¥L resources, either as a standalone operation or
hBTN l‰s# ym-qM wYM b>Ã+ combined with sale of used geothermal
mንግስት XNÄ!-qMbT y¥DrG mBT resource for direct use by Government, or for
xlWÝÝ self-use.
5¼ አግባብነት ያላቸውን የኢነርጂ ሕግ ድንጋጌዎች 5/ A geothermal well-field development and use
y¸Ãà§Â በdr© I ጂኦተርማል ሀብት ላይ licensee who qualifies for power generation

y©!åtR¥L g#DÙD mSK y¥L¥TÂ ym- be granted a license to generate electricity upon
qM Ælf”D lf”D sÀW Æl|LÈN application to the licensing authority, provided
¥mLkÒ s!ÃqRB x@l@KT¶K l¥mN=T that the licensee demonstrates compliance with
f”D Ys-êLÝÝ the relevant provisions of the Energy Law.
6¼ በdr© I የጂኦተርማል ሀብት ላይ y©!åtR¥L 6/ The holder of a geothermal well-field
g#DÙD mSK y¥L¥TÂ ym-qM Ælf”D development and use license on a Grade I
በሀገሪቱ የኢነርጂ እና የኢንቬስትመንት ሕግ geothermal resource shall have the obligation to

g#DÙD mSK y¥L¥TÂ ym-qM f”D competitive basis for a known geothermal
lmS-T b¸ÃSCL dr© y©!åtR¥L resource area, where exploration activities have
hBT mñ„ ytrUg- y¬wq y©!åtR¥L been conducted for the area at least to the level
of test drilling and the existence of geothermal
hBT KLLN b¥wÄdR y©!åtR¥L g#DÙD
resources have been confirmed to the degree
mSK y¥L¥TÂ ym-qM f”D l!s_
sufficient to grant a well-filed development and

use license.
2¼ f”D sÀW Æl|LÈN ytwsnN KLል 2/ If the licensing authority receives an
y¸mlkT yMRm‰ f”D ¥mLkÒ application for an exploration license for an

of revocation of the previous license.
@. Sl|‰ PéG‰M 20. Work Program
1¼ ¥N¾WM ›YnT f”D XNÄ!s-W y¸Ã 1/ Any person lodging application to obtain any
mlKT sW k¥mLkÒW UR የሥራ type license shall submit his application

3¼ b¥N¾WM y|‰ PéG‰M §Y lW_ 3/ Any application for variation shall:

wYM Bk§N mk§kL b¸ÃSCL with the applicable laws pertaining to

/) l©!åtR¥L |‰W xSf§g! yçnÂ c) ensure that all employees have received

\‰t®C TMHRTÂ |L-Â Ãgß# consistent with best practices generally

#7. Sl µœ 37. Compensation

¥N¾WM y©!åtR¥L |‰ l¥kÂwN mÊTN Where any geothermal operation requires the
¥SlqQ y¸-YQ Ælf”ድ l¸lqqW expropriation of land, the licensee shall pay
ymÊTÂ NBrT ÆlYø¬ ለሕዝብ ጥቅም mÊT compensation to the expropriated land use and
y¸lqQbTNÂ lNBrT µœ y¸kfLbTN property in accordance with the payment of
h#n@¬ãC lmwsN bwÈ xêJ m\rT µœ compensation for expropriation of property for
mKfL xlbTÝÝ public interest Proclamation.

38. Environmental and Social Impact Assessment

1¼ ¥N¾WM y©!åtR¥L |‰ Ælf”D 1/ Any holder of a geothermal license shall be
l|‰W y¸ÃSfLg#Â bidqW y|‰ PéG exempted from customs duties and taxes
‰M m\rT kW+ xgR wd x!T×ùÃ including value added tax for importing into
y¸ÃSgÆcW x§qE :”ãC½ mœ¶ÃãC½ Ethiopia any consumables, equipment,
¥>n¶ãCÂ t>kRµ¶ãC t=¥¶ :s@T machinery and vehicles required for his
¬KSN =Mé kg#M„K qr_Â ¬KS nÉ operations in accordance with the approved
YçÂl#ÝÝ work program.
2¼ ¥ÂcWM bz!H xNq{ m\rT kg#M„K 2/ Any item imported into Ethiopia free of customs
qr_Â ¬KS nÉ çñ ygÆ :” f”D sÀW duties and taxes pursuant to the provisions of

WHEREAS, it is essential to promulgate a

compensatory arrangements, if any.

çN BlÖ ያቀረበ wYM f”D sÀW false information or knowingly failed to

xlbTÝÝ budget, and discharge payment of fee, if any.

ሆኖ ከተገኘ ተቀብሎ ÃiDqêL¿ wYM convinced with the variation; or

ዕቅድ m\rT bf”Ç ytzrz„ y©!åt conducting activities specified in the

l¥kÂwN wd f”D KLL ymGÆT ፤ accordance with approved work program

m\rt L¥èCN ymzRUTÂ ymgNÆT geothermal resources operations and erect,

XNÄ!h#M XNdxSf§g!nt$ ÍB¶µãCNና construct and maintain such plant, machinery,

¥>n¶ãCN መትከል ?NÉãCNÂ l@lÖC buildings and other erections as may be

yGNÆ¬ ¥:DÂT ym-qM ፤ essential physical infrastructure within the

T¶K አገልግlÖT §Lçn tGÆR bf”D requirement of geothermal resources on Grade I
