I. RATIONALE

Pursuant to Republic Act No. 9710, Sec.36 of Chapter VI provides that all departments
including different agencies, offices and other government instrumentalities shall adopt gender
mainstreaming as a strategy to promote women’s human rights and eliminate gender
discrimination in the systems, policies, thrusts and programs.
Gender and Development (GAD) is defined as a participatory and empowering
development perspective and process that is equitable, sustainable, free of violence, respectful of
human rights, and supportive of self-determination and the actualization of human potentials. It
strives for gender equality as a fundamental value that should be reflected in development
decisions, and it contends that women are active agents of development rather than passive
recipients of development.
GAD is based on the premise that development benefits everyone. Everyone in society,
male or female, has the right to equal opportunities for a full and fulfilling life.
The Safe Space Act of 2019 is one Philippine law that falls under the purview of GAD.
On April 2019, the Safe Spaces or Anti-Bastos Law was enacted which seeks to protect any
person from gender-based sexual harassment in public spaces. The law aims to fill many gaps left
by the previous legal framework's coverage of sexual harassment, as well as to promote gender
equality in which people are free from duress and any kind of external pressure while going about
their daily lives.
According to the Safe Spaces Act, schools are required to provide a gender-sensitive
environment as well as a confidential mechanism for reporting and resolving grievances on
matters of sexual and gender-based harassment; thus, Emiliano Gala Elementary School would
like to equip its faculty with legal knowledge.
