JOINT AFFIDAVIT OF ARREST

We, PSSG DARWIN RAPATAN y ROBREDILLO AND PSSG SAMUEL CALO y

BIBAT, all of legal age, and residents of Dolores, Eastern Samar, having been sworn to an oath
in accordance with law, do hereby depose and say THAT:

1. We are regular members of Philippine National Police currently assigned at Dolores

Municipal Police Station, Dolores, Eastern Samar;

2. On February 25, 2022 at about 3:30 in the afternoon, we were performing our duty at
Dolores Municipal Police Station when a concerned citizen came and informed the
office regarding the rampant illegal gambling activity (Tong-its) in Sitio Darahuway
Brgy Magongbong, Dolores, Eastern Samar;

3. After receipt of the information, Police Major Aldwin Alea Ballete, Acting Chief of
Police of Dolores Municipal Police Station organized a team to conduct intel driven
and at the same time monitoring at Sitio Darahuway to monitor the said report on
rampant of illegal gambling Tong-its.

4. That at about 8:30 PM of same date, upon the confirmation of the Confidential
Informant on said illegal activity Thus, a 7-man team was composed thereof.
Subsequently, the team went to the area;

5. Upon arrival at the place at about 9:00 o’clock in the evening of even date, we
noticed that three person caught in the act engaging illegal gambling on card games
locally known as Tong-its’ on the veranda of the house , we immediately ran to them
and immediately, they were arrested;

6. I, PSSg Calo, informed the suspects that they were arrested for violation of
Presidential Decree No. 1602. I, PSSg Calo likewise informed the suspects their
constitutional rights and other rights in a language known to and understood by them;

7. The Three (3) arrested persons identified themselves as follows:

 Benilda Baldemero y Globio 53 years old married a helper and a resident of

Barangay Magongbong, Dolores, Eastern Samar;
 Renaldo Galo y Pomarca, 52 years old with live in partner laborer and a
resident of Barangay Magongbong, Dolores, Eastern Samar;
 Noel Badiola y Guitoria 23 years old with live in partner a laborer and a
resident of Barangay Magongbong, Dolores, Eastern Samar;

8. Recovered from the possession and control of the suspects were as follows:

 Two hundred thirty pesos (P220.00) bet money;

 One (1) set of Playing Cards ;

9. Thereafter, we brought the suspects and recovered items to Dolores Municipal Police
Station for documentation, and filing of appropriate charges;

10. We are executing this joint affidavit to attest the veracity of the foregoing statements and
to file a case for violation of Section 1 of P.D. 1602 Illegal Gambling against Benilda
Baldemero y Globio, Renaldo Galo y Pomarca Noel Badiola y Guitoria, before the
Office of the Provincial Prosecutor (Sub-Office), Dolores, Eastern Samar.
 IN WITNESS WHEREOF, we will affix our signatures below this 25th day of February
2022 at Dolores Municipal Police Station, Dolores, Eastern Samar, Philippines.
