Grievance Description

Sir, this is in reference with the position of Head Safety in GHAVP getting vacated shortly upon retirement of present safety head in
February 2021. I find it an exciting opportunity which could give me a greater scope of learning and deal with day to day challenges
encountered in Project Sites. Also Sir, I do fulfil the “minimum qualification criteria” for the position of Head Safety in Projects as
stipulated by AERB i.e. a Graduate Engineer with a one year diploma in Industrial Safety from RLI/CLI. Sir, with deep sorrow I have to
state that I find it discriminatory being asked to continue in same position seeing other under qualified person designated to higher
position.

Also sir AERB has time and again endorsed the requirements stated in their Guideline No. AERB/NRF/SG/IS-1 (Rev. 1) titled “Control of
works” i.e. the required qualification for designating a person as “Head Industrial Safety” in Projects, person must hold a degree in
engineering/ technology and a diploma in industrial safety. Also sir, we already know that consequent to a fatal accident in KKNPP in
2019, AERB had reiterated the requirements and NPCIL had reaffirmed the commitment to suitably designate Safety Heads in Projects,
and a reshuffling of Safety Heads was also done then to immediately meet the requirement.

Sir, it is very painful to share that my “Grievance” and “Appeal” (raised via GRAMS module of NPCIL) have been closed without giving
correct reasons. Grievance was closed (instead of forwarding) at site level stating that site management does not have authority to
appoint Head (Safety). And Appeal was closed stating that it is a matter of “promotion” which is excluded from Grievances. No
consideration has been given to the fact that an under qualified person is being designated as Head (Safety) in GHAVP when already a
“qualified and interested” person is readily available in NPCIL. Please understand that it is not a matter of promotion but an unfair
treatment where an undue favour is being given to one employee over another.

Link to CPGRAMS in HQ webpage has been provided but access has not been given to all employees. And even after writing to
DGM(HR), Kaiga Site and his seniors in HQ about 10 days back no reply has been received.

Sir, HQ has all the authority and responsibility to depute officials commensurate to their eligibility and regulatory obligations. Sir, your
kind intervention is requested for deputing appropriate Safety Head in above project. I look forward for due consideration of my
request for the opportunity. Given the opportunity to work in above Project I will work with utmost sincerity and highest enthusiasm.

Sir, as qualification is considered above seniority and no question of seniority arises til person is qualified. Hence, it is not a matter of
seniority, it is a matter of qualification. AERB has stated a minimum qualification for the post of Head Industrial Safety in construction
projects. Therefore considering a person for this post who does not fulfil the bare minimum criteria stipulated by AERB and neglecting
the readily available qualified and interested person is unfair and a kind of giving undue favours to one employee over another.
NPCIL
has closed the grievance thrice (Departmental GRAMS, GRAMS Appeal and CPGRAMS) citing irrelevant clauses and misleading
comments. Last time CPGRAMS was closed mentioning Rule 43 (5) of AEFR, 1996 which provides qualification criteria for Safety
Officers (whereas grievance is about post of Head Industrial Safety). In fact AEFR does not mention qualification of Head Industrial
Safety anywhere. This gap has been filled by providing same in another document viz. Safety Guideline No. AERB/NRF/SG/IS-1 (Rev. 1)
which is again issued by AERB.
Sir, AEFR and above Safety Guideline both have been issued by AERB. In order to prevent inappropriate
closure of this appeal, I request you to kindly route the grievance via AERB itself to obtain neutral inference of clauses in these
legislations.
