SUBJECT: Delinquency Report System


(Strengthening the Disciplinary Authority of Chief of Office)
1. REFERENCES:

a. NCRPO Decorum Handbook 2012;

c. NMC No. 2010-003 “Establishing a Delinquency Reporting System in the
PNP and Institutionalizing Community Service as an Integral Component
Thereof” dated September 30, 2010
d. NMC No. 2007-001 “Uniform Rules of Procedure Before the Administrative
Disciplinary Authorities and the Internal affairs Service of the PNP” dated
March 6, 2007; and
e. R.A. No. 6975 as amended by R.A. No. 8551 dated February 25, 1998, and
further amended by RA No. 9708.

2. RATIONALE:

The current issue on disciplinary mechanism is the increasing number of pending


administrative cases filed against PNP personnel both uniformed and non-uniformed.
Based on the review of the statistics on administrative cases one-third of the dockets
are minor offenses which can be resolved immediately by the Chief/Head of Office.

A review of the disciplinary policies, the Chief/Head of Office is one among the
enumerated disciplinary authorities who can hear and decide administrative cases
(Citizen’s Complaint and breach of Internal Discipline) with imposable penalty of
withholding of admonition, reprimand, privileges, restriction to specified limits,
suspension or forfeiture of salary or any combination thereof, for a period not exceeding
15 days.

In view of enhancing the disciplinary authority of the Chief/Head of Offices, the


proposed modified Delinquency Report System (DR System) should be adopted to
respond with the demands for immediate or on the spot corrections of misdemeanors or
minor infractions committed by PNP personnel without need of full blown hearing or
summary proceedings.

3. MISSION:

The PNP shall modify and institutionalize the Delinquency Report System to
every unit/office in order to enhance the disciplinary authority of the Chief/Head of Office
and to facilitate the disposition of minor offenses as defined in NMC No. 2007-001 dated
March 6, 2007.

4. DEFINITION OF TERMS:

a. Administrative Officer – refers to the respective Administrative Officer of


every police unit, Municipality or City Police Stations or Police District Offices, Regional
Police Offices, up to the Directorate, National Headquarters, Command Group and the
National Support Units;

b. Chief/Head of Office – shall refer to the highest ranking PNP Officer-in-


command of the PNP office/unit;

c. Delinquency Report – refers to a report which contains the minor


infraction(s) committed by the police personnel, the format of which is prescribed in this
Circular;

d. Demerit – a mark in numerical value made against a police personnel


committing a minor infraction, the list of minor infraction with corresponding demerits is
provided in this Circular;

e. Discipline – pertains to obedience to orders, policy, rules and regulations


and performance of appropriate actions in the absence of orders;

f. DR Forms – pertains to the document issued by Administrative Officer to


offenders where his/her minor infraction is specified which requires the offender to write
his/her explanation on the space provided in the DR form;

g. Explanation – an answer in writing executed by the offender, confirming or


reputing the infraction reported against him;

h. Minor Infractions – acts or omissions committed by a police personnel


whether during office hours or beyond, as far as practicable as included in the list
appearing in this Circular; and

i. Offender – refer to PNP personnel who committed minor infraction.

5. EXECUTION:

a. Concept of Operations

In line with the concept of enhancing the disciplinary authority of the


Chief/Head of Office, this Memorandum Circular shall cover minor offenses/infractions
such as acts or omissions affecting internal discipline of the PNP. There will be three
phases of implementing the DR System. The first phase is the Reporting Phase wherein
the Chief Clerks or any person may submit a report or any documents regarding the
alleged offense committed by the PNP personnel. The second phase is the Evaluation
and Deliberation Phase which shall require presentation of submitted explanation and
determination of the merits of explanation. The third phase is the Execution Phase
which pertains to disposition of the offense and the implementation of the sanction
rendered during evaluation.

1) Reporting Phase

a) All D-Staff/P-Staff/PROs/NSUs/Head of Office shall include the


presentation of reported delinquencies committed by respective personnel in the
agenda of the Staff Conference;

b) All ADMO/RPHRDD/RPMD/ARMD shall present in matrix form all
reported offenders, the facts surrounding the minor infractions and the submitted
explanation with evidence if warranted;
c) Any reports or complaints filed by any person regarding minor
infraction committed by PNP personnel shall be recorded by the admin office;
d) The Chief Clerk of ADMO/RPHRDD/RPMD/ARMD shall issue DR
form which contains the date, time and specific infractions/minor offenses committed
and requires the offender to write therein in the space provided his/her explanation
which shall be submitted within 24 hours from notice; and
e) All accomplished DR forms within the week shall be consolidated
and be presented during the next scheduled Staff Conference.

2) Evaluation and Deliberation Phase

a) All ADMO/RPHRDD/RPMD/ARMD shall enumerate specifically the


minor offenses committed by the offenders and their explanation within their office/unit;
b) The Staff shall evaluate the minor infractions committed, the merits
of the explanation presented;
c) The Staff shall determine the appropriate number of demerits be
rendered according to the demerits system;
d) All demerits shall be summarized and sanction shall be issued
according to the maximum number of demerits recorded to each offenders; and
e) Orders shall be issued for the implementation of the sanction.

3) Execution Phase

a) All ADMO/RPHRDD/RPMD/ARMD shall schedule the execution of


the sanction to be served by the delinquent personnel;
b) All ADMO/RPHRDD/RPMD/ARMD shall monitor the performance
of the sanctions given to delinquent personnel;
c) All PNP personnel sanctioned thru DR System shall participate in
the scheduled execution of the sanction;
d) All the orders as well as the certificate of implementation of
sanction shall be submitted to DPRM (Attn: DLOD) for inclusion in the red flag
information of delinquent personnel under the PNP Personnel Clearance System; and
e) All ADMO/RPHRDD/RPMD/ARMD shall submit reports of DR

System every 5 day of the month.

b. Tasks

1) DPRM
- Shall be the OPR of this MC on Delinquency Report System;
- Shall draft disseminate and monitor the implementation of this
MC on Delinquency Report System;
- Shall establish database through PNP Personnel Clearance
System of all reported and sanctioned delinquent personnel;
and
- Perform other task as directed.

2) D-Staff/P-Staff/PROs/NSUs
- Shall implement the DR System;
- Shall include in the Staff Conference the DR System;
- Shall submit reports to DPRM on the sanctioned delinquent
personnel; and
- Perform other task as directed.

6. COORDINATING INSTRUCTIONS:

a. Demerit System – The infractions and their corresponding demerits are listed
hereunder:

• The maximum allowable demerits shall be fifteen (15) demerits per month or 90 demerits per
semester. One demerit in excess of the allowable number shall be equivalent to one (1) hour of
community service.

a. Unauthorized or improper wearing of uniforms; insignias and accoutrements;
b. Unauthorized haircut;
c. Dirty shoes;
d. Dirty uniform; 5

g. No hanky/tickler/Miranda warning card (as required during inspection); and
h. Other similar minor infractions.
2.Tardiness in reporting for duty/office work; 5

4. Smoking in places not designated as “smoking area”; 5
5. Violation of traffic, pedestrian and parking regulations; 5
6. Use of vulgar or insulting languages or exhibit similar rudeness to the public; 7
7. Spitting or littering in public areas; 7
8. Urinating in places other than the designated areas (restroom, public urinating 10
area);
9. Leaving post for more than two (2) minutes; 15
10.Dozing on post; 15
11. Failure to initiate actions on complain; 15
12. Absent in formation and or any command activities; and 20
13. Other similar minor infractions. Minimum – 5

b. Sanctions – all offenders committed the above minor infractions shall be


given sanction according to the following graduations:

1) Minimum of 5-10 demerits/week – cleaning duty within the office/camp


premises with garbage disposal;
2) Medium of 11-15 demerits/week – deduction of one day from the unused
mandatory leave or service leave; and
3) Maximum of 16-20 demerits/week – deduction of three days from the
unused mandatory leave or service leave.

c. All personnel with exceeding 20 demerits per week shall be subjected to
Pre-Charge Evaluation and Summary Hearing Proceedings in accordance with the
NMC 2007-001 for uniformed personnel and RRACCS for non-uniformed personnel.
d. All records of minor infractions of PNP personnel shall be recorded in the
PNP Personnel Clearance System which shall be reflected in the PAIS record.

7. RESCISSION:

All existing PNP directives and other issuances which are contrary to or
inconsistent with this directive are hereby rescinded or modified accordingly.

8. SEPARABILITY CLAUSE:

Any portion of this Memorandum Circular inconsistent with the organic law or
declared unconstitutional shall not affect the validity of other provisions.

9. EFFECTIVITY:

This circular shall take effect upon the filing of a copy hereof with the Office of
National Administrative Register (ONAR), UP Law Center pursuant to Sections 3 and 4
of the Administrative Code of 1987.
