US EXPORT CONTROLS ON UBIQUITI PRODUCTS

Ubiquiti Inc. (“Ubiquiti”) is committed to conducting its business with honesty and
integrity, and in full compliance with the U.S. export control and trade and economic
sanctions regulations. Compliance with these laws is critical to the Ubiquiti’s
reputation and success.
The U.S. Government administers and enforces certain laws and regulations that
cover the sale and shipment of Ubiquiti products to foreign countries. The key laws
and regulations are:
• The Export Administration Regulations (“EAR”), administered by the Bureau of
Industry and Security (“BIS”), apply to the sale, shipment and transfer of our
goods and technology to foreign companies and foreign persons located both
in the United States and abroad.
• The trade and economic sanctions regulations, administered by the Office of
Foreign Assets Control (“OFAC”), restrict trade, investment, and financial
transactions with certain countries, organizations, and individuals.
By selling, shipping, using or otherwise transferring Ubiquiti’s products you are
agreeing to comply with all applicable export and reexport control laws and
regulations, including the EAR and OFAC.
No Ubiquiti products can be sold, shipped or otherwise transferred to any
country subject to U.S. embargoes or anti-terrorism controls, currently Cuba,
Iran, North Korea, Sudan, Syria and the Crimea Region of the Ukraine. Ubiquiti
products cannot be sold, shipped or otherwise transferred, directly by Ubiquiti
or by you as one of our distributors or by one of your customers or resellers to
one of these restricted destinations
Information on the Export Control Classification Number (“ECCN”) of Ubiquiti’s
products can be found in the chart here. The ECCN determines the level of control of
the item. Many of Ubiquiti’s products are classified as “ENC-Restricted” and cannot be
transferred without a license to government end-users outside of the United States,
Canada, Europe, Japan, and Australia. These products include:

Under the Export Administration Regulations, a government end-user is defined as “any
foreign central, regional or local government department, agency, or other entity performing
governmental functions; including governmental research institutions, governmental
corporations or business units, and international governmental organizations.” However, the
term does not include: utilities (including telecommunications companies and Internet service
providers); banks and financial institutions; transportation; broadcast or entertainment;
educational organizations; civil health and medical organizations; retail or wholesale firms; and
manufacturing or industrial entities.
No person or entity may sell, ship or otherwise transfer Ubiquiti products without a license to
anyone on a U.S. Government list of prohibited persons, including but not limited to U.S.
Treasury Department’s lists of Specially Designated and the BIS’s Denied Persons List, Entity
List, or Unverified List. Further, Ubiquiti products may not be used for any chemical or
biological weapons, and sensitive nuclear end-uses, or missiles to deliver them.
You are responsible for ensuring that any of your employees, contractors, affiliates and
customers are clearly made aware of these regulations.
Failure to comply with U.S. export control and trade and economic sanctions laws and
regulations can result in criminal sanctions, civil fines, debarment from government
contracting, the loss of U.S. export privileges, and imprisonment. The reach of these laws and
regulations covers U.S. persons as well as foreign persons, wherever located.
