ABOUT THE PARTIES

According to Hindu rites and rituals, Akash and Tara got married on 20.11. 2020 in
Mahindra. Tara is employed by a foreign company and has a busy travel schedule
because she was in charge of setting up a new unit. Akash is in the army.
After being married, they both agreed to go to a doctor for advice on family planning and
contraception because they didn't want to start a family for at least 3 years.

B. Background Facts

Despite Contraception, within 6 months, Tara was found to be 6 weeks pregnant. Tara
informed her husband however Akash strangely developed some kind of affection
towards the developing unborn child, the moment he was informed about the same, even
though they had mutually decided not to have a child for 3 years. After Akash told his
family about Tara's pregnancy, everyone put pressure on her to have the kid and avoid
having an abortion. Pregnancy termination, according to them, is equivalent to killing the
foetus.

C. LEGAL DISPUTE

As she had work obligations and couldn't deliver a child at such a critical time. Tara
made the decision to have an abortion since she wasn't mentally prepared to have a child
at this time. When Tara arrived at the hospital, she was required to complete a paperwork,
one of which included a part requiring her husband's approval. Since Tara's husband
wanted a child, he refused to allow the abortion, therefore the hospital wasn't prepared to
carry it out.
In order to protect her rights, Tara approached the Hon’ble Supreme Court of Kushan for
relief.
