THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

COREY KELLER, KELLY BUSH, BETTY JABLONKSKI, AND MARK BUSH with the

crime of ENTERPRISE CORRUPTION in violation of Section 460.20(1) of the Penal Law of

the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about and between October 20,

2021 and June 14, 2022, in Yates County, Monroe County, Schuyler County and Chemung

County, having knowledge of the existence of a criminal enterprise and the nature of its activities,

and being employed by or associated with such enterprise intentionally participated in the affairs

of an enterprise by participating in a pattern of criminal activities: (see Addendum)

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

COREY KELLER, KELLY BUSH, BETTY JABLONKSKI, MARK BUSH AND

CHRISTOPHER GOLDEN with the crime of GRAND LARCENY IN THE SECOND

DEGREE in violation of Section 155.40(1) of the Penal Law of the State of New York, as

committed as follows:

The defendants, acting in concert with each other, on or about between October 20, 2021

and March 10, 2022, in Yates County, Monroe County, Schuyler County and Chemung County,

did steal property and the value of that property exceeded fifty thousand (50,000) dollars.

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

KELLER, KELLY BUSH, BETTY JABLONKSKI, MARK BUSH AND CHRISTOPHER

GOLDEN with the crime of CONSPIRACY IN THE FOURTH DEGREE in violation of

Section 105.10(1) of the Penal Law of the State of New York, as committed as follows:

The defendants, acting in concert with each other, on or about and between October 20,

2021 and March 10, 2022, in Yates County, Monroe County, Schuyler County and Chemung

County, with the intent that conduct comprising a class B or class C felony be performed, he or

she agreed with one or more persons to engage in or cause the performance of such conduct; to

wit Grand Larceny 2nd.

GOLDEN with the crime of CONSPIRACY IN THE FOURTH DEGREE in violation of

Section 105.10(1) of the Penal Law of the State of New York, as committed as follows:

The defendants, acting in concert with each other, on or about and between October 20,

2021 and March 10, 2022, in Yates County, Monroe County, Schuyler County and Chemung

County, with the intent that conduct comprising a class B or class C felony be performed, he or

she agreed with one or more persons to engage in or cause the performance of such conduct: to

COUNT FIVE

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

COREY KELLER, with the crime of OFFERING A FALSE INSTRUMENT FOR FILING

IN THE FIRST DEGREE in violation of Section 175.35(1) of the Penal Law of the State of New

York, as committed as follows:

The defendants, acting in concert with each other, on or about January 4, 2022 in Schuyler

County, knowing that a quarterly sales and use tax return, a written instrument, contained a false

statement or false information, and with intent to defraud the State or any political subdivision,

public authority or public benefit corporation of the state, he/they offered or presented it to a

public office, public servant, public authority or public benefit corporation with knowledge or

belief that it will be filed with, registered or recorded in or otherwise become a part of the records

of such public office, public servant, public authority or public benefit corporation.

COUNT SIX

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

COREY KELLER, with the crime of FALSIFYING BUSINESS RECORDS IN THE FIRST

DEGREE in violation of Section 175.10 of the Penal Law of the State of New York, as committed

as follows:

The defendants, acting in concert with each other, on or about January 4, 2022, in Schuyler

County, with the intent to defraud, he/they made or caused a false entry in the business records of

the New York State Department of Taxation and Finance, and when the intent to defraud included

the intent commit another crime or to aid or conceal the commission thereof.
COUNT SEVEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

KELLER, KELLY BUSH, BETTY JABLONKSKI, MARK BUSH AND CHRISTOPHER

GOLDEN with the crime of CRIMINAL TAX FRAUD IN THE SECOND DEGREE in

violation of section 1805 of the Tax Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about between October 20, 2021

and March 10, 2022, in Yates County, Monroe County, Schuyler County and Chemung County,

committed a tax fraud act or acts and, with the intent to evade tax due, or to defraud the state or any

political subdivision of the state, by means of underpayment during a period of not more than one

year, paid the state in excess of fifty thousand dollars less that the tax liability that was due.

violation of section 1817(a) of the Tax Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about between December 22, 2021

and March 10, 2022, in Yates County, were required to obtain a certificate of authority, and without

possessing a valid certificate of authority, willfully sold tangible personal property subject to tax.

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

SALES AND COMPENSATING USE TAXES in violation of section 1817(a) of the Tax Law

of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about between December 29, 2021

and March 10, 2022, in Chemung County, were required to obtain a certificate of authority, and

without possessing a valid certificate of authority, willfully sold tangible personal property subject

to tax. |

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

KELLER, AND CHRISTOPHER GOLDEN with | the crime of SALES AND

COMPENSATING USE TAXES in violation of section 1817(a) of the Tax Law of the State of

New York, committed as follows:

The defendants, acting in concert with each other, on or about between January 10, 2022

and March 10, 2022, in Monroe County, were required to obtain a certificate of authority, and

without possessing a valid certificate of authority, willfully sold tangible personal property subject

to tax.

COUNT ELEVEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

COREY KELLER, KELLY BUSH, BETTY JABLONKSKI, MARK BUSH, AND

CHRISTOPHER GOLDEN with the crime of CRIMINAL POSSESSION OF CANNABIS

IN THE FIRST DEGREE in violation of Section 222.40(1) of the Penal Law of the State of

New York, committed as follows:


The defendants, acting in concert with each other, on or about March 10, 2022, in Yates

County, Monroe County, Schuyler County and Chemung County, did knowingly and unlawfully

possess cannabis and such cannabis weighed more than 10 pounds. To Wit: Fat Daddy’s 112

pounds; Corey Keller 23.3 pounds; Jamie Walker 16.9 pounds; Betty Jablonski and Mark Bush

58.1 pounds; Kelly Bush 10.5 pounds; Christopher Golden 22.11 pounds.

COUNT TWELVE
THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

COREY KELLER, KELLY BUSH, BETTY JABLONSKI, MARK BUSH, AND

CHRISTOPHER GOLDEN with the crime of CRIMINAL POSSESSION OF CANNABIS

IN THE FIRST DEGREE in violation of Section 222.40(2) of the Penal Law of the State of

New York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Yates

County, Monroe County, and Schuyler County, did knowingly and unlawfully possess

concentrated cannabis and such concentrated cannabis weighed more than four pounds.

COUNT THIRTEEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

with the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE in

violation of Section 265.02(7) of the Penal Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Chemung

County, did possess an assault weapon.


COUNT FOURTEEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

with the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE in

Violation of Section 265.02(8) of the Penal Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Chemung

County, did possess a large capacity ammunition feeding device.

COUNT FIFTEEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

with the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE in

violation of Section 265.02(8) of the Penal Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Chemung

County, did possess a large capacity ammunition feeding device.

COUNT SIXTEEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

with the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE in

violation of Section 265.02(8) of the Penal Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Chemung

County, did possess a large capacity ammunition feeding device.


COUNT SEVENTEEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

with the crime of CRIMINAL POSSESSION OF A WEAPON IN THE SECOND DEGREE

in violation of Section 265.03(3) of the Penal Law of the State of New York, committed as

follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Chemung

County, did possess a loaded firearm.

COUNT EIGHTEEN

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE in

violation of Section 265.02(7) of the Penal Law of the State of New York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Chemung

County, did possess an assault weapon.

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the

committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Steuben

County, did possess a large capacity ammunition feeding device.

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

AND MARK BUSH, with the crime of CRIMINAL POSSESSION OF A WEAPON IN THE

THIRD DEGREE in violation of Section 265.02(5)(i) of the Penal Law of the State of New

York, committed as follows:

The defendants, acting in concert with each other, on or about March 10, 2022, in Steuben

County, did possess three or more firearms.

COUNT TWENTY-TWO

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

the crime of TAMPERING WITH PHYSICAL EVIDENCE in violation of Section 215.40(2)

of the Penal Law of the State of New York, committed as follows:


The defendants, acting in concert with each other, on or about June 8, 2022, in Schuyler

County, believing that certain physical evidence was about to be produced or used in an official

proceeding or a prospective official proceeding, and intending to prevent such production or use,

suppressed it by any act of concealment, alteration, or destruction, or by employing force,

intimidation or deception against any person.

COUNT TWENTY-THREE

THE GRAND JURY OF YATES COUNTY, by this indictment accuses the defendants

JABLONKSI, AND MARK BUSH, with the crime of OFFERING A FALSE INSTRUMENT

FOR FILING IN THE FIRST DEGREE in violation of Section 175.35(1) of the Penal Law of

the State of New York, as committed as follows:

The defendants, acting in concert with each other, on or about June 14, 2022 in Chemung

IN THE FIRST DEGREE in violation of Section 175.10 of the Penal Law of the State of New

York, as committed as follows:

The defendants, acting in concert with each other, on or about June 14, 2022 in Chemung

County, with the intent to defraud, he/they made or caused a false entry in the business records of

the New York State Department of Taxation and Finance, and when the intent to defraud included

the intent commit another crime or to aid or conceal the commission thereof.
