MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This MEMORANDUM OF AGREEMENT is executed by and between:

JOLITA SAMBILAD, of legal age, widow, Filipino, and a resident of Barangay Tuyan,
Malapatan, Sarangani Province, hereinafter referred to as the FIRST PARTY;

- and –

1LT STEPHEN YANGZON, of legal age, single, Filipino, an active member of the
Armed Forces of the Philippines, and a resident of Barangay Poblacion, Malapatan,
Sarangani, Province, hereinafter referred to as the SECOND PARTY;

W I T N E S S E T H

WHEREAS, the FIRST PARTY is the aggrieved party, the mother of the
deceased/victim, MARJO SAMBILAD MILLA involved in a vehicular accident on
September 25, 2022 at the National Higway, Malapatan, Sarangani Province;

WHEREAS, the SECOND PARTY is the driver of Mitsubishi Strada Pick-up color
Gray Metallic with Conduction Sticker No. B8R867, engine no. 4N15UHA7240, chassis
no. MMBJLKL10MH075103, which vehicle was involved in the aforementioned
accident;

WHEREAS, the FIRST PARTY suffered damage and lost the life of her minor
child MARJO SAMBILAN MILLA as a result of the vehicular accident involving the
SECOND PARTY, and which the SECOND PARTY has agreed to answer and shoulder
the costs and expenses that may be required by reason of the said vehicular accident;

NOW, THEREFORE, for and in consideration of the above premises, both

parties have agreed on the following terms and conditions:

1. That for and in consideration of the amount of FIVE HUNDRED NINETY TWO
THOUSAND Philippine Currency (P592,000.00), the SECOND PARTY shall
compensate as payment and settlement for the loss of the life of MARJO
SAMBILAD MILLA, a minor and the only child of the FIRST PARTY. The said
amount is broken down as follows;

2. That the FIRST PARTY JOLITA SAMBILAD shall hereby absolutely release,
completely clear, and forever discharge the afore-described vehicle and
SECOND PARTY 1LT STEPHEN YANGZON from any action, cause of action,
sum of money, liability, damages, claims and demands whatsoever, which in law
or in equity she has, or which she, her heirs, insurer, successors and assigns
hereafter may have upon or by reason of the death sustained by her minor child
arising from the accident which happened on September 25, 2022 at National

Highway, Malapatan, Sarangani Province involving said vehicle registered in the

name of the PHILIPPINE ARMY with Conduction Sticker No. B8R867 with the
intention to completely and absolutely waive all her right of action, causes of
action, claims and demands, of whatever nature, arising from, or in connection
with the aforementioned accident;

3. That the said payment/settlement made by the said SECOND PARTY 1LT
STEPHEN YANGZON shall not be taken by the FIRST PARTY JOLITA
SAMBILAD, her heirs, her insurer or assigns, as a confession and/or admission
of liability on the part of the said SECOND PARTY, in connection with the
aforementioned incident;

4. We have read this document and have fully understood its contents. We
voluntarily and willingly execute this MEMORANDUM OF AGREEMENT with full
knowledge of our rights under the law.

and every page hereof by the concerned parties and their witnesses, and sealed with
my notarial seal.
