COMES NOW, ANDREW SCOTT FULKERSON, PLAINTIFF PRO SE, (hereinafter “affiant”) being
first duly sworn upon his oath, and deposes and says the following pursuant to penalties
summons may be about to issue in which the State of Oklahoma and all subdivisions thereof
may be named Defendant in the United States District Court for the Northern District of
Oklahoma, Tulsa Division. On or about December 11, 2022 at approximately 14:00 hours CST
2. On or about December 11, 2022 your affiant was stationed at a private residence
located at 4364 W. Sunburst Street, in the city of Sand Springs, County of Tulsa, State of
Oklahoma, and the Northern District of Oklahoma, containing your affiant’s office used

to carry out lawful duties under your affiant’s lawful authority as a provisional officer
observed two marked police vehicles bearing the insignia of the Sand Springs Police
4. At that time your affiant observed a white male officer exit the vehicle together
with a second officer in a separate marked vehicle that arrived at approximately the same
time. Said officers were observed to make contact with the resident or residents located
5. The weather report issued by the Tulsa International Airport at that time
indicated a visibility of ten (10) miles. The speed limit on W. Sunburst street, which is a
bi-directional street is 15 miles per hour. Therefore, there was no danger of the officer
being struck by other vehicles in ordinary reasonable operation. Therefore, there was no
reasonable need to use overhead lights to avoid being struck by oncoming vehicles.
6. Based upon your afffiant’s direct observation, The officers involved were
clearly not conducting a traffic stop at any time relevant to this affidavit.
7. Your affiant therefore has reason to believe, and does believe that said officer
or officers did knowingly and intentionally activate their overhead emergency lights in

I, the undersigned, do hereby affirm, under penalties for perjury pursuant to the
laws of the United States of America, that the facts contained in the forgoing AFFIDAVIT
correct based upon the undersigned's own personal knowledge and belief at the time
Code, Section 1746, and therefore need not be executed before a notary public.
