• 0.3% of world’s wealth is spend on charity – 2.5% can solve all world’s
problem. Rather than giving sadaqa to the poor, we lend them on interest?
• Limiting entrepreneurship
• No benefit what so ever from the one you give loan to; not even benefitting
from the shade of their house
Narrated Abu Sa`id: Allah's Messenger ﷺforbade the selling by Munabadha, i.e.
to sell one's garment by casting it to the buyer not allowing him to examine or
see it. Similarly he forbade the selling by Mulamasa. Mulamasa is to buy a
garment, for example, by merely touching it, not looking at it.

.ب الَّ ينظ َّر ِإلي َِّه َّ ِ وإلماَلمس َّة لمسَّ إلثَّو،ِنعَّ إلماَلمسة ِ وّنى، أ َّو ينظرَّ ِإلي ِه،يَّ ِلبه
Narrated Ibn `Umar: The Prophet ﷺforbade Muzabana; and Muzabana is the
selling of fresh fruit (without measuring it) for something by measure on the
basis that if that thing turns to be more than the fruit, the increase would be
for the seller of the fruit, and if it turns to be less, that would be of his loss.
Narrated Ibn `Umar from Zaid bin Thabit that the Prophet ﷺallowed the
rukhsah for selling of the fruits on the trees after estimation (when they are
ripe).
It was narrated that Hakim bin Hizam said: "I said: 'O Messenger of Allah ﷺ, a
man is asking me to sell him something that I do not possess; Shall I sell it to
him?' He said: 'Do not sell what is not with you."'

َّ َّت يَّ رسول ُ َّ ِ ْ ِيم
َّ قالَّ قل،ْب ِحزإم َّ ِ حك
Narrated Ibn `Abbas: Allah's Messenger ﷺcame to Medina and the people
used to pay in advance the price of fruits to be delivered within one or two
years. (The sub-narrator is in doubt whether it was one to two years or two to
three years.) The Prophet ﷺsaid, "Whoever pays money in advance for dates
(to be delivered later) should pay it for known specified weight and measure
(of the dates).
• If it is in the ownership of your agent (e.g. the logistic company you employed), that
is fine too
MULTIPLE SALES IN ONE CONTRACT ARE NOT ALLOWED
Narrated Abu Hurairah: "The Messenger of Allah ﷺprohibited two sales in one.“

ِ َّقالَّّنىَّرسولَّللاَِّصّلَّللاَّعليهَّوسلمَّنعَّبيعت،ِنعَّأ ِبَّهرْي
َّي َِّيفَّبَّيعة
Answer:
Narrated `Abdullah bin `Umar: Allah's Messenger ﷺsaid, "Do not urge
somebody to return what he has already bought (i.e. in a sale where an option
to return is available) from another seller so as to sell him your own goods."

It was narrated from Abu Qatadah that the Messenger of Allah ﷺsaid: "Beware
of swearing oaths when selling, for it may help you to make a sale but it destroys
the blessing."'
Narrated Abu Sa`id: We used to be given mixed dates (from the booty) and used to
sell (barter) two Sas (of those dates) for one Sa (of good dates). The Prophet ﷺsaid
(to us), "No (bartering of) two Sas for one Sa nor two Dirhams for one Dirham is
permissible", (as that is a kind of usury).

Narrated `Urwa: Aisha said, "Barira came to me and said, 'I have agreed with my
masters to pay them nine Uqiyas (of gold) (in installments) one Uqiya per year…
AUCTION
Narrated Anas bin Malik: That the Messenger of Allah ﷺsold a saddle blanket and a drinking
bowl. He ﷺsaid: "Who will buy saddle blanket and drinking bowl?". So a man said: "I will take
them for a Dirham." So the Prophet ﷺsaid: "Who will give more than a Dirham ? Who will give
more that a Dirham ?" A man agreed to give him two Dirham, so he sold them to him.
Narrated Jabir: The Prophet ﷺsold a Mudabbar (on behalf of his master who
was still living and was in need of money).

The one with whom the security is deposited cannot benefit from it. The person who
deposits can.
PRE-EMPTION
Narrated Jabir bin `Abdullah: Allah's Messenger ﷺdecided the validity of pre-
emption in every joint undivided property, but if the boundaries were well
marked or the ways and streets were fixed, then there was no pre-emption.

Narrated Abu Huraira: The Prophet ﷺsaid, "Allah says, 'I will be against three
persons on the Day of Resurrection: 1. One who makes a covenant in My Name,
but he proves treacherous. 2. One who sells a free person (as a slave) and eats
the price, 3. And one who employs a labourer and gets the full work done by
him but does not pay him his wages.' "

Narrated `Abdullah: Allah's Messenger ﷺrented the land of Khaibar to the Jews
on the condition that they would work on it and cultivate it and take half of its
yield.

It was narrated that Hakim bin Hizam said: "I asked the Prophet PBUH "O Messenger
of Allah, a man may come to me and ask me to sell him something that I do not have.
Can I sell it to him then go and buy it from the market?' He said: 'Do not sell what
you do not have.'‘’

Narrated 'Aishah R.A.: "The Prophet ﷺjudged that the produce is for the one
responsible.” … As for the meaning of "the produce is for the one responsible,"
he is the man who purchased the slave then the slave produced for him, and
he found some defect in him, so he returned him to the seller. Then the
produce (of his work before return) is the right of the purchaser's. In cases
similar to this, the produce is for the one responsible.

Narrated Abu Huraira: Allah's Messenger ﷺsaid, "Whoever buys a sheep which
has been kept unmilked for a long period, and milks it, can keep it if he is
satisfied, and if he is not satisfied, he can return it, but he should pay one Sa of
dates for the milk."
Narrated Jabir bin `Abdullah: The Prophet ﷺsaid, "The right of pre-emption is valid in
every joint undivided property, but when the land is divided and the way is
demarcated, then there is no right of pre-emption."

tradition was that they buyer and the seller had the

Thamud, at a distance of three days journey from

Al-Madina, while he made me neared to Al-Madina, َّ ِ ث ليالَّ وساق

at a distance of three days journey from my former ْ

It is allowed to deal with a Shariah compliant branch in a bank that deals with interest as long as the
actual transaction is allowed such as a profit and loss sharing contract (Mudharabah), partnership
(Musharakah), Murabahah or other financing options that are valid according to Islamic law. These
transactions would not be tainted by the fact that the bank’s funds are from unlawful means. The
Prophet PBUH did business with the polytheists of Makkah and the Jews of Madinah, and in fact, he
even ate from the food offered by the Jewish tribes, fully aware that they engaged in interest.

WHY IS THE TITLE NOT TRANSFERRED IN THE NAME OF

Prior to 1863, under Old System title, a mortgage required a borrower to forfeit legal ownership of their land (real property) to a
lender until the loan had been repaid in full (ie. the borrower / mortgagor would transfer the legal title to the lender during the
term of the loan). During the loan term, the borrower only held an equitable interest in the land known as equitable
redemption. Once the borrower had repaid the loan, the lender would execute a transfer of the land back to the borrower, or in
some cases, court orders were sought for the lender to do so. Whilst Old System title was satisfactory, different title deeds could
be drawn up for the same piece of land, causing uncertainty as to land ownership. Often, careful examination of a chain of
deeds, with a minimum period of 30 years, was required to determine the true owner of the land (otherwise known as evidence
of the good root of title to the land).
The transition to a Torrens title system ‘simplified ownership precisely’, as it ensured all interests in the land were recorded on
one title deed for a property, eliminating the need to tediously search the register to evidence a good root of title to the land.
The operation of mortgages under Torrens title system no longer requires the legal title to the land to be transferred from the
borrower to the lender (in the true sense of a “mortgage”). Instead, a Torrens mortgage is simply created as a statutory charge
over the land. In Guthrie V Australia & New Zealand Banking Group (1991)[4], Justice Meagher explained:
“When land is under Torrens title, in view of the Real Property Act 1900, s 57, which provides that a mortgage under that Act has
the effect of a security but does not operate as a transfer of the legal estate in the mortgaged property, a statutory mortgage has
the same effect as a charge would have had if the land were held under common law title”
In doing so, the borrower remains as the legal proprietor of the land but will be prohibited from, among other things, disposing
of the land, leasing, sub-dividing or changing the use of the land without first obtaining the lender’s consent. Once the loan is
repaid, the lender merely discharges the mortgage from the land.

caravans in the lifetime of the Prophet. The Prophet ( )ﷺused to forbid them

till they carried it to the market where foodstuff was sold. Ibn `Umar said, 'The
Prophet ( )ﷺalso forbade the reselling of foodstuff by somebody who had
