The undersigned accuses PAUL CRUZ Y MENDOZA (@PADRINO) of violation of Section 5,


Article II of Republic Act 9165, as amended, committed as follows:

That on or about 8:45 AM of December 11, 2020, in the City of Malolos, Bulacan, Philippine,
the said, not being then authorized by law to sell, trade, deliver or give away to another
any dangerous drug, did then and there willfully, unlawfully, and knowingly sell to PCpl.
Oliver de Guzman y Hernandez, a police poseur-buyer of One (1) heat-sealed
transparent plastic sachet with subsequent markings EFC01 12-11-2020 signature
containing FIVE POINT TWENTY-FIVE (5.25 Grams) of white crystalline substance
containing Methamphetamine Hydrochloride, a dangerous drug.

AFFIDAVIT OF COMPLAINT

I, FRANCHESCA y OCTAGON, Filipino, of legal age, and residing at 101 Night


Drive, Timog Park Home Subdivision, Malolos, Bulacan, accuses ALEJANDRO SUMIPA y
TABUL and two other persons of the crime ROBBERY, committed as follows:

1. That at around 4:50 PM of August 11, 2021, I was driving along Manuel A.
Roxas Highway with my motorcycle, about 400 to 500 meters away from Ford
Malolos, when two other riders suddenly went beside me (each side).

2. That one of them wore black jacket, black helmet, and brown long pants who
was driving a Yamaha N-Max colored matte black and had someone behind
him (back ride) who wore red helmet, denim short pants, and black Adidas
sandals.

3. The back ride pointed a gun (revolver) at me and shouted, “Itabi mo, itabi mo
puputukan kita!”

4. That the other rider drove in front of me to block me and prevent me from
accelerating and getting away from them. He wore blue hoodie jacket, denim
long pants, and blue Nike shoes (which were the same clothes my co-worker,
ALEJANDRO SUMIPA TABUL, worn whom I met from the bank I went to)
who rode a Yamaha Mio i125 colored yellow.
5. That the rider in front of me shouted at the other two who were driving the
other motorcycle beside me, “H’wag niyong saktan!” This is when I confirmed
that he and my co-worker, ALEJANDRO SUMIPA TABUL, had the same voice.
Hence, ALEJANDRO SUMIPA y TABUL was one of my offenders.

6. That I parked in front of the SPRING Hotel along the same highway. ALEJANDRO
SUMIPA TABUL and the two other unknown men immediately followed me and
forcibly took my bag containing cash amounting to PHP 5,000,000.00 while
holding me at gunpoint.

7. After they took my money, they immediately rode their motorcycles and leave
to drive toward the northbound of Manuel A. Roxas Highway.

8. That I am executing this complaint-affidavit in order to file a case of Robbery


against ALEJANDRO SUMIPA y TABUL, and the two other unknown men who
conspired with the former.

9. That all these stated herein are true and were stated freely without any force
or intimidation done against me.

SWORN NARRATIVE AFFIDAVIT OF


ARREST AND PROSECUTION

I, PCpl. Paulo Teodorico, of legal age, a member of the Philippine National Police
and assigned to Malolos City Police Station as an SDEU Operative, who, after taking an oath
in accordance with our existing Constitution, freely and voluntarily narrates as follows.

That, on December 11, 2020 at approximately 4:00 in the morning, while I and my
fellow operatives were passing our station and performing our duties, our COP, PLTCOL
Ronaldo Cruz, summoned us to his office and ordered us to find out if there was truth and
track down an @LOLONG who was reported by a confidential informant regarding his
alleged rampant sale of illegal drugs here in the City of Malolos, Bulacan, specifically in
Brgy. Ubas, Bulacan. According to this, he usually uses a red Toyota Innova car, and the
illegal sale of illegal drugs takes place inside the car itself;

That, because of that, led by our C, Intel/DEU PCPT Henry De Guzman, we were dispatched
to our station at approximately 4:00 in the morning of the same date to find out if there
was truth in the complaint to monitor (Casing Surveillance) the actions of @LOLONG,
who, according to our gathered information, is positive that he is actually selling illegal
drugs, whose real name we found out is that he is a native of Baliwag, Bulacan;

That, according to our confidential informant, he is said to be able to make a transaction


with @LOLONG because he knows him since he has bought here once, and their
transaction was also inside the car;

That, after we confirmed that the report regarding @LOLONG’s illegal activity was true,
we immediately returned to the station and informed our COP of the information we
gathered;

That, our C, Intel/DEU, PCPT Henry De Guzman, instructed PCMS Rufino Herrera to
contact possible witnesses to the inventory being held should our buy-bust operation be
successful;

That, at our headquarters we immediately planned under the leadership of our C,


Intel/DEU and we agreed that I would act as poseur buyer while Pat. Paulo Teodorico
will be my back-up security and he will also act as photographer in case our operation is

successful, and our C, Intel/DEU handed me one (1) one thousand peso piece with serial
number PL123456 that I marked with a check (✓) on the forehead of Vicente Lim and
together with our confidential informant we will try to buy illegal drugs from @LOLONG
and in case our transaction takes place inside the car I will put out my left hand when I had
already bought illegal drugs as a signal (pre-arrange signal) to my comrades that I had
already bought illegal drugs and while we were planning our C, Intel/DEU PCPT Henry De
Guzman ordered our colleague PCMS Rufino Herrera to coordinate with PDEA Region 3
for a possible Buy-Bust Operation to arrest @LOLONG even we were given control
number 102-2214-5523 by Ms. Cristina Galvez, until around 7:00 in the morning of
December 11, 2020 our confidential informant was able to make a transaction with
@LOLONG and they agreed to meet our confidential informant in Brgy. Ubas City of
Malolos, Bulacan.

That, after our final briefing at approximately 8:45 in the morning of December 11, 2020,
we immediately dispatched to our headquarters for our buy-bust operation and a few
minutes before the agreed meeting time of our CI and by @LOLONG we (Me and CI) have
decided to go to the discussed place with a motorcycle;

That, when we got there, our confidential informant immediately saw the car used by
@LOLONG, a Toyota Innova in yellow, with license plate NDU 1234, parked at their
agreed place, so I parked our motorcycle near their car. We walked towards @LOLONG’s
car, and I noticed that my fellow operatives were there, who were stationed in the very car
used by @LOLONG. As we had planned;

That, when we finally got close to the car used by @LOLONG, our CI simply knocked on the
back door of the car, which we immediately entered after unlocking its door;

Now, when we were inside, our CI and @LOLONG talked to me, where our CI introduced
me as his cousin, who said he wanted to know why we were there and then asked,
"Magkano bibilhin niyo?" At that time, I was the one who spoke and said "Isang bulig boss"
(which means one thousand pesos) and this @LOLONG again said "OK sige." At the same
time, he reached into his pocket and took out a small plastic sachet of suspected shabu and
handed it to me. After I received it from @LOLONG I handed him our one (1) one thousand
peso marked money;

That, I normally looked at the time on my watch, where I found out that it was 9:45 in the
morning, and when I made sure that I pocketed what I bought in my empty right pocket, I
opened the window and took out my left hand as a signal to my colleagues that I had
already bought illegal drugs, and immediately after that, I approached Pat. Paulo
Teodorico and my other fellow operatives, and they surrounded the vehicle;

That, @LOLONG tried to start the car, but I immediately stopped it at the same time as I
introduced the police;

That, I let @LOLONG out of the car, and after he got out, he was informed that the suspect
had been arrested for his violation of the law. I also informed him of his rights (Miranda
Doctrine), and after that, I immediately handcuffed him;

That, to make sure that @LOLONG is not hiding anything that could hurt or kill him that he
can use against us, I asked @LOLONG that if possible, he would take out the contents of
the pocket of his shorts and from his right pocket he took out one (1) piece of plastic
sachet containing suspected shabu, one (1) ITEL cellphone with a red housing and we
also recovered from his possession one (1) one thousand pesos marked money bought
with illegal drugs;

That, the evidence I got from @LOLONG I preserved and separated from the illegal drugs I
bought from him;

That, at approximately 10:00 in the morning of the same date, the inventory witness
Elected Barangay Official of Brgy. Ubas, Brgy. Kagawad Aljhon Sabino, at approximately
10:15 in the morning of the same date, Katrina Perez-DOJ representative arrived at the
same time. Joanne Cruz-Media Representative;

That, the corresponding document (Chain of Custody Form) is attached hereto as


verification of the said turn-over of the evidence mentioned;

That, in the ongoing investigation by our investigator, we learned the complete identity of
the suspect @LOLONG as ALEJANDRO SUMIPA y TABUL, 42 years old, married,
unemployed, native of Paltao, Pulilan, Bulacan and currently residing in
Dasmarinas, Cavite;

That, after the investigator made the relevant documents, we (me, Pat. Paulo Teodorico
and PCpl. Cristopher Aguas) brought the suspect to the Bulacan Provincial Crime
Laboratory where the obtained suspected shabu was tested at 1:00 in the afternoon of
December 11, 2020 and received by PMAJ Oliver Ortega, and this @LOLONG was
subjected to a drug test at 3:05 pm on the same date, which was received by PSSg.
Anthony Dimaculangan. The corresponding photo taken by Pat. Paulo Teodorico is
attached. We are here confirming that PCpl. Christopher Aguas turned over the evidence
that was bought and obtained from @LOLONG and after that, we also took him to the
Bulacan Medical Center to be medicalized;

That is the evidence I bought and confiscated from the arrested @LOLONG that I formally
turned over to the investigator, PCpl. Christopher Aguas. The evidence was not
transferred to the custody of anyone other than the one I mentioned, and this was done by
me to preserve the integrity and value of the evidence since it will be marked, written in
the inventory, photographed by Pat Teodorico, and documented in front of witnesses
when the suspect is arrested until he is brought to our Police Station in compliance with
the Chain of Custody Rule;

That, I made this narrative based on the events and my knowledge and to confirm the case
we will file against ALEJANDRO SUMIPA y TABUL @LOLONG, 40 years old, married,
unemployed, native of Paltao, Pulilan, Bulacan and currently residing in
Dasmarinas, Cavite, facing a charge of violation of Sec. 5 and 11 of Art. II of RA 9165
(Comprehensive Dangerous Drugs Act of 2002),

ALEJANDRO SUMIPA y TABUL at dalawa pang katao ng krimeng ROBBERY
(PAGNANAW), na ginawa tulad ng sumusunod:

1. Na bandang 4:50 PM ng August 11, 2021, binabaybay ko ang kahabaan highway ng


Manuel A. Roxas kasama ang aking motorsiklo, mga 400 hanggang 500 metro ang
layo mula sa Ford Malolos, nang biglang tumabi sa akin ang dalawa pang rider (kada
gilid).

2. Na ang isa sa kanila ay naka-itim na jacket, itim na helmet, at maong na pantalon ay


nagmamaneho ng Yamaha N-Max na may kulay matte black at may tao sa likod siya
(back ride) na nakasuot ng pulang helmet, maong na pantalon, at itim na Adidas
sandals.

3. Tinutukan ako ng nakasakay sa likod ng baril (revolver) at sumigaw, “Itabi mo, itabi
mo puputukan kita!”

4. Na, ang isa pang sakay ay nagmamaneho sa harap ko upang harangan ako at pigilan
ako bumibilis at lumalayo sa kanila. Nakasuot siya ng kulay asul na jacket na may
hoodie, denim na pantalon, at asul na sapatos na Nike (na parehong damit ng aking

AFFIDAVIT OF ARREST
We, the UNDERSIGNED Police Officers Pat. Paulo Teodorico and Pat. Ryan Cruz, both
members of the Philippine National Police, presently assigned at the Police Station of
Poblacion, Malolos, Bulacan, do hereby depose and state that:

1. We are among the members of the Poblacion Police Station who conducted hot-
pursuit operations in Poblacion, Malolos, Bulacan.

2. The said operation stemmed from the complaint of FRANCHESCA y OCTAGON for
violation of ROBBERY, which was received by our station.

3. On the complaint dated August 11, 2021, for robbery

4. Upon receipt of their said complaint, our office planned a hot-pursuit operation
against the suspect. At about 1700 on August 11, 2021, the undersigned, together with
the complainant, proceeded to the prearranged pay off.

5. Upon arrival there, the complainants waited for the suspect to arrive while we the
undersigned sat near the table with the complainants. At about 1730, a suspect arrived
and approached the complainants and, after a few conversations.

6. The suspect was brought to the Municipal Police Station of Poblacion, Malolos,
Bulacan for booking and proper disposition. Likewise, the arrested person was apprised
of his rights as provided for under the Constitution of the Philippines.

7. Seized and recovered in the possession and control of the arrested person were the
following:

 Revolver
 Yamaha Mio i125 (NDU-2231) in yellow.
 Amounting to PHP 5,000,000.00 in cash.

8. The suspect, together with the seized and recovered evidence, was brought to the
Poblacion Police Station, Malolos, Bulacan for booking and proper disposition.
Likewise, the arrested person was apprised of their rights as provided for under the
Constitution of the Philippines.

We executed this joint affidavit to attest the truthfulness of the foregoing facts and
to support the filing of Criminal Cases against ROBBERY for violations of Art. 294.
