भारत में , प्रत्येक व्यक्ति द्वारा उसकी कुल आय (उसकी आवासीय स्थिति के आधार पर परिकलित) पर
आयकर दे य होता है , जो पिछले वर्ष के दौरान प्रासंगिक निर्धारण वर्ष के लिए लागू कर की दर से अर्जित किया
जाता है ।
⮚ सकल कुल आय: धारा 14: सकल कुल आय का अर्थ है आय के सभी पांच शीर्षों के तहत आय का योग।

⮚ कुल आय: धारा 2 (45): कुल आय का मतलब सकल कुल आय से कटौती/कटौती द्वारा गणना की गई
आय की कुल राशि है । दसू रे शब्दों में , सकल कुल आय से, धारा 80C से 80U के तहत कुछ कटौती की
अनमु ति है और कटौती के बाद शेष आय को कुल आय के रूप में जाना जाता है ।
♣ पिछला वर्ष: धारा 2 (34): पिछले वर्ष का अर्थ वह वर्ष है जैसा कि धारा 3 में परिभाषित किया गया है
धारा 3 : पिछले वर्ष का अर्थ है निर्धारण वर्ष से ठीक पहले का वित्तीय वर्ष।
♣ मल्
ू यांकन वर्ष: धारा 2 (9): मल्
ू यांकन वर्ष (AY) का अर्थ है हर साल 1 अप्रैल को शरू
ु होने वाले 12
महीने की अवधि।
नोट
(a) एक वित्तीय वर्ष 1 अप्रैल से शरू ु होकर अगले वर्ष के 31 मार्च तक 12 महीनों की अवधि होती है ।
(b) एक वित्तीय वर्ष में अर्जित आय अगले वित्तीय वर्ष में कर योग्य है ।
(c) जिस वर्ष में आय अर्जित की जाती है उसे पिछला वर्ष कहा जाता है ।
(e) और जिस वर्ष कर की गणना की जाती है उसे मल् ू यांकन वर्ष कहा जाता है ।
(f) एक वित्तीय वर्ष दोहरी भमि ू का निभाता है । यह पिछले वर्ष के साथ-साथ मल्ू यांकन वर्ष भी हो सकता है । एक
वर्ष में , यह मल्
ू यां कन वर्ष है , और फिर, यह अगले वर्ष में पिछला वर्ष बन जाएगा।

कर दे यता की गणना
किसी व्यक्ति की कर दे यता की गणना संबधि ं त वित्त अधिनियम अर्थात ् वित्त अधिनियम, 2019 में दी गई
स्लैब दरों पर की जाएगी और दरें नीचे दी गई हैं:
व्यक्तिगत, HUF, AOP, BOI और AJP के लिए कर दरें : भारत में हम व्यक्तियों और HUF के लिए
प्रगतिशील कराधान का पालन करते हैं। इस लक्ष्य को प्राप्त करने के लिए, वित्त अधिनियम आय के कराधान
के लिए स्लैब दरें प्रदान करता है ।
(c) इस स्लैब का उपयोग भारत में रहने वाले और 80 वर्ष या उससे अधिक आयु के प्रत्येक परु
ु ष और महिला
के लिए किया जाता है ।
गणना की गई कर की राशि को अधिभार, यदि लागू हो और शिक्षा उपकर की राशि से और बढ़ा दिया जाता है ।

⮚ यदि कुल आय 50 लाख रुपये से अधिक है लेकिन यह 100 लाख रुपये तक है तो @10% प्रदान किया
जाता है ।
⮚ यदि कुल आय 100 लाख रुपये से अधिक है लेकिन यह 200 लाख रुपये तक है तो @15% प्रदान किया
जाता है ।
⮚ यदि कुल आय 200 लाख रुपये से अधिक है लेकिन यह 500 लाख रुपये तक है तो @25% प्रदान किया
जाता है ।
⮚ यदि कुल आय 500 लाख रुपये से अधिक है तो @37% प्रदान किया जाता है ।
छूट केवल एक निवासी व्यक्ति को दी जाती है यदि कुल आय 500000 रुपये से अधिक नहीं है । छूट की अनम ु ति
अधिकतम 12500 रुपये के अधीन होगी। स्वास्थ्य और शिक्षा उपकर धारा 87A के तहत छूट की अनम ु ति के बाद
लागू होगा।
निर्धारिती के पास नीचे दी गई दरों पर धारा 115BAC के तहत आयकर की गणना करने का विकल्प है :

नोट:-
❖ हालांकि गैर-वेतनभोगी व्यक्ति यदि जिसका शीर्ष व्यवसाय/पेशे के तहत आय नहीं है , तो ऐसा व्यक्ति
साल-दर-साल आधार पर ऑप्ट इन और ऑप्ट आउट कर सकता है ।
❖ कर नियोजन के दृष्टिकोण से, एक करदाता को नई कर व्यवस्था के तहत मौजद ू ा व्यवस्था के साथ
आयकर की तल ु ना करनी चाहिए।
❖ एक बार जब करदाता वर्ष की शरु ु आत में कर व्यवस्था चन
ु लेता है , तो निवेश और TDS या अग्रिम कर जो
दे य होता है , उसके अनसु ार गणना की जा सकती है ।
❖ यदि करदाता नई कर व्यवस्था का विकल्प चन ु ना चाहता है तो करदाता को रिटर्न दाखिल करने से पहले
आयकर विभाग को फॉर्म10IE प्रस्तत ु करना होगा।
❖ यदि कोई व्यक्ति स्वास्थ्य बीमा, NPS में निवेश आदि के लिए कर बचत हे तु कम कटौती का दावा करता
है , तो नई व्यवस्था कर बचत निवेश का उपयोग करने वाले व्यक्तियों के मक ु ाबले अधिक फायदे मद ं होगी।
भारत में , हम फर्मों, कंपनियों और स्थानीय प्राधिकरणों के लिए समान कराधान का पालन करते हैं।
फ्लैट कराधान का मतलब है कि एक निश्चित दर पर आयकर की गणना ऐसे व्यक्ति की आय के
स्तर पर बिना ध्यान दिए की जाएगी।

✔ कंपनी धारा 10AA या 32(1)( iia) या 32AD या 33AB या 33ABA या 35(1) (ii)/ (iia)/(iii)/35 (2AA)
/(2AB) या 35AD या 35CCC या 35CCD या धारा 80H से 80TT (80JJAA के अलावा) के तहत
किसी कटौती का दावा नहीं कर रही है ।
✔ कंपनी किसी भी अग्रेषित हानियों का दावा नहीं कर रही है (यदि ऐसा नक
ु सान उपरोक्त बिंद ु में निर्दिष्ट

In India, Income Tax is payable by every Person on his Total Income (Calculated
depending upon his Residential Status) which is earned during Previous Year at the

⮚ Gross Total Income: Section 14: Gross total income means the aggregate of
income under all the five heads of income.
⮚ Total Income: Section 2 (45): Total Income means the total amount of income
computed by deduction/deductions from gross total income. In other words, from
the gross total income, certain deductions under Section 80C to 80U are allowed
and the balance income, after the deductions, is known as Total Income.
♣ Previous year: Section 2 (34): Previous Year means the year as defined in
Section 3
Section 3: Previous year means the financial year immediately preceding the
assessment year.

♣ Assessment Year: Section 2 (9): Assessment Year (AY) means the period
of 12 months commencing on the 1st date of April every year.

(a) A financial year is the period of 12 months starting from 1st April till 31st March of
the following year
(b) The Income earned in one financial year is taxable in the next financial year.
(c) The year in which income is earned is called Previous Year.
(e) And the year in which tax is computed is called Assessment Year.
(f) One financial year plays a dual role. It can be a previous year as well as the
assessment year. In one year, it is assessment year, and then, it will become the
previous year in the next year.
✔ Income earned in a financial year is not assessed in that financial year but in
the following financial year. TO this general rule, the following are the
exceptions:

Income computed under each head shall be added up to compute the gross total
income.
Certain concessions are allowed from the gross total income, which is called
deduction from gross total income under section 80C to 80U.
After permitting the deductions, the remaining income is called total income.

Note:- Tax on LTCG under section 112A shall be @ 10% in excess of Rs 100000

TAX RATES FOR INDIVIDUAL, HUF, AOP, BOI AND AJP: In India, we follow
Progressive Taxation for Individuals and HUFs. To achieve this goal, the Finance Act
provides slab rates for the taxation of income.

❖ From the perspective of Tax planning, a taxpayer must make a comparison of the income
tax under the new tax regime with the existing regime.
❖ Once the taxpayer chooses the tax regime at the beginning of the year, the investments
and TDS or advance tax which is payable can be calculated accordingly.
❖ The taxpayer has to furnish Form 10IE to the income tax department before filing the
return if the taxpayer intends to opt for the new tax regime.
❖ In case an individual claims lower deductions for tax savings, towards health insurance,
investment in NPS etc, the new regime will be more beneficial as against individuals
who utilise the tax saving investments.
In India, we follow flat taxation for firms, companies and local authorities. Flat
taxation means that income tax at a fixed rate will be calculated irrespective
of the level of Income of such a Person.
