MAGNA CARTA

Section 1: This section is all about Declaration of Policy, primarily to improve the social and economic
status of teachers and of the teaching profession, the living and working conditions and also to ensure
that teaching will be comparable to other professions. It means that teaching profession should not
belittled by others but should be considered as respectable and comparable to other professions
because in reality, there is no inferior profession and all profession are equal because their contributions
varies differently in the nation. Moreover, the purpose of this section is also to attract and retain
qualified teachers.

Section 2: The Magna Carta tells us that this act. Covers all teachers in public elementary and secondary
schools. At the same time, Magna Carta also tells us that those everyone who is engage in the
classroom teaching whether full time or part time basis are covered by the act. The Guidance
counselors, school librarians, industrial of vocational schools are also covered by the act. And the act
also covers those who are performing supervisory or administrative functions like the principals, head
teachers and supervisors. And this Magna Carta does not cover other school personnel like the school
nurses, school physicians, school dentist and the other school employees.

Section 3: This section is all about Recruitment and Qualification. The act tells us that those who would
be teaching in the Kindergarten and Elementary should have Bachelor in Elementary Education degree
major in General Education or in Preschool education. And the act also say that those who are teaching
in the secondary should be graduate of Bachelor in Secondary Education with appropriate field of
specialization. For those teachers who will be teaching from other areas they are allowed to teach in the
secondary school provided that they have 18 units of Professional Education. Subjects. Moreover, for
those who are teaching in the tertiary levels in State Universities or Colleges should have Master’s
Degree.

Section 4: This section is all about Probationary Period. There is called regular appointment and
provisional appointment of Magna Carta. Those who will be given regular appointment must be Civil
Service eligible, must have training and professional preparation in any school specifically schools that
are recognized by the government. And those who have minimum educational qualification and no Civil
Service Eligibility would still be employed but they are only given 1 year of probation and 1 year to be
qualified. Furthermore, as of now, as long you have the license and as along you passed through ranking
process then you will be given an item. And if you are given and item then you would be automatically
considered as a permanent teacher.

Section 5: Section 5 tells us that the Security of Tenure is guaranteed and the Magna Carta says that
those who are in provisional status will become permanent if they are able to sever for 10 years but if
you do not have the license to teach and you are not eligible to teach, you will not be given an item. But
in the Senior High School those who are still not secure in their license they are given an item to teach
but they are given 5 years to qualify themselves. However, if they did not get their qualification and
license in that span of time, they cannot continue their permanent status and should rehired.

Section 6: Is all about the Consent for Transfer. Teachers are allowed to be transferred on his locality but
no transfer should be done if the teacher does not agree. Transfer must be with teachers consent and
you are not allowed to be transferred in your locality in less than 3 months from National or Local
Election and everything that you will spend in your transfer would be shouldered by the Department of
Education.

Section 7: This section is all about the Code for Professional teachers. This would tell us that for public
school teachers should have to abide the codes under the code of ethics and you must have the copy of
the code.

Section 8: This section is all about Safeguards in Disciplinary Procedures. It says there that every teacher
shall enjoy equitable safeguards at each stage of any disciplinary procedure. And in case the teacher
undergo a disciplinary procedure, then the teacher has the right to be informed in writing of the
charges, the right to full access of the evidence of the case, the right to defend himself and to be
defended by a witness and the teacher has right to prepare for the defense, and at the same time, the
teacher has the right to appeal to designated authorities specially if the teacher’s conscience is really
clear that he could prove his innocence and no publicity shall be given during the pendency of case.
